SUBJECT:
First Reading of Ordinance No. 119, 1999,Authorizing the Conveyance of a Parcel by a Quit Claim
Deed to Dayton Family LLP in Exchange for a Parcel to be Acquired from Them by the City.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY:
In September 1999, the City plans to construct a right-turn lane to alleviate congestion at the
southwesterly corner of the Horsetooth/Mason Street Intersection. Two properties are affected by
the project. The corner lot has already been purchased by the City. An agreement has been reached
with Dayton Family LLP, owner of the adjacent property, "Horsetooth Lanes". As part of the
. Dayton agreement,the City needs to convey to the Dayton Family LLP sufficient property to allow
for the replacement of 21 parking spaces to be eliminated as a result of the conveyance to the City.
These spaces will be constructed on aportion of the corner lot and transferred to the Dayton by Quit
Claim Deed.

ORDINANCE NO. 119, 1999
AUTHORIZING THE CONVEYANCE OF A PARCEL
BY A QUIT CLAIM DEED TO DAYTON FAMILY LLP IN EXCHANGE
FOR A PARCEL TO BE ACQUIRED FROM THEM BY THE CITY
WHEREAS,the Horsetooth/Mason Right-Turn Lane Project(hereinafter referred to as the
"Project") is scheduled for construction in September 1999; and
WHEREAS,the City of Fort Collins(hereinafter referred to as the "City") has entered into
an Agreement of Purchase and Sale (hereinafter referred to as the "Agreement") with the Dayton
Family LLP (hereinafter referred to as the "Dayton") to purchase 2,826 square feet of property
needed to construct the Project; and
WHEREAS,the City is the owner of adjacent property described as Lot 1,Block 2,Replat
of Lots 1-4,Creger Plaza Subdivision,City of Fort Collins,Larirner County,Colorado,a portion of
which is described on Exhibit "A", attached hereto and incorporated herein by this reference (the
"Property"); and
WHEREAS, as part of the Agreement, the City is required to replace 21 parking spaces
which Dayton have lost due to the Project and deed the Property,on which these spaces are located,
to the Daytons by Quit Claim Deed; and
• WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized
to sell, convey or otherwise dispose of real property owned by the City,provided the Council first
finds by ordinance that any sale or disposition of real property owned by the City is in the best
interest of the City of Fort Collins.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the above described conveyance of the Property will be for the benefit of the
City's citizens and that it is in the best interests of the City.
Section 2. That the Mayor is authorized to execute such documents of conveyance as are
necessary to convey the Property to Dayton Family LLP upon the term and conditions described
above.

• DESCRIPTION OF THE CITY OF FORT COLLINS PROPERTY TO BE DEEDED TO THE
DAYTON FAMILY LLP
A tract of land located in the Northeast Quarter of Section 35, Township 7 North, Range 69 West
of the Sixth Principal Meridian, City of Fort Collins, Larimer County, Colorado, the said tract is a
portion of that certain tract of land described in a Warranty Deed dated June 2, 1999, and recorded
at Reception No. 99047804 records of the Clerk and Recorder of the said Larimer County the said
tract is also a portion of Lot 1 Block 2 of the Plat of Replat of Lots 1, 2, 3 & 4 Creger Plaza
Subdivision a plat of record with the said Clerk and Recorder, more particularly described as
follows;
Commencing at the northwest comer of the said Lot 1, Block 2 Replat of Lots 1, 2, 3 & 4 Creger
Plaza Subdivision; THENCE along the west line of the said Lot 1, Block 2, South 01 degrees 04
minutes 00 seconds West for a distance of 17.64 feet to the TRUE POINT OF BEGINNING of this
description; THENCE leaving the said west line, South 89 degrees 45 minutes 21 seconds East for
a distance of 9,15 feet; THENCE along a curve to the right having a radius of 23.00 feet a central
angle of 89 degrees 55 minutes 41 seconds and an arc length of 36.10 feet, being subtended by a

subtended by a chord of South 12 degrees 59 minutes 06 seconds West for a distance of 89.05 feet
to the said west line of Lot 1, Block 2; THENCE non-tangent from the previous curve, along the
said west line of Lot 1, Block 2,North 01 degrees 04 minutes 00 seconds East for a distance of
294.68 feet to the point of beginning. Containing 6987 square feet more or less.
The above described tract is subject to all easements and rights of ways now existing or of record.
