SUBJECT
Resolution 2004-105 Authorizing the Lease of a Portion of the City-Owned Property at 250 North
Mason Street, Fort Collins, Colorado.
RECOMMENDATION
Staff recommends adoption of the Resolution.
FINANCIAL IMPACT
Rent collected from this lease will result in at least $3,550 in unanticipated revenue.
EXECUTIVE SUMMARY
Since the Transit Center became operational, the City has leased an office space at the Center to a
company that has provided over-the-road bus service from the Center. The previous tenant's lease
has expired and the company has vacated the premises. This service has been beneficial to the
community and City staff has decided to negotiate with a new tenant to provide the same services.
The lease agreement will be for the rental of a 190 square foot office space, an outdoor
bicycle/storage unit, and use of an outdoor bus stop area. The lease term will be for one year, with
the City having the option to renew for an additional one-year term. The annual rental for these
spaces will be$3,550. The tenant will be required to carry commercial general liability insurance,
commercial automobile liability insurance and worker's compensation insurance.
RESOLUTION 2004-105
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE LEASE OF A PORTION OF THE
CITY-OWNED PROPERTY AT
250 NORTH MASON STREET, FORT COLLINS, COLORADO
WHEREAS, the City of Fort Collins is the owner of property known as the Downtown
Transit Center ("Center") located at 250 North Mason Street, Fort Collins, Larimer County,
Colorado; and
WHEREAS, the Center is operating as a central multi-modal facility; and
WHEREAS,the City desires to lease a 190 square foot portion of the Center,together with
one storage locker and use of an outdoor bus stop area(the'Premises") for the purpose of providing
over-the-road transportation; and
WHEREAS, the lease would be for a term of up to two years, at an annual rent of at least
$3,550; and
WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is
authorized to lease any and all interests in real property owned in the name of the City,provided that
Council first finds that the lease is in the best interests of the City.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council hereby finds that leasing the Premises under the terms listed
above is in the best interests of the City of Fort Collins.
Section 2. That the City Manager is hereby authorized to execute a lease agreement for the
Premises, consistent with the terms of this Resolution, together with such additional terms and
conditions as the City Manager, in consultation with the City Attorney, determines to be necessary
and appropriate to protect the interests of the City.
