Resolution 2004-055 Making an Amendment to the Boards and Commissions Manual Relating to
Residency Requirements.
RECOMMENDATION
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY
On June 4, 2002, Council adopted Resolution 2002-062 making amendments to the Boards and
Commissions Manual relating to the recruitment and appointment process for boards and
commissions. With regard to membership limitations, the residency requirements of the manual
were changed to state that applicants must be registered voters (except those under 18 years of age)
and must have resided within the Fort Collins Growth Management Area for at least one year prior
to their appointment. In order to avoid a negative impact on currently seated members, these
changes were applied only to individuals appointed, or reappointed, after August 1, 2002.
It was recently brought to staff’s attention that the language in Resolution 2002-062 was also
inadvertently applied to Council’s long-standing requirement that board and commission members
must reside within the Fort Collins Growth Management Area during their term of service. The
revisions made by Resolution 2004-055 will clarify that the only requirements that were intended
to apply to individuals appointed, or reappointed, after August 1, 2002, are the requirements that all
appointees must be registered voters (except those under 18 years of age) and must have resided
within the Fort Collins Growth Management Area for at least one year prior to their appointment.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
MAKING AN AMENDMENT TO THE BOARDS AND COMMISSIONS
MANUAL RELATING TO RESIDENCY REQUIREMENTS
WHEREAS, the City currently has several boards and commissions appointed by the City
Council; and
WHEREAS, the information pertaining to membership lists, descriptions of each board and
commission, meeting schedules, conflict of interest guidelines, appeal procedures, and general
information regarding membership limitations, attendance policies and other responsibilities of the
City’s boards and commissions is contained in a Boards and Commissions Manual (the “Manual”),
maintained by the City Clerk, which Manual was last adopted by the City Council by Resolution
2001-026; and
WHEREAS, Resolution 2001-026 requires that amendments to the Manual which constitute
policy changes shall be made only by the Council by resolution, except that changes that are
consistent with resolutions and ordinances adopted by the Council may be made administratively
by the City Clerk’s Office; and
WHEREAS, on June 4, 2002, Council adopted Resolution 2002-062 making amendments
to the Manual relating to the recruitment and appointment process for boards and commissions; and
WHEREAS, in order to avoid making changes that negatively impacted currently seated
members of the boards and commissions, Resolution 2002-062 included language to be inserted in
the membership limitations section of the Manual stating that certain requirements should apply only
to individuals appointed, or reappointed, after August 1, 2002; and
WHEREAS, said language was inadvertently applied to Council’s long-standing requirement
that board and commission members must reside within the Fort Collins Growth Management Area
during their term of service; and
WHEREAS, the Council wishes to clarify that the only requirements that were intended to
apply to those individuals appointed, or reappointed, after August 1, 2002, are the requirements that
the appointees must be registered voters (except those under 18 years of age) and must have resided
within the Fort Collins Growth Management Area for at least one year prior to their appointment.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the provisions relating to Membership Limitations, as contained on page
6 in the Boards and Commissions Manual dated January 2004, are hereby amended to read as
follows:
Membership Limitations
The following limitations and requirements are applied to board or commission
membership:
No person may serve on any one board or commission for more than eight (8)
consecutive years (two complete terms). For the purpose of this provision, a “term”
shall include the balance of an unexpired term served by a person appointed to fill
a vacancy if such unexpired term exceeds 24 months.
No person will be appointed by the City Council to serve concurrently on more than
one board or commission. This limitation does not apply to committees deemed to
be temporary in nature.
All persons appointed, to, or serving on, or reappointed, to any board or commission
after August 1, 2002, shall be registered voters (except those under 18 years of age)
and shall have resided within the Fort Collins Growth Management Area for at least
one year. Any member serving on a board or commission who relocates outside of
the Growth Management Area during his or her term of service on a board or
commission, regardless of his or her date of appointment or reappointment, shall
resign his or her membership. These requirements shall apply to all individuals
appointed, or reappointed, after August 1, 2002 and These limitations shall not apply
to applicants for or members of the General Employees Retirement Committee.
Section 2. That any individual who is currently serving on a board or commission and
who is currently residing outside of the Fort Collins Growth Management Area shall immediately
resign his or her membership.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this
20th day of April, A.D. 2004.
