RECOMMENDATION: Staff recommends adoption of the Resolution. EXECUTIVE SUMMARY: The state Sunshine Law requires that, at its first regular meeting of each year, the City Council designate the place for the posting of notices of meetings to be held by the Council, City boards and commissions or any committees of the same. OACKGROUND: The adoption of this Resolution is being recommended by City staff to comply with the provisions of the state's Sunshine Law, even though the City has adopted its own open meetings laws. Both the state Sunshine Law and the City Code require that full and timely notice be given of meetings at which any formal action could occur or at which a majority of the members are expected to be in attendance. One of the requirements of the state law is that the City Council, at its first regular meeting of each calendar year, designate the public place or places for the posting of such notices. That place is already designated in Section 2-34 and 2-74 of the City Code as the Information Desk bulletin board in the lobby of City Hall West. These provisions in the Code probably satisfy the intent of the state law. (Many municipalities may not have such code provisions if they do not have local open meetings laws.) However, since there is no conflict on this point between the requirements of the state law and the requirements of the City Code,staff is recommending that this Resolution be adopted. The adoption of the Resolution should not be construed, however, as a waiver of the City's ability,as a home rule municipality,to abide solely by the provisions of its local open meetings laws if a situation arises in which there is a conflict between the state and local laws. . RESOLUTION 2000-7 OF THE COUNCIL OF THE CITY OF FORT COLLINS DESIGNATING THE PLACE FOR POSTING NOTICES OF CERTAIN PUBLIC MEETINGS WHEREAS,the state legislature has enacted Section 24-6-401 et seq.(the"Sunshine Law"), which governs the meetings of"local public bodies"as defined therein; and WHEREAS,Section 24-6-402(2)(c)ofthe Sunshine Law states that a local public body shall, at its first regular meeting of each calendar year,designate the public place or places for posting full and timely notice of any meetings of local public bodies at which the adoption of any proposed policy,position resolution,rule,regulation or formal action occurs,or at which a majority or quorum of the body is in attendance, or is expected to be in attendance; and WHEREAS,the City of Fort Collins,as a home rule municipality,has adopted its own laws pertaining to meetings of the City Council, City boards and commissions and the committees of each; and WHEREAS, through the adoption of Section 2-34 and 2-74 of the City Code, the City Council has permanently designated the place for the posting of notice of meetings of these bodies as required by the Sunshine Law; and WHEREAS, the City Council wishes,nonetheless,to comply with the requirements of the Sunshine Law to the extent that such requirements are not in conflict with the City's own open meetings laws. NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Information Desk bulletin board in the lobby of City Hall West, 300 LaPorte Avenue,shall be, and the same hereby is,designated as the proper place for the posting of notice of any meetings of the City Council or City, boards and commissions, or meetings of the committees of such bodies,for which public notice is required by law to be given.
