HomeMy WebLinkAboutCOUNCIL - AGENDA ITEM - 03/16/1999 - FIRST READING OF ORDINANCE NO. 44, 1999, APPROPRIA AGENDA ITEM SUMMARY ITEM NUMBER: 16 DATE: March 16, 1999 FORT COLLINS CITY COUNCIL STAFF: Matt Baker SUBJECT: First Reading of Ordinance No. 44,1999, Appropriating Prior Year Reserves and Unanticipated Revenue in the Street Oversizing Fund and Authorizing the Transfer of Appropriations from the Street Oversizing Fund to the Capital Projects Fund for the South Timberline Road Improvement Project. RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT: This Ordinance will appropriate $1,119,718 into the Capital Projects fund to construct arterial roadway improvements for the Timberline Road at Willow Springs Improvement Project. This project will go to bid as soon as funds are available. Funds have been received and will be appropriated as follows: Willow Springs Development (Contribution in Aid) $127,536 Street Oversizing Fund $861,747 Ft Collins/Loveland Water District $128,435 (In Anticipation of Funds) This will not affect the Street Oversizing Fund's ability to meet its other construction obligations in 1999. EXECUTIVE SUMMARY: Arterial street improvements are planned for Timberline Road at Willow Springs from Battle Creek Drive to the Mail Creek Ditch. These improvements include curb and gutter, detached sidewalks, bike lanes,right turn lanes,and the installation of anew sixteen-inch(16")water main. The project is predominantly funded by the Street Oversizing Program, but includes a Development portion contributed in the form of a Contribution In Aid, as well as a contribution from the Fort Collins/Loveland Water District. The Fort Collins/Loveland Water District portion will cover costs of extending the District's water line to meet future needs. Staff is requesting funds to be appropriated from the Street Oversizing Fund to the Capital Projects Fund for the purpose of starting these arterial road improvements in May of 1999. Staff believes this project needs to start in the spring of 1999 in order to avoid severe traffic delays and congestion in the area. Arterial improvements on Timberline Road at Willow Springs are also necessary in 1999 to keep construction impacts on city residents to a minimum. CKGROUND: Over the past year staff has completed the design of the Timberline Road Widening at Willow Springs project. The improvements will span from Battle Creek Drive,south to the city limits at the Mail Creek Ditch. The project will include reconstruction of the roadway, including curb, gutter, DATE: March 16, 1999 2 ITEM NUMBER: 16 sidewalks, and bike lanes. Additional upgrades to the project will include the installation of a new sixteen-inch(16") City water main. The project will also include the installation of anew sixteen- inch (16") Fort Collins/Loveland Water District water main to meet future needs for the District. This joint effort between the City and District has been formed in order to take economic advantage of the project's riming and to benefit both parties now and in the future. Staff has designed the project to save 16 existing large cottonwood trees and several other existing tree species. The project is planned to begin construction in May of 1999, with final completion in the fall of 1999. Funding for the project is through the Street Oversizing Program and developer contributions. Street Oversizing will contribute $863,747, and developer contributions(Contributions in Aid)will total $127,536. The Fort Collins/Loveland Water District will install a new sixteen-inch(16")water main for future capacity in conjunction with this project. All costs for the extension will be paid for with funds received from the Fort Collins/Loveland Water District. This coordinated effort between the City and the District will allow this infrastructure to be built more cost effectively due to the economy of scale of the combined project. It will also reduce future inconvenience to the traveling public by having all utilities completed prior to roadway construction. Due to current and future development in the area,this section of Timberline Road has a declining Level Of Service(LOS). The improvements for Timberline Road at Willow Springs will require that Timberline Road be closed to the traveling public the full extent of the project. Although this will be an inconvenience for the local area traffic, access for local residents will be maintained with signed alternate routes. These alternate routes will be indicated to the public using high intensity orange construction zone signs. Staff has been working with the local residents both in the city limits and in the County to minimize the impacts of this large project. In order to take this project to bid and to start construction in May,all funds for the project must be appropriated into the Capital Project fund. The developers have already provided their funds for the improvements, and Street Ovbrsizing funds are budgeted and appropriated for the remaining share of the improvements. Funds from the Fort Collins/Loveland Water District will be collected prior to bid opening. . ORDINANCE NO. 43, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES AND UNANTICIPATED REVENUE IN THE STREET OVERSIZING FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM THE STREET OVERSIZING FUND TO THE CAPITAL PROJECTS FUND FOR THE SOUTH TIMBERLINE ROAD IMPROVEMENT PROJECT WHEREAS, a section of Timberline Road from Battle Creek Drive south to the city limits at the Mail Creek Ditch has a declining level of service for traffic, with severe traffic delays and congestion projected,beyond 1999,if improvements are not constructed; and WHEREAS, City staff has been working on the design plans for improvements to the aforementioned section of Timberline Road(the"Project')including reconstruction ofthe roadway, curb, gutter, sidewalks, bike lanes, and installation of new sixteen-inch (16") water mains for the City and the Fort Collins/Loveland Water District; and WHEREAS,the estimated cost of the Project is $1,119,718, and funds are available in the form of existing appropriations ($863,747), prior year reserves in the Street Oversizing Fund, consisting of contributions from developers in the vicinity of the Project ($127,536), and a contribution from the Fort Collins/Loveland Water District for their share of the improvements ($128,435); and • WHEREAS, upon completion of the bid process, the Project would begin in the Spring of 1999, with final completion and landscaping scheduled for Fall of 1999; and WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter") permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years,notwithstanding that such reserves were not previously appropriated; and WHEREAS, Article V, Section 9, also pernuts the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations, in conjunction with all previous appropriations for that fiscal year,do not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, it is the desire of the City Council to appropriate $127,536 from prior year . reserves in the Street Oversizing Fund and authorize the transfer of said amount,along with existing appropriations totaling $836,747 from the Street Oversizing Fund,to the Capital Projects Fund,and to appropriate $128,415 in unanticipated revenue in the Capital Projects Fund, representing a contribution from the Fort Collins/Loveland Water District, to be used to construct improvements along Timberline Road from Battle Creek Drive to the Mail Creek Ditch. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Sectionl. That there is hereby appropriated from prior year reserves in the Street Oversizing Fund for transfer to the Capital Projects Fund, Timberline Road Improvement Project and appropriated therein the sum of ONE HUNDRED TWENTY-SEVEN THOUSAND FIVE HUNDRED THIRTY-SIX DOLLARS ($127,536) to be used to construct improvements along Timberline Road from Battle Creek Drive south to the Mail Creek Ditch. Section 2. That the unexpended appropriated amount of EIGHT HUNDRED SIXTY- THREE THOUSAND SEVEN HUNDRED FORTY-SEVEN DOLLARS ($863,747) is hereby authorized for transfer from the Street Oversizing Fund to the Capital Projects Fund, Timberline Road Improvement Project and appropriated therein to be used to construct improvements along Timberline Road from Battle Creek Drive south to the Mail Creek Ditch. Section 3. That there is hereby appropriated for expenditure from unanticipated revenue in the Capital Project Fund, Timberline Road Improvement Project, the sum of ONE HUNDRED TWENTY-EIGHT THOUSAND FOUR HUNDRED THIRTY-FIVE DOLLARS ($128,435), representing a contribution from the Fort Collins/Loveland Water District,to be used to construct improvements along Timberline Road from Battle Creek Drive south to the Mail Creek Ditch.
