RECOMMENDATION: Staff recommends adoption of the Resolution and of the Ordinance on First Reading. `} i FINANCIAL IMPACT: Federal "ISTEA” funds will pay for 100% of the cost to upgrade the crossing warning devices. $169,413 in Federal Funds has been budgeted towards this project and is being appropriated into the City's Minor Streets Capital Fund. The City is required to pay for the Colorado Department of Transportation's costs for administering the project. These costs, estimated at$2,587,will be paid 410 with existing Minor Streets Capital Funds. EXECUTIVE SUMMARY: A. Resolution 99-95 Authorizing the City Manager to Enter into an Agreement with the Colorado Department of Transportation, and the Burlington Northern Santa Fe Railway Company for Upgrading the Crossing Warning Devices at the West Drake Road and Burlington Northern Santa Fe Railroad Crossing. B. First Reading of Ordinance No. 123, 1999, Appropriating Unanticipated Revenue in the Capital Projects Fund Minor Streets Capital Project to Be Used to Upgrade Crossing Warning Devices at the West Drake Road and Burlington Northern Santa Fe Railroad Crossing. The agreement with the Colorado Department of Transportation (CDOT), and the Burlington Northern and Santa Fe Railway Company (BNSF), is for upgrading the crossing warning devices at the West Drake Road and BNSF crossing as shown on the attached map. The project consists of upgrading the existing signal system and adding gates to improve safety. A 'constant warning device" that monitors the track for approaching trains will also be upgraded with new equipment. The "constant warning device" minimizes the delay to traffic at the crossing. The new equipment will also reduce the risk of equipment failure which can cause extensive delays to traffic. DATE: August 3, 1999 2 ITEM NUMBER: 16 A-B The City applied for and received Federal ISTEA Funds to pay for 100%of the cost to upgrade the crossing warning devices. Ordinance No. 123, 1999, appropriates the $169,413 in Federal Funds budgeted towards the project in to the City's Minor Streets Capital Project in the Capital Projects Fund. The BNSF's estimated cost for the upgrade is $162,913. The City is required to pay for CDOT's costs for administering the project, because the federal funds may not be used for this purpose. These costs, estimated at $2,587, will be paid for with existing Minor Streets Capital Funds. This project is planned to be done in coordination with another project under separate agreement between the City and the BNSF to replace and widen the crossing material to add pedestrian crossings. Construction of the improvements is not yet scheduled. RESOLUTION 99-95 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE COLORADO DEPARTMENT OF TRANSPORTATION AND THE BURLINGTON NORTHERN AND SANTA FE RAILWAY COMPANY FOR UPGRADING THE CROSSING WARNING DEVICES AT THE WEST DRAKE ROAD AND BURLINGTON NORTHERN AND SANTA FE RAILROAD CROSSING WHEREAS,the City and the Burlington Northern and Santa Fe Railway Company("BNSF") desire to upgrade the crossing warning devices at the West Drake Road/Burlington Northern and Santa Fe Railroad crossing; and WHEREAS, Federal Intermodel Surface Transportation Efficiency Act ("ISTEA") funds have been made available to pay for one hundred(100)percent of the cost of upgrading said crossing warning devices; and WHEREAS,the City has sufficient Minor Streets Capital Funds to reimburse the Colorado Department of Transportation for its costs in administering the project, which costs are estimated to be in the sum of Two Thousand Five Hundred and Eighty Seven Dollars ($2,587); and WHEREAS,the costs of the upgrading project are estimated by BNSF to be in the sum of One Hundred Sixty Two Thousand Nine Hundred and Thirteen Dollars ($162,913); and WHEREAS,ISTEA funds are available in the maximum amount of One Hundred Sixty Nine Thousand Four Hundred and Thirteen Dollars ($169,413)to fund the project; and WHEREAS,the City, the State of Colorado and BNSF now desire to enter into a contract for the purpose of accomplishing the upgrade of the crossing warning devices at the West Drake Road and Burlington Northern and Santa Fe Railroad crossing; and WHEREAS, Section 16 of Article II of the City Charter provides that the Council may, by resolution,enter into contracts with other governmental bodies to finish governmental services or to enter into cooperative or joint activities with other governmental bodies; and WHEREAS,the Council had determined that the aforesaid contract for the upgrade of said crossing warning devices is in the best interest of the City. NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Council hereby approves the Contract between and among the City,the State of Colorado and the Burlington Northern and Santa Fe Railway Company, and authorizes the City Manager to enter into the Contract on behalf of the City,which contract provides that one hundred (100) percent of the cost to upgrade the aforesaid crossing warning devices shall be funded by Intermodel Surface Transportation Efficiency Act funds and the cost incurred by the State of Colorado in administering the project shall be reimbursed by the City to the State in the estimated sum of Two Thousand Five Hundred and Eighty Seven Dollars ($2,587), from City Minor Streets Capital Funds. Mayor ATTEST: City Clerk ORDINANCE NO. 123, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND MINOR STREETS CAPITAL PROJECT TO BE USED TO UPGRADE CROSSING WARNING DEVICES AT THE WEST DRAKE ROAD AND BURLINGTON NORTHERN SANTA FE RAILROAD CROSSING WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins(the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,the City Council adopted Resolution 99-95,on August 3, 1999,authorizing the City to enter into a contract with the Colorado Department of Transportation (CDOT) and the Burlington Northern and Santa Fe Railroad Company for the receipt of Intermodal Surface Transportation Efficiency Act funds(ISTEA)to be used to upgrade the crossing warning devices at the West Drake Road and Burlington Northern and Santa Fe Railroad crossing(the"Project"); and WHEREAS, the estimated cost of the Project is One Hundred Seventy-Two Thousand . Dollars ($172,000). and WHEREAS, CDOT has made available to the City, Intermodal Surface Transportation Efficiency Act funds to pay for one hundred (100)percent of the cost($169,413) of installing new crossing warning devices at the Project; and WHEREAS, local funds, totaling Two Thousand Five Hundred Eighty-Seven Dollars ($2,597)have been identified and are appropriated in the 1999 Capital Projects Fund Minor Streets Capital project to be used to reimburse the Colorado Department of Transportation for its costs in administering the Project; and WHEREAS, it is the desire of the Council to appropriate the sum of$169,413 in federal Intermodal Surface Transportation Efficiency Act funds to be used to upgrade crossing warning devices at the West Drake Road and Burlington Northern and Santa Fe Railroad crossing. NOW, THEREFORE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund Minor Streets Capital project, the sum of ONE HUNDRED SIXTY-NINE THOUSAND FOUR HUNDRED THIRTEEN DOLLARS ($169,413), upon the City's receipt of Intermodal Surface Transportation Efficiency Act funds from the Colorado Department of Transportation, to be used to upgrade crossing warning devices at the West Drake Road and Burlington Northern and Santa Fe Railroad crossing. Introduced and considered favorably on first reading and ordered published this 3rd day of August, A.D. 1999, and to be presented for final passage on the 17th day of August, A.D. 1999.
