RECOMMENDATION Staff and the Art in Public Places (APP)Board recommend adoption of the Resolution. FINANCIAL IMPACT The Utility Service Center Entryway Project art budget is$80,000,to be used for design,fabrication, installation and contingency for this project. Funds for this project have been appropriated for Art in Public Places in the following Utility funds: $ 23,663 in Light and Power, $34, 908 in Water, $17,793 in Wastewater and $3,636 in Storm Drainage. The Art in Public Places Program has a maintenance fund for the long-term care of the APP art collection. EXECUTIVE SUMMARY This Resolution will approve expenditure of $80,000 for design, fabrication, installation and contingency for a project to install a sculptural art piece by James Haire at the entrance to the Utility Service Center. BACKGROUND Section 23-303 of the City Code,which was added in 1995,established the Art in Public Places Reserve Accounts within the Light and Power,Water,Wastewater and Storm Drainage Funds,and designated them for use in acquiring or leasing works of art,maintenance,repair or display of works of art, and administrative expenses related to the Art in Public Places Program,in accordance with the Art in Public Places Guidelines adopted by the Council in Ordinance No. 20, 1995. The Council permanently adopted the Art in Public Places Program,and reenacted City Code Chapter 23,Article IX,with certain modifications in 1998. April 20, 2004 -2- Item No. 20 Under Section 23-303 of the Code,APP money in a utility account can only be used for works of art that provide a betterment to that utility,or that are otherwise determined by the City Council to be for a specific utility purpose that is beneficial to the rate payers. This project uses$7,275 of APP money remaining from a previous expansion project at the Utility Service Center site,as well as additional APP money from Utility projects that were not deemed appropriate locations for art work. The Art in Public Places Board moved to select an artist for this project using an RFP process through the City's Purchasing Department. The Utility Project Team selected Fort Collins artist James Haire. James Haire worked with the project team to create a design concept appropriate to the site. This design concept was reviewed and recommended by the Utility Project Team and the APP Board. The APP Board reviewed the design for this project at the Board's regular meeting on January 21, 2004. The artist will create five life-size bronze figures for the median in front of the Utility Service Center on Wood Street. The figures will depict a chemist, a project manager, a customer service representative,a field technician and an engineer. These figures are meant to honor the individuals and their professions. A written description and drawing of the proposed work of art are attached as Attachment"A". The final piece may vary from this description. Attachment A City of Fort Collins Art in Public Places Program Utility Service Center Entryway Project James Haire After working with the Utility Project Team, I propose to sculpt five life-size bronze figures to be placed on the southern end of the median in front of the utilities building at 700 Wood Street. The bronze sculpture will depict some of the various occupations of the people who work in the utilities department. The figures will represent a chemist, an engineer, an administrator, a field tech, and a customer service representative. They will be both male and female and of various ethnicities. The chemist will be a standing female in a lab coat pouring from a beaker into a test tube. The engineer will be wearing a hard hat and sifting on a low wall with blue- t rints spread on his lap. The administrator will be a standing male in a shirt and tie. He will have a folder in one hand and his sleeves rolled up ready for work. The field tech will also be a standing male. He will be wiping C " the perspiration from his brow with his forearm and holding a shovel in his other hand. The customer service person will be a female standing slightly in front of the other figures. She will be wearing a headset and have an order sheet in her hand as if helping a customer. The figures will be depicted as if encountered while they are working. They will be set in a flagstone plaza with a low wall running behind them on which the engineer will be sitting. This wall will be 17" at the highest point. While the group of figures will give an overall picture of the people who make up the Utility Department, the individual figures will be independent and are meant to give a sense of the work they do. These figures are meant to honor the individuals and their professions. Utility Entryway Design Presentation The artist,Jim Haire, presented the maquette for this piece to the board. The sculpture will be 5 full-size bronze figures placed in the median in front of the Utility Service Center. They will include a chemist, a field technician, an administrator, a customer service representative, and an engineer. The artist has worked extensively with the team on the composition of the figures. Mr. Sherman motioned to approve this work and to take before council for approval. Mr. Needham seconded. Adjournment 5:55 p.m. Respectfully submitted, Ilsbeth Kaufman Art in Public Places Program Assistant 01-21-04 RESOLUTION 2004-053 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING EXPENDITURES FROM THE ART IN PUBLIC PLACES RESERVE ACCOUNTS IN THE LIGHT AND POWER, WATER, WASTEWATER AND STORM DRAINAGE UTILITY FUNDS TO COMMISSION AN ARTIST TO CREATE A SCULPTURAL ENTRYWAY PIECE FOR THE UTILITY SERVICE CENTER WHEREAS, Section 23-303 of the City Code established the Art in Public Places Reserve Accounts in the Light and Power, Water, Wastewater and Storm Drainage Funds for use in the acquisition or leasing of works of art, maintenance, repair or display of works of art, and administrative expenses related to the Art in Public Places Program, in accordance with the Art in Public Places Guidelines adopted by Council in Ordinance No. 20, 1995 (the "Guidelines"); and WHEREAS, in 1998 the City constructed additional facilities at the Utility Service Center at 700 Wood Street, (the "Construction Project") funded jointly by the Wastewater Utility and the Light and Power Utility of the City; and WHEREAS, one percent(1%)of the funds appropriated for the Construction Project in the Wastewater Fund and the Light and Power Fund was set aside in the Art in Public Places reserve account for each of those funds, of which $7,275 remains to be used; and WHEREAS,the City Utilities have completed a number of projects (the"Utility Projects") that do not offer appropriate sites for Art in Public Places projects; and WHEREAS, one percent of the funds from the Utility Projects has been set aside in the Art in Public Places Reserve Accounts in the funds for the appropriate Utilities,and those Utilities have proposed that such funds be used for public art at the entry to the Utility Service Center(the "Art Project"); and WHEREAS, the Art in Public Places Board(the`Board"), moved to select an artist for the Art Project through an RFP process with the City Purchasing Department; and WHEREAS, the Utility Project Team selected James Haire (the"Artist")to create a design concept appropriate to the Utility Service Center site; and WHEREAS, the Board evaluated the Artist's final design at its regular meeting on January 21, 2004, pursuant to the Guidelines; and WHEREAS,based on that evaluation,the Board voted to recommend the Artist's proposal for five life-size bronze figures depicting a chemist, a project manager, a customer service representative, a field technician and an engineer, to be placed in the median in front of the Utility Service Center; and WHEREAS,the estimated cost to create the Art Project,including commission of the Artist, fabrication, installation and contingency for the Art Project, is $80,000; and WHEREAS, those funds are available in the Art in Public Places reserve accounts in the Light and Power,Water,Wastewater and Storm Drainage Utility Funds,and are appropriated as part of the 2004 budget,to provide for the artist design fees,fabrication,installation and contingency for the Art Project; and WHEREAS, Section 23-308 of the City Code requires that the Board's selection of the recommended art be presented for Council review and approval,because the cost of the art exceeds $10,000. NOW,THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Council hereby authorizes the expenditure of up to TWENTY THREE THOUSAND SIX HUNDRED AND SIXTY THREE DOLLARS ($23,663)from the Art in Public Places reserve account in the Light and Power Fund, THIRTY FOUR THOUSAND NINE HUNDRED AND EIGHT DOLLARS ($34,908) from the Art in Public Places reserve account in the Water Fund, SEVENTEEN THOUSAND SEVEN HUNDRED AND NINETY THREE DOLLARS ($17,793) from the Art in Public Places reserve account in the Wastewater Fund, and THREE THOUSAND SIX HUNDRED AND THIRTY SIX DOLLARS ($3,636) from the Art in Public Places reserve account in the Storm Drainage Fund for the Art Project,which consists of five life- size bronze figures depicting a chemist, a project manager, a customer service representative, a field technician and an engineer, to be placed in front of the Utility Service Center,which project is proposed by the artist James Haire, and the conceptual design of which was reviewed and approved by the Art in Public Places Board on January 21, 2004.
