HomeMy WebLinkAboutCOUNCIL - AGENDA ITEM - 05/06/2008 - RESOLUTION 2008-039 AUTHORIZING THE LEASE OF A POR ITEM NUMBER: 13 AGENDA ITEM SUMMARY DATE: May 6, 2006 FORT COLLINS CITY COUNCIL STAFF: Kelly DiMartino Helen Matson SUBJECT Resolution 2008-039 Authorizing the Lease of a Portion of City-Owned Property Located at 200 West Mountain Avenue, Suites A and B, For Up to Two Years As Part of the Fort Collins Public Access Network ("FC-PAN"). RECOMMENDATION Staff recommends the adoption of the Resolution. FINANCIAL IMPACT The City is recommending that there be no cost to FC-PAN for leasing the space nor for the cost of utilities during the first year. However, during the second year, FC-PAN will pay for utilities only. EXECUTIVE SUMMARY FC-PAN is the City's designated public access provider. One of its responsibilities, as required by the City, is to provide and operate a Community Media Center. Operations Services has identified 449 square feet of City-owned space at 200 West Mountain Avenue that is available for this purpose and is contracting with FC-PAN for its use. Details of the agreement are as follows: • The City will provide temporary space for the Community Media Center. • Year One: 449 square feet of space and utilities provided at no cost. • Year Two: 449 square feet of space provided at no cost; FC-PAN pays for utilities (approximately$65 per month). BACKGROUND FC-PAN is a relatively new non-profit,with extremely limited funding. The reason for its existence is to provide public access television services,something that the City may provide itself or contract out. For the past two years, FC-PAN has been seeking City assistance in finding space for the Community Media Center that could be provided at no, or very low cost. May 6, 2008 -2- Item No. 13 It is important that the space be in close proximity to City Hall as the City purchases and owns the public access equipment,and the equipment that physically puts the public access programming on the air is located at City Hall. Space has previously not been available. With the relocation and consolidation of some City offices, space for FC-PAN is now available at 200 West Mountain. The majority of the building will be used by the Rocky Mountain Innovation Initiative(RMI2). FC-PAN offices will be contained in one area of the building that provides a separate entry so that appropriate office hours can be set. The lease agreement covers only a two year term. The expectation is that during those two years, FC-PAN will secure funding for on-going operation costs, including rent, at a more permanent location. ATTACHMENTS I. Location Map. ATTACHMENT 1 200 W. Mountain Ave-Stes A & B Fort Collins Public Access Network Location Map LaPorte Avenue !rp!j• � Y` 61 Y l6 a d m d U FD U_ y c U °1 0 o City of Ft Calling m = operation SemicesIRES 2 W Mountain Avenue Larimer County Courthouse ® Suites A and B Location N Suite C Location RESOLUTION 2008-039 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF A PORTION OF CITY-OWNED PROPERTY LOCATED AT 200 WEST MOUNTAIN AVENUE, SUITES A AND B, FOR UP TO TWO YEARS AS PART OF THE FORT COLLINS PUBLIC ACCESS NETWORK("FC-PAN") WHEREAS, the City is the owner of the property legally described as a portion of Lot 2, Replat Lots 1-49, Block 31, Fort Collins, Colorado, also known as 200 West Mountain Avenue, Suites A and B (the "Property"); and WHEREAS, the City purchased the Property for the Civic Center Master Plan and has not yet finalized specific plans for the Property; and WHEREAS, FC-PAN is the City's designated public access provider and one of its responsibilities, as required by the City of Fort Collins, is to provide and operate a Community Media Center; and WHEREAS, FC-PAN has been seeking City assistance in finding space that could be provided at no or very low cost; and WHEREAS,the City desires to lease 449 square feet of the Property to FC-PAN at no cost for the first year and, during the second year FC-PAN would pay for utilities only; and WHEREAS, under Section 23-114(a) of the Code of the City of Fort Collins, the Council is authorized to lease, for a definite term of two years or less, any and all interests in real property owned in the name of the City,provided that the Council first finds, by resolution,that the lease is in the best interests of the City. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council hereby finds that leasing the Property under the terms listed above is in the best interests for the City of Fort Collins. Section 2. That the City Manager is hereby authorized to execute lease agreements for the Property on terms and conditions consistent with this Resolution,together with such additional terms and conditions as the City Manager, in consultation with the City Attorney, determines to be necessary and appropriate to protect the interests of the City,including any necessary changes to the legal description of the Property, as long as such changes do not materially increase the size or change the character of the leased premises.
