SUBJECT
First Reading of Ordinance No. 180, 2004, Appropriating Unanticipated Revenue in the General
Fund for Police Services and Authorizing the Transfer of Matching Funds Previously Appropriated
in the Police Services Operating Budget to the Local Law Enforcement Block Grant Program.
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
The City has received a grant in the amount of$13,817 from the U.S.Department of Justice for the
Local Law Enforcement Block Grant ("LLEBG") program. The funds will be used to procure
equipment related to basic law enforcement functions. This grant requires a cash match of$1,535
which will be met by the existing Police Service budget.
EXECUTIVE SUMMARY
Fort Collins Police Services("FCPS")has been awarded a grant from the U.S.Department of Justice
I G program in the amount of$13,817. The funds are to buy equipment related to basic law
enforcement functions. A local cash match of$1,535 is required and will be met by the existing
Police Services budget. The grant funds will be used to purchase trunk vaults for securing SWAT
rifles and other SWAT equipment in vehicles.
The grant requires input from an Advisory Board who will make a non-binding recommendation to
the U.S. Department of Justice on the agency's use of the funds. The Advisory Board, consisting
of representatives from local law enforcement(FCPS Chief Harrison),prosecution(District Attorney
Stuart VanMeveren), court system (Judge Kathleen Lane), public school (Ellyn Dickmann), and a
non-profit agency active in crime prevention or treatment(Scoot Crandall—TEAM Fort Collins and
Pam McCracken — CSU Center for Drug and Alcohol Education), reviewed the project and
supported the proposed use of the grant funds.
In addition, a Public Hearing was held on August 13, 2004, to allow any citizen of Fort Collins to
comment on the proposed use of the grant funds. No one attended the public hearing and no
comments were received.
FCPS documented the Advisory Board recommendation and Public Hearing input and sent the
results to the U.S. Department of Justice. Final notice of grant award was received on August 24,
2004, and the grant period closes on September 30, 2005.
ORDINANCE NO. 180, 2004
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE
GENERAL FUND FOR POLICE SERVICES AND AUTHORIZING
THE TRANSFER OF MATCHING FUNDS PREVIOUSLY APPROPRIATED
IN THE POLICE SERVICES OPERATING BUDGET TO THE LOCAL LAW
ENFORCEMENT BLOCK GRANT PROGRAM
WHEREAS,the City of Fort Collins Police Services has been awarded a grant by the United
States Department of Justice and the Local Law Enforcement Block Grant("LLEBG")program in
the amount of$13,817; and
WHEREAS, the LLEBG funds are to be used for the procurement of equipment related to
basic law enforcement functions; and
WHEREAS, the grant funds will be used to purchase approximately 12 trunk vaults for
securing SWAT rifles and other SWAT equipments in vehicles; and
WHEREAS,an Advisory Board was formed of representatives from local law enforcement,
the prosecutor's office,the court system,the public schools,and a non-profit agency active in crime
prevention or treatment; and
WHEREAS, the Advisory Board reviewed the proposed use of the grant funds and
recommended to the United States Department of Justice the agency's use of the funds; and
WHEREAS, the grant requires $1,535 of matching funds, which was included in the 2004
Police Services budget for this purpose and are available for transfer to the Police Services LLEBG
program; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins ("Charter")
permits City Council to make supplemental appropriations by ordinance at any time during the fiscal
year, provided that the total amount of such supplemental appropriations, in combination with all
previous appropriations for that fiscal year, does not exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of the LLEBG funds as
described herein will not cause the total amount appropriated in the General Fund to exceed the
current estimate of actual and anticipated revenues to be received in that fund during the fiscal year;
and
WHEREAS, Article V, Section 10,of the Charter authorizes the City Council to transfer by
ordinance any unexpended and unencumbered amount or portion thereof from one project to another
project, provided that the purpose for which the transferred funds are to be expended remains
unchanged.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated from unanticipated grant revenue in the
General Fund the sum of THIRTEEN THOUSAND EIGHT HUNDRED AND SEVENTEEN
DOLLARS ($13,817)for expenditure in the General Fund for Police Services equipment related to
basic law enforcement functions.
Section 2. That the unexpended appropriated amount of ONE THOUSAND FIVE
HUNDRED THIRTY-FIVE DOLLARS($1,535)is authorized for transfer from the Police Services
operating budget in the General Fund to the Police Services LLEBG program for equipment and
technology related to basic law enforcement functions and appropriated therein.
