SUBJECT:
Items Relating to Railroad Crossing Warning Devices for Lincoln Avenue.
RECOMMENDATION:
Staff recommends adoption of the Resolution and the Ordinance on First Reading.
FINANCIAL IMPACT:
Federal "ISTEA" funds will pay for 100% of the cost for the new crossing warning devices.
S148,844 in Federal Funds have been budgeted towards this project and are being appropriated into
the Railroad Consolidation Project Fund. The City is required to pay indirect costs for administering
the project. These costs. estimated at$6.156,will be paid for with existing Railroad Consolidation
Project Funds.
EXECUTIVE SUMMARY:
A. Resolution 2000-1 Authorizing the City Manager to Enter into an Agreement with the
Colorado Department of Transportation, and the Union Pacific Railroad Company for
Installing New Crossing Warning Devices at the Lincoln Avenue Crossing of the Union
Pacific Railroad Tracks Northeast of Jefferson Street.
B. First Reading of Ordinance No. 7. 2000, Appropriating Unanticipated Revenue in the
Railroad Consolidation Project Fund to be used for Installing Crossing Warning Devices at
the Lincoln Avenue Crossing of the Union Pacific Railroad Tracks Northeast of Jefferson
Street.
The agreement with the Colorado Department of Transportation (CDOT), and the Union Pacific
Railroad Company (UPRR). is for installation of crossing warning devices at the Lincoln Avenue
crossing of the Union Pacific Railroad tracks northeast of Jefferson Street. The project consists of
constructing new signals and gates to improve safety at the crossing.

The City applied for and received Federal ISTEA Funds to pay for 100% of the cost to install the
crossing warning devices. Adoption of the Ordinance would appropriate the $148,844 in Federal
Funds budgeted towards the project into the Railroad Consolidation Project Fund. Not covered by
federal funding,the City is required to pay for indirect costs. These costs, estimated at$6.156,will
be paid for with existing Railroad Consolidation Project Funds.
This project will be done in coordination with another project under separate agreement between the
City and the UPRR to replace and widen the crossing material to provide width for the travel lanes,
bicycle lanes and sidewalks.
Construction of the improvements is scheduled for later this year.
RESOLUTION 2000-3
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT
WITH THE COLORADO DEPARTMENT OF TRANSPORTATION AND THE
UNION PACIFIC RAILROAD COMPANY FOR INSTALLING NEW CROSSING
WARNING DEVICES AT THE LINCOLN AVENUE CROSSING OF THE
UNION PACIFIC RAILROAD TRACKS NORTHEAST OF JEFFERSON STREET
WHEREAS,the City and the Union Pacific Railroad Company ("UPRR") desire to install
crossing warning devices at the Lincoln Avenue crossing of the Union Pacific Railroad tracks
northeast of Jefferson Street: and
WHEREAS, Federal Intermodel Surface Transportation Efficiency Act ("ISTEA") funds
have been made available to pay for one hundred (100) percent of the cost of installation of said
crossing warning devices; and
WHEREAS,the City has sufficient Railroad Consolidation Project Funds to pay for all costs
in administering the project. which costs are estimated to be in the sum of Six Thousand One
Hundred and Fifty Six Dollars ($6,156); and
WHEREAS, the total costs of the project are estimated by UPRR to be in the sum of One
Hundred Fifty Five Thousand Dollars ($155,000); and
WHEREAS, ISTEA funds are available in the maximum amount of One Hundred Forty
Eight Thousand Eight Hundred and Forty Four Dollars ($148,844)to fund the project: and
WHEREAS,the City.the State and UPRR now desire to enter into a contract for the purpose
of accomplishing the installation of the crossing warning devices at the Lincoln Avenue crossing of
the UPRR tracks northeast of Jefferson Street; and
WHEREAS. Section 16 of Article II of the City Charter provides that the Council may, by
resolution,enter into contracts with other governmental bodies to furnish governmental services or
to enter into cooperative or joint activities with other governmental bodies; and
WHEREAS, the Council had determined that the aforesaid contract for the installation of .
crossing warning devices is in the best interest of the City.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Council hereby approves the Contract between and among the City, the
State of Colorado and the Union Pacific Railroad Company, and authorizes the City Manager to
enter into the Contract on behalf of the City, which contract provides that one hundred percent
(100%) of the cost to install the aforesaid crossing warning devices shall be funded by Intermodel
Surface Transportation Efficiency Act funds and the cost incurred in administering theproject shall
be paid by the City in the estimated sum of six thousand one hundred fifty six dollars($6,156) from
City Railroad Consolidation Project Funds.
Passed and adopted at a regular meeting of the City Council held this 4th day of January,
A.D. 2000.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE
CAPITAL PROJECTS FUND DOWNTOWN RAILROAD TRACK CONSOLIDATION
CAPITAL PROJECT TO BE USED TO INSTALL NEW CROSSING WARNING DEVICES
AT THE LINCOLN AVENUE CROSSING OF THE UNION PACIFIC RAILROAD TRACKS
NORTHEAST OF JEFFERSON STREET
WHEREAS,Article V, Section 91 of the Charter of the City of Fort Collins(the"Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year, does not exceed the then current estimate of actual
and anticipated revenues to be received during the fiscal year; and
WHEREAS,the City Council adopted Resolution 2000-3, on January 4,2000, authorizing
the City to enter into a contract with the Colorado Department of Transportation(CDOT) and the
Union Pacific Railroad Company for the receipt of Intermodal Surface Transportation Efficiency
Act funds (ISTEA) to be used to install new crossing warning devices at the Lincoln Avenue
crossing of the Union Pacific Railroad tracks northeast of Jefferson Street (the"Project'); and
WHEREAS, the estimated cost of the Project is one hundred fifty-five thousand dollars
• ($155,000); and
WHEREAS, CDOT has made available to the City Intermodal Surface Transportation
Efficiency Act funds to pay for one hundred percent(100%) of the cost of installing new crossing
warning devices at the Project, or $148,844; and
WHEREAS, local funds, totaling six thousand one hundred fifty-six dollars ($6,156) have
been identified and are appropriated in the 2000 Capital Projects Downtown Railroad Track
Consolidation capital project to be used to reimburse the Colorado Department ofTransportation for
its costs in administering the Project; and
WHEREAS, it is the desire of the Council to appropriate the sum of$148,844 in federal
Intermodal Surface Transportation Efficiency Act funds to be used to install new crossing warning
devices at the Lincoln Avenue Crossing of the Union Pacific Railroad Tracks Northeast of Jefferson
Street.
NOW, THEREFORE. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the
Capital Projects Fund Downtown Railroad Track Consolidation capital project, the sum of ONE
HUNDRED FORTY-EIGHT THOUSAND EIGHT HUNDRED FORTY-FOUR DOLLARS
($148,844), from Colorado Department of Transportation Intermodal Surface Transportation
Efficiency Act funds, to be used to install new crossing warning devices at the Lincoln Avenue
• Crossing of the Union Pacific Railroad Tracks Northeast of Jefferson Street.
Introduced and considered favorably on first reading and ordered published this 4th day of
