FORT COLLINS CITY COUNCIL STAFF: Randy Hensley SUBJECT: First Reading of Ordinance No. 145, 1999.Appropriating Federal Grant Revenue and Authorizing the Transfer of Appropriations Between Projects in the Transportation Services Fund for the Operation of the North Front Range Transportation& Air Quality Planning Council's 1999-2000 Metropolitan Planning Organization Administration Program Year. I RECOMMENDATION: I i Staff recommends adoption of the Ordinance on First Reading. fFINANCIAL IMPACT: This item appropriates $618,824 in the Transportation Services Fund,representing the 1999-2000 fiscal year budget for the administration of the North Front Range Transportation & Air Quality !I Planning Council, also known as the Metropolitan Planning Organization (MPO). The following funding sources have been identified: 1999-2000 Federal Fiscal Year Funds Administered by CDOT $410,820 1 Local Match from MPO Member Entities 83,004 Unexpended, Unencumbered Funds from the 1998-1999 MPO Program 125.000 $618.824 g Because it is a federal grant project, the appropriation will be "non-lapsing", so it will be carried forward to 2000. EXECUTIVE SUMMARY: The North Front Range Transportation & Air Quality Planning Council (NFRT&AQPC) is the regional Metropolitan Planning Organization. The administration/program budget for the NFRT&AQPC is funded with federal transportation program dollars administered by the Colorado Department of Transportation (CDOT)based on the federal fiscal and program year of October 1, 1999 to September 30, 2000. This period does not correspond to the City's calendar year appropriation time frame,and this time differential causes some accounting and budget management a problems. The Council's approval of this Ordinance will enable staff to more consistently manage and track the NFRT&AQPC's budget and expenditures. The proposed budget and appropriation for the 1999-2000 program year is $618,824 for administration of the NRFT&AQPC. BACKGROUND: The City of Fort Collins currently performs the administrative duties,including fiscal management, . for the NFRT&AQPC. Over the past several years. the NRFT&AQPC's budget has been funded on the federal fiscal year of October through September while the City's financial system is based on the calendar year. This has resulted in difficulties in keeping fund statements balanced, and managing the finances for the program in the most effective manner. Beginning in 1998 with j DATE: September 7, 1999 2 ITEM NUMBER: 17 Ordinance 98-184, the funding for the NFRT&AQPC was appropriated in an ordinance that was separate from the City's normal budget ordinance in order to provide funding availability that corresponds with the federal fiscal year(October 1 through September 30.) The result was better fiscal management and improved accountability for the finances of the NFRT&AQPC. This ordinance will accomplish for the budget year 1999-2000 what Ordinance 98-184 accomplished for the budget year 1998-1999. By adopting this Ordinance, Council will appropriate the NFRT&AQPC's expenditures to be spent and revenues collected within a program year based upon the federal fiscal year 1999-2000. The City's share of the local match to be expended in connection with the federal funds is part of the 2000-2001 biennial budget. City Council will appropriate the 2000 budget in November 1999. ORDINANCE NO. 145, 1999 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING FEDERAL GRANT REVENUE AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN PROJECTS IN THE TRANSPORTATION SERVICES FUND FOR THE OPERATION OF THE NORTH FRONT RANGE TRANSPORTATION & AIR QUALITY PLANNING COUNCIL'S 1999-2000 METROPOLITAN PLANNING ORGANIZATION ADMINISTRATION PROGRAM YEAR WHEREAS,the North Front Range Transportation & Air Quality Planning Council is the Metropolitan Planning Organization(MPO)and lead air quality planning agency for the North Front Range region; and WHEREAS,voting members of the MPO include Fort Collins, Greeley, Loveland, Evans, Timnath, Windsor, Berthoud, LaSalle, Garden City, Latimer County, Weld County, the State of Colorado Transportation Commission,and the State of Colorado Air Quality Control Commission; and WHEREAS,the funds for the administration of the MPO program are federal transportation program funds appropriated by the federal government and administered by the Colorado Department of Transportation (CDOT), based on the federal fiscal year of October I through September 30; and WHEREAS,under the terms of an Intergovernmental Agreement between the City and the MPO, entitled Intergovernmental Agreement for the Provision of Services of Executive Director, dated July 6, 1998, the City provides an executive director and the administrative services to the MPO,including accounting and financial services,and,accordingly,manages federal grant revenue and matching funds received on behalf of the MPO; and WHEREAS,on behalf of the MPO,the City will receive in MPO program year 1999-2000, federal grant revenue from various federal transportation programs totaling $410,820 which,along with required matching funds from MPO member entities totaling$83,004,will be used to provide coordinated. comprehensive and cooperative transportation and air quality planning services in the North Front Range region; and WHEREAS, the City of Fort Collins' share for supporting the 1999-2000 MPO program, totaling $7.176,is included in the City's 2000-2001 Biennial Budget; and WHEREAS,Article V,Section 11.of the Charter of the City of Fort Collins(the "Charter") provides that appropriations for a federal grant shall not lapse if unexpended at the end of the fiscal year until the expiration of the federal grant; and WHEREAS, CDOT will permit unexpended funds remaining in the 1998-1999 MPO program in the amount of$125.000 to be reallocated and used for the 1999-2000 MPO year; and WHEREAS, Article V, Section 9, of the Charter permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year, does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V,Section 10,of the Charter authorized the City Council to transfer by ordinance any unexpended and unencumbered amount of portion thereof from one fund or capital project to another fund or capital project provided that the purpose for which the funds were initially appropriated remains unchanged; and WHEREAS, City staff has determined that the appropriation of federal grant revenues administered through CDOT and unanticipated local matching shares from MPO member entities will not cause total appropriations to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from federal grant revenue in the Transportation Services Fund, 1999-2000 Metropolitan Planning Organization program,the sum of four hundred ten thousand,eight hundred and twenty dollars($410,820)upon receipt from federal fiscal year 1999-2000 funds administered through the CDOT, to be used for the 1999-2000 MPO program year. Section 2. That there is hereby appropriated from federal grant program revenue in the Transportation Services Fund, 1999-2000 MPO program, the sum of eighty-three thousand four dollars ($83,004), upon receipt from MPO member entities local shares, to be used for the 1999- 2000 MPO program year. Section 3. That the unexpended and unencumbered amount of one hundred twenty-five thousand dollars ($125,000) is hereby authorized for transfer from the 1998-1999 MPO grant program to the 1999-2000 MPO grant program, upon the effective date of this Ordinance.
