First Reading of Ordinance No. 200, 1999, Amending Section 24-42 (c) for the Purpose of
Correcting an Error.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY:
Section 24-42(c) of the City Code makes reference to Section 24-657(g)(4) of the Code, which
section does not exist. The intended section was probably Section 29-657(g)(5). However, when
the Land Use Code was adopted,all of Chapter 29 was removed from the City Code and recodified
• as the "Transitional Land Use Regulations". Since the Transitional Land Use Regulations are
already mentioned in subparagraph(c)of Section 24-42,the specific reference to a section number
is not necessary. Therefore,the reference to this section should be deleted.

M ORDINANCE NO. 200, 1999
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING SECTION 24-42 (c)FOR THE PURPOSE
OF CORRECTING AN ERROR
WHEREAS, Section 24-42(c)of the Code of the City contains a reference to a non-existent
Code section; and
WHEREAS, the Council has determined that the aforesaid error should be corrected.
NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that Section 24-42(c) shall be and hereby is amended to read as follows:
(c) It shall be the duty of any property owner whose property is adjacent to a
pedestrian/bicycle path which was required by the city to be constructed pursuant to
the provisions of Articles 3 and/or 4 of the Land Use
Code or,if applicable,the Transitional Land Use Regulations,to maintain the paved
surface of said pedestrian/bicycle path so that the condition of the same does not en-
danger the public.
Introduced and considered favorably on first reading and ordered published this 7th day of
December,A.D. 1999, and to be presented for final passage on the 4th day of January,A.D. 2000.
