RECOMMENDATION Staff recommends adoption of the Ordinance on Second Reading. EXECUTIVE SUMMARY Fort Collins Police Services applied to the Office of Drug Control and System Improvement (Byrne Grant) on behalf of the Task Force for federal grant monies to help fund the investigation of illegal narcotics activities in Larimer County. These funds will be used to match personnel costs related to the assigned Colorado State University Detective, rental and operational costs at the Task Force off-site location, overtime funding to help offset the overtime costs of each participating agency, and confidential funds to be used for the purchase of narcotics from drug dealers by undercover police officers. This Ordinance, which was adopted 5-0 (Councilmembers Hamrick and Roy were absent) on First Reading on July 6, 2004, appropriates the $250,000 in new federal grant money and $5,000 to be received from Colorado State University. ORDINANCE NO. 103, 2004 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE GENERAL FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATED AMOUNTS BETWEEN ACCOUNTS AND PROJECTS FOR THE MULTI-JURISDICTIONAL DRUG TASK FORCE WHEREAS,Fort Collins Police Services has been awarded a grant of federal money in the amount of$250,000 through the Office of Drug Control and System Improvement (Byrne Grant); and WHEREAS,this grant is to be used by the Latimer County Drug Task Force to help fund the investigation of illegal narcotics activities; and WHEREAS,the City of Fort Collins will administer the grant for the Latimer County Drug Task Force which includes Fort Collins Police Services, Loveland Police Department, Latimer County Sheriff's Department,Drug Enforcement Administration,and the Colorado State University Police Department; and WHEREAS, the members of the Latimer County Drug Task Force will provide grant matching funds in the amount of$420,676; and WHEREAS,Fort Collins portion of the matching funds is$121,851 which is included in the 2004 Police Services budget for this purpose and is available for transfer to the Multi jurisdictional Drug Task Force Grant Project; and WHEREAS,the City of Fort Collins will receive$5,000 from Colorado State University to fund their portion of training costs; and WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V,Section 10, of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or project to another fund or project, provided that the purpose for which the transferred funds are to be expended remains unchanged. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated from unanticipated grant revenue in the General Fund the sum of TWO HUNDRED FIFTY THOUSAND DOLLARS ($250,000) for expenditure upon receipt from the Office of Drug Control and System Improvement in the General Fund for Police Services for the Multi jurisdictional Drug Task Force Grant Project. Section 2. That the unexpended appropriated amount of ONE HUNDRED TWENTY-ONE THOUSAND EIGHT HUNDRED FIFTY-ONE DOLLARS ($121,851) is hereby authorized for transfer from the Police Services operating budget in the General Fund to the Multi jurisdictional Drug Task Force Grant Project. Section 3. That there is hereby appropriated from unanticipated revenue in the General Fund the sum of FIVE THOUSAND DOLLARS ($5,000) for expenditure upon receipt from Colorado State University in the General Fund for Police Services for the Multi jurisdictional Drug Task Force Grant Project. Introduced and considered favorably on first reading and ordered published this 6th day of July, A.D. 2004, and to be presented for final passage on the 20th day of July, A.D. 2004. The participating agencies must provide matching funds in the amount of$420,676. Fort Collins' portion of the match is $121,851. These funds will be used to match personnel costs related to the assigned Colorado State University Detective, rental and operational costs at the Task Force off-site location, overtime funding to help offset the overtime costs of each participating agency, and confidential funds to be used for the purchase of narcotics from drug dealers by undercover police officers. This appropriation is not a request to identify new dollars for the Fort Collins Police Services 2004 budget. This action appropriates the $250,000 in new federal grant money and $5,000 to be received from Colorado State University. As the administrator of this grant, Fort Collins Police Services will assure participating agencies receive their share of the funds.
