Resolution 99-141 Authorizing the City Manager to Grant a License to Drahota Construction
Company to Enter City Property.

RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
Drahota Construction Company has requested a license from the City to place a construction trailer
on approximately seven hundred square feet(700')of an unused portion of the Fort Collins Senior
Center P.U.D. site. Drahota will be using the trailer as its office for the construction of two
additional multi-family residential buildings for The Preserve II Apartments P.U.D. The License
to Enter agreement will terminate on or before July 31, 2000.

RESOLUTION 99-141
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO GRANT A LICENSE
TO DRAHOTA CONSTRUCTION COMPANY
TO ENTER CITY PROPERTY
WHEREAS,the City of Fort Collins is the owner of the property known as the Fort Collins
Senior Center P.U.D. in Larimer County, Colorado ("City Property"); and
WHEREAS, Drahota Construction Company wishes to enter the City Property, which
property is shown on Exhibit"A" attached hereto, for the placement of a construction trailer; and
WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized
to sell, convey or otherwise dispose of real property owned by the City,provided the Council first
finds by ordinance that any sale or disposition of real property owned by the City is in the best
interest of the City; and
WHEREAS,the value of the License to Enter Private Property, based on comparable sales
in the areas, is $1,050.
NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the above-described License to Enter is in the best interest of the City.
Section 2. That the City Manager is hereby authorized to execute such agreements and
instruments as are necessary to convey the License to Enter to Drahota Construction Company for
the total price of$1,050.
Passed and adopted at a regular meeting of the City Council held this 7th day of December,
A.D. 1999.
