Resolution 99-83 Authorizing an Exemption to the Use of a Competitive Process for Facade
Restoration of the 1904 First Baptist Church, 328 Remington Street.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
This request is for an exemption to the competitive process for University Designers and Builders,
as the contractor for the restoration of the 1904 First Baptist Church, 328 Remington Street, in the
Old Town Fort Collins Historic District.
The City of Fort Collins has been awarded a State Historical Fund grant in 1999 by the Colorado
Historical Society. The purpose of the grant is to rehabilitate the interior and exterior of the historic
1904 First Baptist Church in Fort Collins.
The building owner selected University Designers and Builders based on its exemplary recent
restoration of the Trimble and Barkley Blocks in Fort Collins. The State Historical Fund encourages
spin-off projects from previous successful grant awards. Historic preservation is a specialized field
that requires knowledge of historical construction and preservation engineering. The firm's
restoration reputation with the State Historical Fund also was an added incentive for the project to
receive the grant.
The City of Fort Collins Purchasing Department will competitively bid the major construction trades
(sub-contractors)which is approximately 50%of the total grant. The remainder of the construction
falls under the expertise of University Designers and Builders.
University Designers and Builders is uniquely qualified because of its experience, motivation, and
the quality of the previous preservation work in Fort Collins and throughout the state. The firm
specializes in pure restoration and/or reconstruction from historic photo documentation and has a
thorough knowledge of the Secretary of the Interior's Standards for Rehabilitation.
The City is benefitting through the increased historic authenticity in the landmarked Old Town Fort
Collins Historic District, by using University Designers and Builders.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING AN EXEMPTION TO THE USE OF A COMPETITIVE
PROCESS FOR FACADE RESTORATION OF THE 1904 FIRST
BAPTIST CHURCH, 328 REMINGTON STREET
WHEREAS,the City of Fort Collins has been awarded a grant in the amount of$162,362
from the Colorado Historical Society's State Historical Fund which will be used to restore the 1904
First Baptist Church Building,328 Remington, in the Old Town Fort Collins Historic District; and
WHEREAS,the building owner selected University Designers and Builders as the building
contractor,and have arranged for them to complete the work since the firm is uniquely qualified and
specializes in pure restoration and/or reconstruction from historic photo documentation, having a
thorough knowledge of the Secretary of the Interiors Standards for Rehabilitation; and
WHEREAS,the City of Fort Collins Purchasing Department will competitively bid the major
construction trades which is approximately 50% of the total grant; and
WHEREAS, Article IV, Section 8-160(d)(1)b of the Code of the City of Fort Collins
authorizes the Purchasing Agent to contract for services without competition if although there exists
more than one (1) responsible source, a competitive process cannot be used or, if used, will result
in a substantially higher cost to the city, will otherwise injure the city's financial interests or will
substantially impede the city's administrative functions or the delivery of services to the public;and
WHEREAS, the Purchasing Agent has determined that the use of a competitive process
would substantially impede the City's delivery of these restoration services in accordance with the
proposed grant funding and has submitted the requisite justification to the City Manager for
approval; and
WHEREAS, the City Manager has reviewed and approved the determination of the
Purchasing Agent; and
WHEREAS, Section 8-160(d)(3) requires approval by City Council of exceptions to the
competitive purchasing process for items costing more than One Hundred Thousand Dollars
($100,000) prior to acquisition.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Purchasing Agent is authorized to contract with University Designers and
Builders for restoration of the 1904 First Baptist Church Building, 328 Remington.
