First Reading of Ordinance No. 183, 1999 Authorizing the Conveyance ofNonexclusive Easement
Interests for the Construction of Off Site Water and Sewer Lines Related to the Harmony Ridge
P.U.D. in the Cathy Fromme Prairie Natural Area.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT:
The developer of the Harmony Ridge P.U.D. will be responsible for all costs associated with the
construction of the four offsite utility lines for that development. If the developer does not meet all
of the requirements set forth in the easements and on the plans,then the Fort Collins-Loveland Water
District (Water District) and South Fort Collins Sanitation District (Sanitation District) will be
responsible for the costs to meet the requirements. The City will be compensated fair market value
for a temporary construction easement associated with one of the easements being proposed. (See
explanation of each easement below) The amount will be determined prior to the second reading.
EXECUTIVE SUMMARY:
Staff and the Natural Resources Advisory Board(NRAB)have reviewed the easements and utility
plans and have no objections to the easements being approved. All four easements will replace or
modify existing easements to accommodate changes to plans for the water or sewer lines. Three of
the easements are very routine and have minimal impact to the Cathy Fromme Prairie. Easement
(1), as described in detail below raised issues that staff has worked with the developer to address.
The easement will require that the impacts during construction be minimized and a restoration plan
be developed and implemented. These requirements are improvements over the currenth_ existing
easement.
BACKGROUND:
The following is a description of the four easements being proposed,are shown on the attached map
and identified by the number listed below for each easement.
• (1) The Sanitation District currently has a 20 foot wide and approximately 2,100 foot long
easement for an existing 8-inch sanitary sewer line that crosses the Cathy Fromme Prairie. The
development plans for the Harmony Ridge P.U.D.require that the 8-inch sewer line be replaced with
a 10-inch sewer line. To accomplish this with the least impact to the Cathy Fromme Prairie and at

the least cost,the developer is proposing to install the new line parallel to the existing line and then
abandon the existing line in place. This will require shifting the existing 20-foot easement over by
10 feet. First the City will grant a new 20-foot wide easement parallel to the existing easement.
Then after the new line is in place the existing easement will be vacated. Staff recommends that the
City not require compensation for the new easement, since there will be no net increase in the size
of the easement. A 20-foot wide temporary construction easement is also being requested for the
construction of this line. The City will be compensated at fair market value for the temporary
construction easement.
As this easement crosses the Cathy Fromme Prairie it crosses a creek,the Fossil Creek Trail,in front
of the raptor observatory and crosses Fossil Creek. The installation of the sewer line will be visible
from the trail and it will require closure of the trail for several weeks. Staff is proposing that the
easement require the developer to delay construction of this line until after March 15th to avoid
disturbing the eagles and other migratory raptors which winter at Cathy Fromme Prairie. Staff is
currently relocating prairie dogs off of the easement to another area in the Cathy Fromme Prairie.
The developer will also be required to complete the sewer line installation,including the restoration
work, by May 15th. This will allow the new vegetation a chance to start growing immediately,
which will greatly speed up the revegetation process. The developer has been very receptive to
requirements to minimize the impacts to the Cathy Fromme Prairie and minimize the length of time
the trail is closed.
(2) An easement for a future sewer line was granted to the Sanitation District when this large
parcel of land was sold to the City for the Cathy Fromme Prairie. However,this summer when the
sewer line was constructed, it was discovered that there was an error in the legal description. The
old easement is being vacated and the new revised easement corrects the error. Staff has also
proposed that the City dedicate a public utility easement to address public stormwater drainage needs
in this location. Staff has proposed that no compensation be required for this easement correction.
(3) A drainage and utility easement for a future sewer line and drainage was reserved when this
large parcel of land was sold to the City for the Cathy Fromme Prairie. During the final design of
the sewer line, a new alignment was found which reduced the disturbance to existing native
vegetation on the property and simplified the construction of the sewer line. However the new
alignment did not quite fit within the existing easement. Therefore the developer is requesting a
small 1,137 square foot easement to accommodate the new alignment. The City has recommended
that the City not require compensation for this small additional easement and temporary construction
easement because the impact to the Cathy Fromme Prairie will not be increased due to this
adjustment,and the change will result in benefit to the resource values of the Natural Area compared
to the prior plan.
(4) The Water District currently has an easement for a future waterline along the south side of
the old alignment for West Harmony Road. This summer the City built a parking lot at the west end
of the old West Harmony Road near Taft Hill Road for public access to the Fossil Creek Trail in the
Cathy Fromme Prairie. To avoid having a waterline under the new parking lot,the City requested
that the developer of the Harmony Ridge P.U.D. and the Water District move the waterline south
of the new parking lot. The Ordinance would grant the Water District a new easement and vacate
the prior easement. A 20-foot wide temporary construction easement is also being requested for the
construction of this line. Staff has recommended that no compensation be required for this easement
adjustment because the proposed change is beneficial for the City.

On all four of the easements, the developer will be required to regrade and restore the native
• vegetation on all disturbed areas. If the developer does not meet the restoration requirements the
Sanitation District or Water District will then be responsible for meeting the restoration
requirements.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CONVEYANCE OF
NON-EXCLUSIVE EASEMENT INTERESTS FOR
THE CONSTRUCTION OF OFFSITE WATER AND SEWER LINES
RELATED TO THE HARMONY RIDGE P.U.D. IN
THE CATHY FROMME PRAIRIE NATURAL AREA
WHEREAS, the City of Fort Collins is the owner of that certain parcel of real property
located in Latimer County, Colorado, known as the Cathy Fromme Prairie Natural Area ("the
Natural Area"); and
WHEREAS,as a result of changes in plans and circumstances since the original approval of
the Harmony Ridge P.U.D.(the"P.U.D."),modifications to the locations of various sewer and water
lines have been determined to be desirable by City staff, the developer of the P.U.D. (the
"Developer")and the utilities involved,the South Fort Collins Water District(the"Water District")
and the South Fort Collins Sanitation District(the "Sanitation District"); and
WHEREAS, in order to accomplish the modifications described above, new easements,
including temporary construction easements, will be required from the City, to replace, modify or
add to existing easements that have previously been granted; and
I-WHEREAS,in order to install a new 10-inch sewer line for the P.U.D.to replace an existing
8-inch line, the Sanitation District will require: (a) a non-exclusive easement under and through a
portion of the Natural Area described on Exhibit "A", attached hereto and incorporated herein by
this reference for the construction and maintenance of that sewer line("New Sewer Line Easement
1");(b)a 20 foot wide temporary construction easement more particularly described on Exhibit"B",
attached hereto and incorporated herein by this reference, along that Easement for construction
purposes("Temporary Construction Easement 1");and(c)permission to use for construction of the
new sewer line the area of the easement previously granted for the existing sewer line and recorded
on January 29, 1997, in the real property records of the Latimer County Clerk and Recorder at
Reception No.97006001 ("Existing Easement 1"); and
WHEREAS, in exchange for the grant of New Sewer Line Easement 1 and Temporary
Construction Easement 1.the Sanitation District has agreed to vacate Existing Easement 1,upon the
sooner of completion of the construction or May 30, 2000, and has agreed to pay the fair market
value of Temporary Construction Easement 1; and
WHEREAS,in order to adjust an easement that was granted to the Sanitation District for the
P.U.D. to reflect more current design plans, City staff has proposed that the City grant a new non-
exclusive easement under and through a portion of the Natural Area described on Exhibit "C".
attached hereto and incorporated herein by this reference. for the construction and maintenance of
that sewer line("New Sewer Line Easement 2"),and also dedicate as a public drainage easement that
area described on Exhibit"C"(the"Public Drainage Easement"),in exchange for the vacation of that
certain portion of the easement previously granted to the Sanitation District for a sewer line on
January 27, 1997, described as "EASEMENT 4" on Exhibit"A" thereto, and recorded on February
5, 1997, in the real property records of the Larimer County Clerk and Recorder at Reception No.
97007771 ("Existing Easement 2"); and
WHEREAS,in order to allow for the adjustment of apreviously planned sewer line to reduce
impacts and simplify the construction of the line,the Sanitation District will require a non-exclusive
easement under and through a portion of the Natural Area described on Exhibit"D",attached hereto
and incorporated herein by this reference for the construction and maintenance of that sewer line
("New Sewer Line Easement 3"), and a 20 foot wide temporary construction easement more
particularly described on Exhibit "E", attached hereto and incorporated herein by this reference,
along that Easement for construction purposes("Temporary Construction Easement 2"),in addition
to the easement previously reserved in the warranty deed to the City for this portion of the Natural
Area, and recorded on January 29, 1997, in the real property records of the Larimer County Clerk
and Recorder at Reception No. 97006003 ("Existing Easement 3"); and
WHEREAS, Citv staff has recommended that no compensation be required for the grant of
New Sewer Line Easement 3 and Temporary Construction Easement 2, because the change in the
sewer line plan will reduce the impacts on the Natural Area from the prior plan, and thus will be
beneficial to the City; and
WHEREAS, in order to allow for the adjustment of a previously planned water line so that
the water line is not under the City's parking lot for the Natural Area,the Water District will require
a non-exclusive easement under and through a portion of the Natural Area described on Exhibit 7",
attached hereto and incorporated herein by this reference for the construction and maintenance of
that water line (the "Nev., Water Line Easement"), and a 20 foot wide temporary construction
easement more particularly described on Exhibit"G",attached hereto and incorporated herein by this
reference,along that Easement for construction purposes("Temporary Construction Easement 3
and
WHEREAS, in exchange for the grant of the New Water Line Easement,the Water District
has agreed to vacate that portion of that certain easement previously granted by the City for the water
line and recorded on February 5, 1997,in the real propem,records of the Larimer County Clerk and
Recorder at Reception No. 97007770 consisting of the easterly 386.24 feet along Harmony Road
("Existing Easement 4"), and City staff has recommended that no compensation be required for the
grant of Temporary Construction Easement 3,because the change in the water line plan will reduce
the impacts on the Natural Area from the prior plan, and thus will be beneficial to the City; and
WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized
to sell, convey or otherwise dispose of real property owned by the City,provided the Council first
finds by ordinance that any sale or other disposition of real property owned by the City is in the best
interest of the City of Fort Collins.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. Thatthe conveyance ofNew Sewer Line Easement 1,Temporary Construction
Easement 1, New Sewer Line Easement 2, the Public Drainage Easement, New Sewer Line
Easement 3, Temporary Construction Easement 2, the New Water Line Easement and Temporary
Construction Easement 3, under the terms and conditions set forth above, are in the best interest of
the Citv of Fort Collins.
Section 2. That the Mayor is hereby authorized to execute such documents as are
necessary to convey to the Sanitation District New Sewer Line Easement 1,Temporary Construction
Easement 1, New Sewer Line Easement 2, New Sewer Line Easement 3, and Temporary
Construction Easement 2, consistent with the terms and conditions described above.
Section 3. That the Mayor is hereby authorized to execute such documents as are
necessary to convey to the Water District the New Water Line Easement and Temporary
Construction Easement 3, consistent with the terms and conditions described above.
Section 4. That the Mayor is hereby authorized to execute a deed of dedication of the
Public Drainage Easement, consistent with the terms and conditions described above.
Section 5. That the Council hereby consents to the use by the Sanitation District and its
• assignees,for construction of the new sewer line as referenced above,the area of Existing Easement
1.
