Plat. RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. EXECUTIVE SUMMARY: This Ordinance vacates the street rights-of-way for Morning Dove Lane south of Dusty Sage Drive. First, it should be noted that the Harmony Ridge P.U.D. development is under construction,but no streets have been constructed. Furthermore,the right-of-way for this street is no longer needed for the housing units because the plan has been amended so that they take access off of Dusty Sage Loop. However, the Harmony Ridge P.U.D. depicts utilities in the Morning Dove Lane right-of- way and since drainage facilities and public access will need to accommodate a utility, access,and drainage easement, such easement will be retained with the vacation of Morning Dove Lane. ORDINANCE NO. 156, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING PORTIONS OF THE RIGHTS-OF-WAY FOR MORNING DOVE LANE, SOUTH OF DUSTY SAGE DRIVE AS DEDICATED ON THE HARMONY RIDGE P.U.D. PLAT WHEREAS,the plat for the Harmony Ridge P.U.D.dedicated to the public certain rights-of- way for Morning Dove Lane; and WHEREAS an Administrative Minor Amendment has approved a change to the final plan > PP for the project entitled"Harmony Ridge P.U.D.",which negates the need for that portion of Morning Dove Lane that is south of Dusty Sage Drive; and WHEREAS, the approval of the Administrative Minor Amendment to Harmony Ridge P.U.D.,generates the need for the vacation of the right-of-way dedicated for said portion of Morning Dove Lane,as more particularly described on Exhibit"A",attached hereto and incorporated herein by this reference; and WHEREAS, said portion of Morning Dove Lane right-of-way is no longer necessary or desirable to retain for street purposes because its usage for primary access to the housing units is no longer needed with the approval of the Administrative Minor Amendment; and WHEREAS,pertinent City agencies and private utility companies have been contacted and reported no objection to the proposed vacation, provided that an easement for access, utility, and drainage be reserved unto the City; and WHEREAS, the right of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said street right-of-way. NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the portions of street right-of-way for Morning Dove Lane more particularly described on Exhibit "A", attached hereto and incorporated herein by this reference, are hereby vacated, abated and abolished, reserving the same unto the City as an easement for access, utility, and drainage purposes.
