RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT The proposed appropriations of$414,100 will come from Storm Drainage Fund Prior Year Reserves. EXECUTIVE SUMMARY The Fossil Creek Drainage Basin Master Plan identifies the need to improve the storm drainage culverts under Timberline Road at Fossil Creek, between Trilby and Carpenter Roads. The new culverts are a prerequisite for a future project that will remove approximately 105 homes from the Fossil Creek floodplain in the Paragon Point area. These improvements are adjacent to the Fossil Creek Wetlands Natural area on the west and the Fossil Creek Reservoir Natural area on the east. When the Fort Collins-Loveland Water District ("FCLWD") identified a need to construct a 30" diameter water main in this portion of Timberline Road, the City Utilities and Engineering Departments elected to partner with FCLWD and undertake a multi-jurisdictional project that would construct the water main, install the storm culverts and improve Timberline Road between Trilby and Carpenter Roads. By doing all the work as one project, the construction costs, impact to the public and to adjacent natural areas would be minimized. Over the past year, FCLWD and City staff from Utilities, Transportation and Natural Resources have worked together to obtain approval from the Natural Resources Advisory Board on a win/win wetland mitigation plan. In September,City Council approved the necessary temporary construction easements and slope restriction agreements. Recently, the scope of the project changed, which resulted in a redistribution of costs. The transportation improvement elements were drastically scaled back due to budget constraints within the Street Oversizing Fund. Although this reduced the impact to the natural areas, it also resulted November 18, 2003 -2- Item No. 11 in a higher portion of the remaining earthwork, mitigation, and paving costs to be shared by the FCLWD and City Utilities. The City Utilities' increased portion of construction cost is estimated at $410,000, along with an Art in Public Places appropriation of$4,100. Although the scope of the project has changed, all parties are still in agreement that a joint project minimizes construction costs as well as reduces impacts on the public and adjacent natural areas. ORDINANCE NO. 161, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING STORM DRAINAGE FUND PRIOR YEAR RESERVES INTO THE FOSSIL CREEK BASIN CAPITAL PROJECT FOR THE CONSTRUCTION OF STORM WATER IMPROVEMENTS ASSOCIATED WITH THE TIMBERLINE ROAD WATERLINE IMPROVEMENT PROJECT WHEREAS, the Fort Collins-Loveland Water District ("FCLWD") plans to construct a 30-inch diameter water main in Timberline Road from Trilby Road to Carpenter Road, and continuing south to serve the Latimer County Events Center and the expanding facilities in the vicinity of the Fort Collins-Loveland Airport (the "Water Main"); and WHEREAS, City Stormwater staff has identified a need for critical flood control box culverts in the vicinity of the Water Main in order to improve public safety in 100-year flood events (the "Stormwater Improvements"); and WHEREAS, FCLWD and the City have worked to develop a cooperative plan for the construction of the Water Main and the Stormwater Improvements (together referred to as the "Project"), so as to minimize cost and disruption associated with the construction; and WHEREAS, the scope of the project has changed, resulting in a redistribution of costs and a higher share of the project costs being shared by City Utilities; and WHEREAS, all parties are still in agreement that a joint project minimizes construction costs, impact to the public and adjacent natural areas; and WHEREAS, funds to cover the higher share of the project costs are available in the Storm Drainage Fund Prior Year Reserves; and WHEREAS, Article V, Section 9 of the Charter of the City of Fort Collins permits the City Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as may be available from reserves accumulated in prior years, notwithstanding that such reserves were not previously appropriated. NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from prior year reserves in the Storm Drainage Fund the sum of FOUR HUNDRED TEN THOUSAND DOLLARS ($410,000) into the Fossil Creek Basin Capital Projects and FOUR THOUSAND, ONE HUNDRED DOLLARS for the construction of the storm drainage improvements associated with the Timberline Road Waterline Improvement Project. Introduced, considered favorably on first reading, and ordered published this 18th day of November, A.D. 2003, and to be presented for final passage on the 2nd day of December, A.D. 2003.
