RECOMMENDATION: Staff recommends adoption of the Resolution and of the Ordinance on First Reading. I FINANCIAL IMPACT: This item appropriates $328,103 from prior year reserves in the Sales and Use Tax Fund,representing additional sales/use tax revenue received in 1998 which was not transferred to the Building Community Choices program (BCC) for Streets and Transportation. In addition,the Ordinance authorizes the transfer of$127.000 to the BCC 7Streets and Transportation program for the Mason Street Transportation Corridor project. Appropriation of the additional funds for expenditure in 1999 will reduce the budgeted appropriation for the Mason Street Transportation Corridor in 2000 by$127,000. The remaining additional funds for the additional work to be added are available in existing appropriations in the Mason Street Transportation Corridor Capital Project. The total cost of the additional work is estimated to be $253.848. EXECUTIVE SUMMARY: A. Resolution 99-94 Authorizing an Exemption to the Use of a Competitive Process for Additional Professional Services in Connection with the Mason Street Transportation Corridor Project. B. First Reading of Ordinance No. 122, 1999,Appropriating Prior Year Reserves in the Sales and Use Tax Fund for Transfer to the Building Community Choices Streets and Transportation Capital Projects Fund and Appropriating Funds Therein for the Mason Street 4 Transportation Corridor Capital Project. 3 r The Mason Street Transportation Corridor Project("Corridor")is in the planning and design stage. t The original scope of work issued to the consulting firm ofBalloffet&Associates,Inc. ("Balloffet") for planning and design of the Corridor does not include a comprehensive travel origin and 1 destination study. The purpose of this study is to identify transportation opportunities along the Corridor, accurately predict transit usage, and develop a multi-modal transportation model. This Ordinance appropriates revenue dedicated to the project to fund an addendum to the scope of work r for Balloffet for a vehicle intercept origin and destination survey, a transit on-board survey, and a special generator study for Colorado State University. 4 c DATE: August 3, 1999 2 ITEM NUMBER: 15 A-B BACKGROUND: Voters approved funding for the first two phases of the Mason Street Transportation Corridor Project ("Corridor") on April 8, 1997, as part of the Building Community Choices ballot package. The Corridor is intended to enhance opportunities for pedestrians,bicyclists, and transit riders along its length,to encourage in-fill development and to provide economic opportunities. It will provide a direct north/south route for bicyclists and a faster passenger-trip time using transit rather than having to use autos on a congested College Avenue corridor. It also offers the future possibility of rail service from Fort Collins to destinations throughout the region. The Corridor will extend at least from Cherry Street on the north to Harmony Road on the south, centered along the right-of-way of the Burlington Northern Santa Fe Railroad tracks. Phase I includes design and engineering studies and the acquisition of rights-of-way. Phase 2 will be the construction of a bike and pedestrian way from Prospect Street to Harmony Road. Other development and construction will be added, as funding becomes available. On December 14, 1998, the City of Fort Collins entered into an agreement with Balloffet & Associates,Inc. ("Balloffet") for the planning and design of the Corridor. This agreement did not include a detailed user origin and destination study because it was assumed that most of this information could be gathered from other locally collected data such as the North Front Range Mobility Report Card. Since these data are not as specific to the Corridor and Fort Collins as was hoped,it is necessary to expand Balloffet's scope of work to include a comprehensive travel origin and destination study. The purpose of this study is to identify transportation opportunities along the Corridor, accurately predict transit usage, and develop a multi-modal transportation model. It is critical that this information be statistically valid so that the Master Plan for the Corridor will be accurate. Additional dedicated revenue above 1999 appropriations is available in the Sales and Use Tax Fund to fund the addendum to Balloffet's scope of work. Appropriating these funds now, instead of waiting until FY 2000 insures that the Corridor planning and design can remain on schedule for adoption by the City Council in 2000. RESOLUTION 99-94 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING AN EXEMPTION TO THE USE OF A COMPETITIVE PROCESS FOR ADDITIONAL PROFESSIONAL SERVICES IN CONNECTION WITH THE MASON STREET TRANSPORTATION CORRIDOR PROJECT WHEREAS, the City previously conducted a competitive request-for-proposals process, through which Balloffet & Associates, Inc. ('Balloffet") was selected to complete various professional services related to the analysis and planning of the Mason Street Transportation Corridor Project(the 'Project"); and WHEREAS, the City entered into a professional services agreement with Balloffet for the completion of the planning, engineering/design of the Project on December 14, 1998, and work is proceeding satisfactorily pursuant to that agreement; and WHEREAS, the original scope of work to be completed by Balloffet did not include the completion of a vehicle intercept origin and destination survey,a transit on-board survey,and special generator study related to Colorado State University (the "Additional Work"); and WHEREAS, City staff has determined since contracting with Balloffet that existing travel origin and destination information is not sufficient for the analysis and planning required in • connection with the Project; and WHEREAS,the Purchasing Agent has determined that the use of Balloffet to complete the Additional Work through a change order to the existing contract for services would be an efficient and cost-effective means of accomplishing the same and has submitted the requisite justification to the City Manager for approval, and WHEREAS,the cost associated with the Additional Work totals $253,848, $127,000 of which is proposed to be appropriated in Ordinance No. 122, 1999, and the remainder of which is currently appropriated and available in the Mason Street Transportation Corridor capital project in the Building Community Choices Streets and Transportation Capital Projects Fund; and WHEREAS, Article IV, Section 8-160(d)(1)j of the Code of the City of Fort Collins authorizes the Purchasing Agent to contract for services without competition if the services are to be provided through a change order to an existing professional services contract; and WHEREAS. the City Manager has reviewed and approved the determination of the Purchasing Agent; and WHEREAS, Section 8-160(d)(3) requires approval by City Council of exceptions to the competitive purchasing process for items costing more than One Hundred Thousand Dollars • ($100,000)prior to acquisition. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Purchasing Agent is authorized to execute an addendum to the City's existing contract with Balloffet to add the Additional Work to the scope of services to be completed thereunder, at an additional contract price of $253,848, contingent upon the final adoption of Ordinance No. 122, 1999, appropriating certain funds therefore. Mayor ATTEST: City Clerk ORDINANCE NO. 122, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING PRIOR YEAR RESERVES IN THE SALES AND USE TAX FUND FOR TRANSFER TO THE BUILDING COMMUNITY CHOICES STREETS AND TRANSPORTATION CAPITAL PROJECTS FUND AND APPROPRIATING FUNDS THEREIN FOR THE MASON STREET TRANSPORTATION CORRIDOR CAPITAL PROJECT WHEREAS,on April 8, 1997,the voters of the City of Fort Collins approved Ordinance No. 20, 1997. extending a 0.25 cent sales and use tax to finance the Building Community Choices Capital Improvement Plan for streets and transportation projects; and WHEREAS, one of the transportation projects approved for funding is the Mason Street Transportation Corridor(the "Corridor"); and WHEREAS, the Corridor project is needed to create a facility dedicated to the north/south flow of bicycles,buses, and pedestrians, and the initial phase of the project includes acquiring the right to use the corridor right-of-way, creating a detailed corridor plan and the design of a multi- modal transportation facility, and constructing a bikeway from Prospect Road, south to Harmony Road; and WHEREAS, on December 14, 1998, the City entered into an agreement with Balloffet & Associates, Inc. ("Balloffet") for the planning, engineering/design of the Corridor; and WHEREAS, to complete the Corridor design, the scope of work for Balloffet needs to be amended to include a detailed user origin and destination study for the Corridor; and RBEREAS, amending the original scope of work as presented to Balloffet will cost $253,848. and all but $127.000 of this amount is available from existing appropriations in the Building Community Choices Streets and Transportation Capital Projects Fund, Mason Street Transportation Corridor capital project; and WHEREAS, funds are available from the excess sales and use tax revenues collected in 1998; and 'WHEREAS,the aforementioned excess revenues are in the prior year reserves of the Sales and Use Tax Fund; and WHEREAS, Article V, Section 9 of the Charter of the City of Fort Collins, (the "Charter") permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years,notwithstanding that such reserves were not previously appropriated; and WHEREAS,Article V,Section 10, of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project,provided the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS,it is the desire of the Council to appropriate$328,103 from prior year reserves in the Sales and Use Tax Fund for transfer to the Building Community Choices Streets and Transportation Capital Projects Fund,and appropriate$127,000 of said amount in the Mason Street Corridor capital project. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section1. Thatthere is hereby appropriated from prior year reserves inthe Sales and Use Tax Fund the sum of THREE HUNDRED TWENTY-EIGHT THOUSAND ONE HUNDRED THREE DOLLARS ($328,103), for transfer to the Building Community Choices Streets and Transportation Capital Projects Fund. Section 2. That there is hereby appropriated for expenditure from revenue transferred to the Building Community Choices Streets and Transportation Capital Projects Fund,from the Sales and Use Tax Fund,the sum of ONE HUNDRED TWENTY-SEVEN DOLLARS ($127,000)to be used for the Mason Street Transportation Corridor capital project. Introduced, considered favorably on first reading, and ordered published this 3rd day of August,A.D. 1999, and to be presented for final passage on the 17th day of August, A.D. 1999.
