Bruno SUBJECT: First Reading of Ordinance No.111, 1999, Authorizing the Conveyance of a Non-Exclusive Easement for an Electrical Substation to the City of Loveland on Fort Collins-Loveland Municipal Airport Property. RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT: Since the Airport will benefit in the long run from the installation of the electrical substation on Airport property,and, since the property will remain in Municipal ownership,no compensation has been recommended. 0 EXECUTIVE SUMMARY: The Cities of Fort Collins and Loveland each own a fifty-percent share of the Fort Collins-Loveland Municipal Airport. The City of Loveland has asked for approval from the City of Fort Collins to acquire an easement of approximately three acres in order to construct an electrical power substation. The substation will provide improved service to residents in the vicinity of the Airport, and the Airport itself over time. Section 23-111 of the City Code provides that the City Council must authorize the sale, or conveyance of real property owned by the City following a determination that to do so is in the best interest of the City. The Airport Layout Plan that follows indicates the approximate location of the easement on Airport property. Exhibit"A" addresses the legal description of the property. 0 . ORDINANCE NO. 111, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CONVEYANCE OF A NON-EXCLUSIVE EASEMENT FOR AN ELECTRICAL SUBSTATION TO THE CITY OF LOVELAND ON FORT COLLINS LOVELAND AIRPORT PROPERTY WHEREAS,the City of Fort Collins and the City of Loveland each own an undivided fifty percent share of that certain real property known as the Fort Collins Loveland Airport ("the Airport"); and WHEREAS, the City of Loveland wishes to acquire a non-exclusive easement under and through a portion of the Airport as described on Exhibit "A", attached hereto and incorporated herein by this reference (the "Easement"), for installation of a power substation by the Loveland electric utility,along with associated lines,ducts,and other equipment and structures associated with the substation; and WHEREAS, City and Airport staff have determined that the proposed Easement will not have a negative impact on the Airport, and will enable the City of Loveland to provide improved electric service in the vicinity of the Airport, to the Airport's eventual benefit, and therefore recommend that no compensation be required for the grant of the Easement; and WHEREAS, Section 23-111 of the City Code provides that the City Council is authorized . to sell, convey or otherwise dispose of real property owned by the City,provided the Council first finds by ordinance that any sale or other disposition of real property owned by the City is in the best interest of the City of Fort Collins. NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the conveyance of the Easement is in the best interest of the City of Fort Collins. Section 2. That the Mayor is authorized to execute such documents of conveyance as are necessary to convey the Easement interest to the City of Loveland upon the terms and conditions described above.
