RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT: The lease will generate,in land rents for the airport,$288 annually for the first five years. After the fifth,and every fifth year thereafter through the term of the lease(twenty-five),the rent will increase (using an equation based on the inflation rate established by the Denver-Boulder Consumer Price Index). EXECUTIVE SUMMARY: The Airport Manager has negotiated a twenty-five year lease of property with James Grubbs,for the construction of an aircraft hangar. James Grubbs will construct a hangar that will provide at least 2,000 square feet of aircraft storage space. At the expiration of the lease,the improvements revert to the ownership of the Cities. The construction of the hangar will generate new revenue for the Airport and help meet the aircraft storage needs of local aircraft owners. 9 i ORDINANCE NO. 74, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LONG-TERM LEASE OF PROPERTY AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT TO JAMES GRUBBS FOR THE CONSTRUCTION OF AN AIRCRAFT HANGAR WHEREAS,the Cities of Fort Collins and Loveland(the"Cities")jointly own and manage certain real property in Larimer County that is the site of the Fort Collins-Loveland Municipal Airport (the "Airport Property"); and WHEREAS, the Cities have set aside a portion of the Airport Property for lease to parties desiring to conduct aeronautical activities and support activities at the airport; and WHEREAS,pursuant to Section 23-114 of the Code of the City of Fort Collins,the Council is authorized to lease any and all interests in real property owned in the name of the City,provided that Council first finds that the lease is in the best interests of the City; and WHEREAS, the Intergovernmental Agreement for the Joint Operation of the Fort Collins- Loveland Municipal Airport between the Cities specifically recognizes the leasing of Airport Property as a valid use of the jointly owned Airport Property; and . WHEREAS, James Grubbs has indicated a desire to lease a portion of airport property, described as follows and hereinafter referred to below as "the Lot", for the construction and maintenance of an aircraft hangar: Hangar Site: A portion of the Northeast''/<of Section 33,Township 6 North,Range 68 West of the 6th Principal Meridian, Larimer County, Colorado more particularly described as follows: Considering the East line ofthe Northeast''/<of Section 33,Township 6 North,Range 68 West of the 6th Principal Meridian,Larimer County,Colorado as defined by a'/< inch iron rod with a 3 inch brass cap marked PLS 13446 at the Northeast corner of said Section 33 and a'/o inch iron rod with 2 inch aluminum cap marked PLS 11989 at the East '/4 corner of said Section 33, as bearing S 00' 31' 31" E and with all bearings contained herein relative thereto. Commencing at the Northeast corner of Section 33, Township 6 North, Range 68 West of the 6th Principal Meridian,Larimer County,Colorado;thence run S 00'31' 31" E along the East line of the Northeast '/4 of said Section 33 for a distance of 1,984.86 feet; thence leaving said East line run S 89' 28'29" W for a distance of 899.39 feet to the true POINT OF BEGINNING; thence run S 70' 19' 30" W for a • distance of 60.00 feet; thence run N 19' 40' 27" W for a distance of 40.00 feet; thence run N 70' 19' 30" E for a distance of 60.00 feet; thence run S 19' 40' 27" E for a distance of 40.00 feet to the true Point of Beginning. Containing 2,400 square feet or 0.06 acres more or less. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the proposed lease of the Lot to James Grubbs upon the terms of the lease hereafter referenced, is in the best interests of the City. Section 2. That the Mayor is hereby authorized to enter into a long term lease of the Lot to James Grubbs under the terms and conditions of that certain lease form entitled "Lease Agreement,Cities of Loveland and Fort Collins,Colorado and James Grubbs"which is on file with the City Clerk of the City of Fort Collins, Colorado. Introduced and considered favorably on first reading and ordered published this 4th day of May, A.D. 1999, and to be presented for final passage on the 18th day of May, A.D. 1999.
