EXECUTIVE SUMMARY: Ordinance No. 60, 1999, which was unanimously adopted on First Reading on April 20, 1999, vacates a portion of the street right-of-way for Mitchell Drive. RECOMMENDATION: ; X Staff recommends adoption o�, e Ordinance onTigLReadmg ,', EXECUTIVE SUMMARY: This Ordinance vacates a portion of the street right-of-way for Mitchell Drive. The site was originally platted as part of Lots 1 and 2 of Observatory Heights. Right-of-way was dedicated for future expansion along Mitchell,Drive at the mtersectfM(5f;FastHorsetooth Road to include both a left-turn lane and a nght turts.-'lane. Because o the gg4struo on of the landscaped median along East Horsetooth Road, a left-turn lane is fio longer needed. Therefore,not all of the street right-of- way that was originally dedicate the Observat4y Heights plat is needed. Hence,a portion of the right-of-way is being proposed for vacation with the Palmer Design Center development. As there are currently utilities in place that cross this area, the street right-of-way will be retained as a utility easement. COP
