RECOMMENDATION: Staff recommends the adoption of the Resolution and the Ordinance on First Reading. FINANCIAL IMPACT: Adoption of the Ordinance will appropriate an additional $59,000 from the Colorado Department of Transportation for the Gateway Mountain Park Access Road Project. The required matching funds have already been appropriated. i i i a EXECUTIVE SUMMARY: A. Resolution 99-54 Authorizing the Mayor to Enter into an Amendment to the j Intergovernmental Agreement Between the City and the State Department of Transportation a for Highway Realignment and Access Design for Gateway Mountain Park. i B. First Reading of Ordinance No. 71, 1999, Appropriating Unanticipated Revenue in the Capital Projects Fund to Be Used for the Gateway Mountain Park Access Road Project. Gateway Mountain Park is a 400-acre site located five miles up the Poudre Canyon. The site is d owned by the City of Fort Collins and was previously the City's Water Treatment Plant. The City o Council has provided direction to make this property accessible to the public. In addition to ? providing access to a 400-acre park site, this project will also open up approximately two square miles of additional natural area. This land is owned by a combination of federal, state, and local E agencies and is contiguous to the 400-acre site. These lands are currently inaccessible to the public because of the entry road problem. The overall plan for the Gateway project is to provide a mountain park setting for more active recreation and safe access to a currently inaccessible mountain area. i i DATE: May 4, 1999 2 ITEM NUMBER: 21 A-B The project involves the realignment of State Highway 14 (Poudre Canyon) at the entrance to the City's old water treatment plant. This project will provide safe access to Gateway Mountain Park and alleviate highway safety issues associated with the site. Council approved this project and the contract with CDOT pursuant to Resolution 98-113 and appropriated available 1998 funding by adopting Ordinance No. 135, 1998. The appropriated funds are sufficient to provide the increased local match in the total amount of$51,000. By adopting Resolution 99-54 Council will be amending the City's agreement with CDOT as follows: Section V. "PROJECT FUNDING PROVISIONS," paragraph A. shall be modified as follows: A. The local Agency has estimated the total cost of the work to be $254,000, which is to be funded as follows: a. Federal Participating Funds: (80% of$254,000) $203,000 b. Local Agency Participating Share: (20% of$254,000) 51,000 Total Funds $254,000 Paragraph B. of Section V. shall be amended by deleting the amount of $180,000 and substituting the amount with$254,000. Paragraph C. of Section V. shall be amended by deleting the amount of $144,000 and substituting the amount with$203,000. These changes simply add state fiscal year 1999 funding in the amount of$59,000 to the project. Staff will be returning to Council in July to request the appropriation of approximately$167,000(plus interest)in CDOT fiscal year 2000 funding. The state fiscal year 2000 money will not be available until July and state regulations require the City to appropriate the fiscal year 1999 funding before July. RESOLUTION 99-54 OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO ENTER INTO AN AMENDMENT TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY AND THE STATE DEPARTMENT OF TRANSPORTATION FOR HIGHWAY REALIGNMENT AND ACCESS DESIGN FOR GATEWAY MOUNTAIN PARK WHEREAS, the City of Fort Collins, Colorado (the "City") has the power to enter into intergovernmental agreements with the State of Colorado under Article II,Section 16 of the Charter of the City; and WHEREAS, the State of Colorado, State Department of Transportation (the "State"), has obtained certain federal funds pursuant to the Intermodal Surface Transportation Efficiency Act of 1991 (ISTEA) to be allocated for highway projects; and WHEREAS,the State is responsible for the disbursement of these funds; and WHEREAS, the City is desirous of obtaining said funds for the provision of highway realignment and access design of State Highway 14 to create a safe access to Gateway Mountain Park, and has filed an application with the State for this purpose; and WHEREAS, on August 18, 1998, the Council adopted Resolution 98-113, authorizing the Mayor to enter into an Intergovernmental Agreement with the State Department of Transportation, for highway realignment and access design for Gateway Mountain Park; and WHEREAS,the State has proposed an amendment to the Intergovernmental Agreement to provide additional funds for the project; and WHEREAS,the City desires to accept the additional funds for such project pursuant to the conditions of the amendment to the Intergovernmental Agreement; and WHEREAS, the City matching funds required in the Intergovernment Agreement were appropriated in Ordinance No. 135, 1998,along with sufficient additional City funds to provide the required local match for the additional State funds, in the additional amount of $15,000; and WHEREAS,the City desires to work together with the State to effect said project as provided in the Intergovernmental Agreement, as amended. NOW, THEREFORE, BE IT RESOLVED BY COUNCIL OF THE CITY OF FORT COLLINS, COLORADO that the Mayor is hereby authorized to enter into an amendment to the Intergovernmental Agreement between the City and the State of Colorado, State Department of Transportation, for the provision of realignment and access design of State Highway 14 to create a . safe access to Gateway Mountain Park, which amendment shall increase the amount of federal participating funds from $144,000 to $203,000, and shall increase the amount of local agency participating share from $36,000 to $51,000. Passed and adopted at a regular meeting of the City Council of the City of Fort Collins held this 4th day of May, A.D. 1999. Mayor ATTEST: City Clerk • ORDINANCE NO. 71, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND TO BE USED FOR THE GATEWAY MOUNTAIN PARK ACCESS ROAD PROJECT WHEREAS,the City of Fort Collins owns a 400-acre site located approximately five miles up the Poudre Canyon,which property was formerly known as the City's Water Treatment Plant No. 1, and is currently identified as Gateway Mountain Park; and WHEREAS, the City Council has provided direction to make the Park accessible to the public by improving the entry road to the Park from Highway 14 (the "Project") at an estimated design and construction cost of$1,120,000; and WHEREAS,City Council adopted Resolution 98-113,on August 18, 1998,authorizing the City to contract with the Colorado Department of Transportation(CDOT)for the realignment of the entry road to Gateway Mountain Park; and WHEREAS, on September 1, 1998, City Council adopted Ordinance No. 135, 1998, appropriating $664,000 to be used for improvements associated with the Project, with the . understanding that the remaining funds ($456,000) would be appropriated in 1999 and 2000; and WHEREAS, CDOT has subsequently made available an additional $59,000 to be used for the Project; and WHEREAS, sufficient City funds were appropriated in Ordinance No. 135, 1998,to match the new total grant amount; and WHEREAS, City Council adopted Resolution 99-54, on May 4, 1999, amending the intergovernmental agreement between the City of Fort Collins and the Colorado Department of Transportation for the design and development of the access road to Gateway Mountain Park; and WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, it is the desire of the Council to appropriate funds, totaling $59,000, from unanticipated revenue in the Capital Projects Fund, Gateway Mountain Park capital project, to be used for the design and development of the access road to Gateway Mountain Park. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund, Gateway Mountain Park capital project, the sum of FIFTY-NINE THOUSAND DOLLARS($59,000),representing additional revenue from the Colorado Department of Transportation to be used for the design and development of the access road to Gateway Mountain Park. Introduced,considered favorably on first reading and ordered published this 4th day of May, A.D. 1999, and to be presented for final passage on the 18th day of May, A.D. 1999.
