Resolution 99-86 Making an Amendment to the Boards and Commissions Manual as it Relates to
Membership Limitations.
RECOMMENDATION:
Staff and the General Employees Retirement Committee recommend adoption of the Resolution.
EXECUTIVE SUMMARY:
The City of Fort Collins began the General Employees Retirement Plan in 1971. Section 21-87 of
the City Code provides for an administrative committee consisting of six members. Three members
of the Committee are to be employees covered by the Retirement Plan. The fourth may be another
employee covered by the Plan or a tax paying elector of the City. The fifth appointee is to be a
retired member of the Plan who is receiving a monthly benefit from the Plan. The Director of
Finance serves as a standing member of the Committee. The fiduciary responsibility of the members
of the Committee is to the Plan. Historically, Council has appointed employees to the Committee
without regard to residency within the Urban Growth Area of the City.
Council has adopted a Boards and Commissions Manual, maintained by the City Clerk, which
summarizes the duties, composition, membership, limitations and responsibilities of the City's
boards and commissions. In the Manual, the membership limitations provide that all persons
appointed to or serving on any board or commission shall be residents of the Fort Collins Urban
Growth Area or residents of City-owned property located outside the Urban Growth Area.
Members of the General Employees Retirement Plan reside throughout Larimer County and northern
Colorado. Retirees of the Plan live throughout the U.S.A. Because the responsibilities of the
members of the Committee focus on the needs and desires of the Plan members and this focus is not
constrained or limited to the Urban Growth Area,the General Employees Retirement Committee is
requesting that the Council provide an exception to the residency requirements for appointees to this
Committee.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
MAKING AN AMENDMENT TO THE BOARDS AND COMMISSIONS MANUAL
AS IT RELATES TO MEMBERSHIP LIMITATIONS
WHEREAS,the City currently has several boards and commissions appointed by the City
Council; and
WHEREAS,the information pertaining to the duties,composition,membership limitations,
and responsibilities of the City's boards and commissions is contained in a Boards and Commissions
Manual (the "Manual"), maintained by the City Clerk, which Manual was adopted by the City
Council by Resolution 90-110 and amended by the City Council by Resolution 97-119; and
WHEREAS,the membership limitations contained in the Manual provide, in part, that all
persons appointed to, or serving on,any board or commission shall be residents of the City of Fort
Collins, the Fort Collins Urban Growth Area (the "UGA"), or residents of City-owned property
located outside the UGA; and
WHEREAS, a Retirement Committee (the "Committee") was established in 1971 for the
purpose of administering the City's Retirement Plan(the "Plan"); and
. WHEREAS, the duties of the Committee, as contained in Section 21-88 of the City Code,
are limited to supervising the administration of the Plan; and
WHEREAS, the Council wishes to establish an exception to the UGA membership
requirement for employees and retirees appointed to the Committee; and
WHEREAS,the Council believes that it would be in the City's best interests to amend the
membership limitations to allow persons appointed to or serving on the General Employees
Retirement Committee to reside outside of the UGA.
NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the "Membership Limitations" subsection of the Boards and Commissions Manual
of the City of Fort Collins is hereby amended to read as follows:
Membership Limitations
The following limitations and requirements are applied to board or commission
memberships:
No person may serve on any one board or commission for more than
eight(8) consecutive years(two complete terms).* In the event that
an individual fills the unexpired term of a board or commission
member,the unexpired term shall not be counted as a complete term.
No person will be appointed by the City Council to serve concurrently
on more than one board or commission. (This limitation does not
apply to committees deemed to be temporary in nature.)
All persons appointed to, or serving on, any board or commission
shall be residents of the City of Fort Collins or the Fort Collins Urban
Growth Area. Any member who resides outside ofthe Urban Growth
Area during his or her term of service on a board or commission,shall
resign his or her membership The limitations imposed by this

"Section 2-437(b) of the City Code limits members of the Water
Board to three(3) consecutive four(4)year terms.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this
