FINANCIAL IMPACT: This Resolution authorizes the Housing Authority to apply for funding from HUD in the amount of $299,012 to fund current and future capital improvements for the Authority's public housing stock. Annual budgets for the future will have to be developed to manage this fund. EXECUTIVE SUMMARY: Originally, grants under the U.S. Department of Housing and Urban Development's (HUD) Comprehensive Improvement Assistance Program (CIAP) were awarded on a competitive basis. Several years ago,however,larger housing authorities (over 250 units)were placed in a new HUD Capital Fund Program(CFP). CFP provided funding annually on a non-competitive basis using the number of housing units as the basis to determine the amount of the grant. HUD recently decided to eliminate CIAP and replaced it with CFP. Nonetheless,HUD will provide this year a one-time distribution of CIAP funds based on units and total bedrooms. The allocation for the Fort Collins Housing Authority will be $299,012 ($1,941.63 per unit). To be eligible for these funds,the Board must adopt this Resolution. HUD will be developing a formula for the award of grants under CFP for the upcoming Federal fiscal year 2000. i RESOLUTION NO. 19 OF THE BOARD OF COMMISSIONERS OF THE FORT COLLINS HOUSING AUTHORITY AUTHORIZING THE 1999 COMPREHENSIVE IMPROVEMENT ASSISTANCE PROGRAM GRANT APPLICATION WHEREAS, in the past the United States Department of Housing and Urban Development ("HUD")has awarded the Fort Collins Housing Authority("the Authority"),on a competitive basis, grants under HUD's Comprehensive Improvement Assistant Program ("CIAP"); and WHEREAS,recently HUD has decided to eliminate the CIAP and replace it with the Capital Fund Program ("CFP") which will award these grants based on the number of units a housing authority has,rather than on a competitive basis; and WHEREAS,in phasing out the CLAP and replacing it with the CFP,HUD will be providing this year a one-time distribution of CIAP funds to the Authority based on the number of units it has; and WHEREAS, if the Authority applies for a CIAP grant, it will be eligible to receive Two Hundred Ninety-Nine Thousand and Twelve Dollars ($299,012) or One Thousand Nine Hundred Forty-One Dollars and Sixty-Three Cents ($1,941.63)per unit; and WHEREAS,in order to be eligible for these funds,the Authority must apply for the grant and the Board must adopt this Resolution making the certifications contained herein to HUD and enter into the agreements contained herein with HUD. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE FORT COLLINS HOUSING AUTHORITY that the Authority's 1999 CIAP application is hereby authorized and the Authority hereby certifies to and agrees with HUD as follows concerning such grant: 1. The Authority will comply with all policies,procedures,and requirements prescribed by HUD for modernization, including implementation of the modernization in a timely, efficient, and economical manner. 2. The Authority has established controls to ensure that any activity funded by the CIAP is not also funded by any other HUD program,thereby preventing duplicate funding of any activity. 3. The Authority will not provide to any development more assistance under the CIAP than is necessary to provide affordable housing, after taking into account other government assistance provided. 4. The proposed physical work will meet the modernization and energy conservation standards under 24 CFR 986.115. 5. The Authority will comply with applicable nondiscrimination and equal opportunity requirements under 24 CFR 5.105(a). 6. The Authority will take appropriate affirmative action to award modernization contracts to minority or women's business enterprises'urtder 24 CFR 5.105(a). 7. The Authority has provided HUD or the responsible entity with-any documentation that the Department needs to carry out its review under the National Environmental Police Act (NEPA)and other related authorities in accordance with 24 CFR 96t 110(c), (d) and(m). 8. The Authority will comply with the wage rate requirement under 24 CFR 968.110(e.) and(f). 9. The Authority will comply with the relocation assistance and real property acquisition requirements under 24 CFR 968.108. 10. The Authority will-comply with the requirements for physical accessibility under 24 CFR 968,145. 11. The Authority will comply with the requirements for access to records and audits under 24 CFR 968,145. 12. The Authority will comply with the uniform administrative requirements under 24 CFR 968.135. 13. The Authority will comply with lead-based paint testing and abatement requirements under 24 CFR 968.110(k). 14. The Authority has complied with the requirements governing local government and resident participation in accordance with 24 CFR 968.210-(b) and 968.215, and has given full consideration to the priorities and concerns of local goveitiment and residents. 15. The Authority will.co*mply with the special,requirements of 24 CFR 968.102 with respect to a Turnkey III development., 16. The Authority will comply With.the'spe W requirements of 24 CFR 968.101(b)(3) with respect to a Section 23 leased housing bond-financed development.
