SUBJECT:
Resolution 99-63 Authorizing the City Manager to Lease 1745'/2 Hoffman Mill Road and the Barn
and Pastures on the Nix Natural Area.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
FINANCIAL IMPACT:
If these leases continue for the full two-year period, rent collected will result in approximately
Twenty Thousand Dollars ($20,000) in unanticipated revenue to the Capital Projects Fund - 1/4-
Cent Natural Areas. The tenants will pay all maintenance and utility expenses.

EXECUTIVE SUMMARY:
The City purchased two houses and a barn as part of the Nix Natural Area in December 1996. At
the time of the purchase,three leases were in place for residences and for the barn and pasture. The
new lease for 1745 Hoffinan Mill Road(Residence"A")was approved by Council on May 18, 1999.
The lease for 1745'/z Hoffinan Mill Road,referred to as"Residence `B"on the map attached to the
Resolution,terminates on July 14, 1999. The lease for the barn and pastures terminates on June 1,
1999. Because planning for use of the structures on the property is still underway,Natural Resources
staff is recommending that new leases for Residence `B" and the barn/pasture be executed that
would permit continued collection of rent payments pending completion of plans by the Natural
Resources Department.
Natural Resources is continuing to evaluate the feasibility of modifying Residence `B" for use by
Natural Resources staff, including Rangers and maintenance staff. The proposed Lease Agreements
have a maximum term of two years, with the City having the option to terminate the lease at any
time with notice to the tenants.
RESOLUTION 99-63
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO LEASE 1745'/2 HOFFMAN MILL ROAD
AND THE BARN AND PASTURES ON THE NIX NATURAL AREA
WHEREAS,the City of Fort Collins is the owner of the property known as the Nix Natural
Area, City of Fort Collins,Larimer County,Colorado; and
WHEREAS, 1745 V2 Hoffman Mill Road is shown as Residence`B"on Exhibit"A"attached
hereto; and
WHEREAS,the barn and pasture also is shown on the attached Exhibit"A"; and
WHEREAS, at the current time plans for use of the structures including Residence`B"and
the barn are in process, and continued rental of Residence `B" and the barn and pasture area will
generate income to the Natural Areas fund pending completion of related plans; and
WHEREAS, staff has negotiated a new lease of Residence `B" with the current tenants,
Jayme and Stacy Watts,for a period of up to two years at a monthly lease rate of$525,which lease
provides for termination by the City at any time with notice to the Tenant, along with additional
. terms and conditions set forth in the Residence `B" Lease Agreement, on file in the Office of the
City Clerk; and
WHEREAS,staff has negotiated a new lease for the barn and pasture with the current tenant,
Ron Splittgerber, for a period of up to two years at a monthly lease rate of $345, which lease
provides for termination by the City at any time with notice to the Tenant, along with additional
terms and conditions set forth in the Barn and Pasture Lease Agreement, on file in the office of the
City Clerk; and
WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is
authorized to lease any and all interests in real property owned in the name of the City,provided that
Council first finds that the lease is in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council hereby finds that the lease of Residence`B"under the terms of
the Residence `B" Lease Agreement, on file in the office of the City Clerk, is in the best interests
of the City.
Section 2. That the Council hereby finds that the lease of the barn and pasture under the
terms of the Barn and Pasture Lease Agreement,on file in the office of the City Clerk. is in the best
interests of the City.
Section 3. That the City Manager is hereby authorized to execute the Residence`B"Lease
Agreement and the Barn and Pasture Lease Agreement. -
Passed and adopted at a regular meeting of the City Council held this 1 st day of June,A.D.
