RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. EXECUTIVE SUMMARY: This Ordinance will dedicate additional right-of-way to the Colorado Department of Transportation for access right-of-way for future widening of the south side of State Highway 68 (Harmony Road) from County Road 9 east to Cambridge Drive. This new right-of-way is in addition to that dedicated with the Harmony Technology Park First Filing Plat. ORDINANCE NO. 82, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO EXECUTE A QUIT CLAIM DEED DEDICATING TO THE COLORADO DEPARTMENT OF TRANSPORTATION CERTAIN PORTIONS OF THE ACCESS RIGHTS-OF-WAY ON HARMONY ROAD ADJACENT TO HARMONY TECHNOLOGY PARK FIRST FILING WHEREAS,the State of Colorado has established and dedicated certain access rights-of-way locations from Colorado State Highway 68 (Harmony Road); and WHEREAS, the Planning and Zoning Board of the City has approved a final plan for a project entitled"Harmony Technology Park First Filing'; and WHEREAS, the approval of the Harmony Technology Park First Filing requires the dedication to the State of Colorado Department of Transportation("CDOT")of the access rights-of- way as established by CDOT more particularly described on Exhibit "A", attached hereto and incorporated herein by this reference; and WHEREAS, said access location from the Harmony Road right-of-way is desirable for a dedicated public street connection known as "Technology Parkway"; and • WHEREAS, pertinent City and State agencies have been contacted and have reported no objection to the proposed access change,provided that a new access location be dedicated to CDOT; and WHEREAS, the right of the residents of the City of Fort Collins will not be prejudiced or injured by the dedication of said street access rights-of-way to CDOT; and 'WHEREAS, the City Council hereby finds that the dedication of said access rights-of-way to CDOT is in the best interests of the City. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be,and hereby is authorized to execute a quit claim deed dedicating to the Colorado Department of Transportation those certain portions of street access rights-of-way,which rights-of-way are more particularly described on Exhibit"A" attached. • Introduced,considered favorably on first reading and ordered published this 18th day of May, A.D. 1999, and to be presented for final passage on the 1 st day of June, A.D. 1999.
