SUBJECT:
Items Relating to the Law Enforcement Assistance Fund (L.E.A.F.) Contract with the Colorado
Department of Transportation Providing Funds for the Fort Collins Police Services Drunk Driving
Enforcement Program.
RECOMMENDATION:
Staff recommends adoption of the Resolution and the Ordinance on First Reading.
FINANCIAL IMPACT:
The Colorado Department of Transportation has awarded Fort Collins Police Services a 2000 Law
Enforcement Assistance Fund(L.E.A.F.)grant in the amount of$41,000 to help reduce the number
• of drunk drivers in Fort Collins.No matching funds are required.
EXECUTIVE SUMMARY:
A. Resolution 99-119 Approving. and Authorizing the Mayor to Execute the Drunk Driving
Enforcement Grant Contract 4L-37-00 Between the City and the Colorado Department of
Transportation.
B. First Reading of Ordinance No. 154. 1999, Appropriating Unanticipated Revenue in the
General Fund for Police Services Drunk Driving Enforcement Program.
The Colorado Department of Transportation has awarded Fort Collins Police Services a 2000 Law
Enforcement Assistance Fund(L.E.A.F.)grant in the amount of$41.000 to help reduce the number
of drunk drivers in Fort Collins. This grant will provide overtime compensation for Fort Collins
Police Officers who are involved in operations. which focus on the detection and arrest of drunk
drivers. The stipulations of the grant are as follows:
• The grant money will be used for overtime compensation for police officers to perform drunk-
driving enforcement duties.

• Fort Collins Police Services must conduct at least three sobriety checkpoints or saturation patrols
in 2000.
• Fort Collins Police Services must be actively involved in the Colorado Department of
Transportation's DUI enforcement public awareness campaign by participating in joint efforts.
• Fort Collins Police Services will make all reasonable efforts to increase DUI alcohol and drug
related arrests by 10%from the 1999 level.
Police Services has agreed to these stipulations and there are no matching funds required for this
grant.
RESOLUTION 99-119
• OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING AND AUTHORIZING THE MAYOR
TO EXECUTE THE DRUNK DRIVING ENFORCEMENT
GRANT CONTRACT#L-37-00 BETWEEN THE CITY AND
THE COLORADO DEPARTMENT OF TRANSPORTATION
WHEREAS, the City of Fort Collins, on behalf of the Fort Collins Police Services, has
submitted an application to the Colorado Department of Transportation, Office of Transportation
Safety ("CDOT") for funding a Law Enforcement Assistance Fund (L.E.A.F.) project for the
prevention of drunken driving and the enforcement of laws pertaining to the driving under the
influence of alcohol or other drugs,pursuant to Section 43-4-401 through Section 43-4-404,C.R.S.,
and to L.E.A.F. Rules at 2 CCR 602.1; and
WHEREAS, CDOT has approved the application and has prepared Drunk Driving
Enforcement Grant Contract#L-37-00 (the "Contract") which must be entered into by the City as
a condition to receiving the funds from CDOT; and
WHEREAS, the City of Fort Collins has the authority and responsibility to fund the Fort
Collins Police Services and to enter into contracts on behalf of the Fort Collins Police Services;and
. WHEREAS,the City will receive under the Contract a grant of Forty-one Thousand Dollars
($41,000)which will be used by the Fort Collins Police Services in its Drunk Driving Enforcement
Program; and
WHEREAS,a Resolution by the Fort Collins City Council formally approving the Contract
and authorizing the proper City signature to be affixed to the Contract indicating such approval is
required by CDOT.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLIN'S that the City Council hereby approves the term,conditions and obligations of the Contract
and authorizes the Mayor to execute the Contract on behalf of the City of Fort Collins.

ORDINANCE NO. 154, 1999
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE GENERAL FUND
FOR POLICE SERVICES DRUNK DRIVING ENFORCEMENT PROGRAM
WHEREAS, the Colorado Department of Transportation has awarded Fort Collins Police
Services a 2000 Law Enforcement Assistance Fund(L.E.A.F.)grant in the amount of$41,000; and
WHEREAS, these fends will be used by Police Services to support the Fort Collins Drunk
Driving Enforcement Program; and
WHEREAS,Council has adopted Resolution 99-119, approving and authorizing the Mayor
to execute the Drunk Driving Enforcement Grant Contract 4L-37-00 between the City and the
Colorado Department of Transportation; and
WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year,does not exceed the then current estimate of actual and anticipated
revenues to be received during the fiscal year.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
• COLLINS that there is hereby appropriated from unanticipated grant revenue in the General Fund
the sum of FORTY-ONE THOUSAND DOLLARS ($41,000)for expenditure,upon receipt, in the
General Fund for the Police Services Drunk Driving Enforcement Program.
