Items Relating to Utility Rates for 2000.
RECOMMENDATION: II
Staff, the Water Board and the Electric Board recommend adoption of the Ordinances on First E
Reading.
FINANCIAL IMPACT:
These ordinances increase annual Water Fund operating revenues by an estimated 6% and
Wastewater Fund operating revenues by 2%. Payments in lieu of taxes paid to the General Fund by
Water and Wastewater will also increase by like percentages. Storm Drainage Fund operating
revenues will increase 10%. Light and Power Fund revenues will not change significantly.
Approval of the ordinances will ensure that the Water, Wastewater and Storm Drainage Funds will
all meet or exceed debt service coverage requirements.

These five ordinances increase the City's utility rates for water by an average of 6%,wastewater by
2% and stotmwater by 10%. The rate increase for water varies by customer class based on the
Utilities' cost of service study. There is no monthly rate increase for electric customers; however,
the charge for initiating a new service will increase. The Water and Electric Boards have reviewed
the rate changes in conjunction with their discussions on the recommended 2000-2001 budget. The
table below shows the rate impacts on a typical single family residential customer's monthly bill.

The cost of cash in lieu of raw-water rights and the surcharge for commercial accounts using water
in excess of the applicable annual allotment will increase approximately 30%to reflect the current
market for raw-water purchases.The Water Board reviewed and recommended the approval of this
increase in the cash in lieu of water rights rate.
All changes will become effective January 1,2000.
BACKGROUND:
Water
If approved by Council,water rates will increase an average of 6%. The increase is necessary to pay
debt service for the Water Treatment Facility Master Plan and to fund the operations and
maintenance of the City's water system. The rate increase will not be the same for all customer
classes. The proposed increase for each rate class is determined by the Utilities' cost of service
study. Staff produced the cost of service study. John Gallagher,P.E.,a utility consultant with Black
and Veatch,reviewed the methodology and results of the study. Based on this cost of service study,
it is recommended that the commercial water rates increase 9.15%and residential rates(metered and
non-metered) increase 5.44%. The above increases are only for those customers inside the City
limits. The customers outside the city limits currently pay higher rates than inside rates. In
accordance with Council policy,they will remain frozen until the water rates inside and outside the
City limits are the same. It is anticipated that future water rates will increase an average of 6%per
year for the next 5 years. This Ordinance also eliminates the special rate for Colorado State
University's water accounts. In order to simplify rate administration, each CSU account will be
served under the applicable non-residential rate schedule. The fire hydrant fees and charges are also
being increased to more accurately reflect the cost of providing this service.

Wastewater
This ordinance will increase wastewater rates 2%for all customer classes in 2000. The increase is
needed to fund the operations and maintenance of the City's wastewater system and to finance capital
improvements. Current projections indicate that another 2% increase in wastewater rates will be
needed in 2001 and that an annual 4%increase will be necessary in the years 2002-2004. The Utility
will conduct a cost of service study to determine the distribution by rate class of future increases.
Except for wastewater strength surcharges, the wastewater rates will increase for only those
customers inside the city limits. The customers outside the City limits currently pay higher rates
than inside rates. In accordance with Council policy, they remain frozen (except for wastewater
strength surcharges) until the wastewater rates inside and outside the City limits are the same.
Electric
There is no increase proposed for the monthly electric rates in 2000, however, a 2% increase is
projected for 2001. Administrative"housekeeping"changes are being proposed for the electric rates.
Several of the changes are needed in order to accommodate the implementation of the new Banner
Customer Service System in 2000. These changes include:
• Delete the interim rates GS50X and GS50TX from the Code. These interim
large commercial rates were only valid through March 31, 1998 at which
time they were replaced by the coincident peak rate GS50.
• Add a new rate for the smaller wattage floodlight as requested by our
customers. The 70-watt high-pressure sodium light is smaller than other
floodlights offered by the Utility. The rate will be $5.78 per month.
• Revise the customer of record for the water heater control rebate (Hot Shot)
from the specific date of March 15th to the "March billing cycle" in order to
reflect new business practices required for Banner. Specify that the rebate is
made as a credit on the utility bill.
• Revise the small commercial (General Service) seasonal rate to permit a
utility bill to be issued during an off-season month. This is necessary for
timely collection of on-season energy usage. The seasonal rate is used
mainly for irrigation purposes.
• Delete the time of demand(TOD)rates for residential and small commercial
customers.Although the Utility has offered TOD rates for small commercial
and residential customers since the 1970's,few customers have selected these
rates. At this time there are only two residential customers on the TOD rate.
These two customers save an average of$7 or 1%per year on the rate. Since
the cost to modify Banner to accommodate the TOD rate offering is
prohibitive,the Utility recommends that the TOD rates be eliminated.
• Increase the service charge for initiating a request for electric service from
$10.65 to $14.59. The increase is based on the Utilities cost to provide this
service to new or relocating residential and small commercial customers. The
service charge is 8% less than it was in 1993, when the charge was $15.87.

Stormwater
The proposed ordinance increases stormwater fees by 10%. The increase is necessary to fund the
operations and maintenance of the City's stormwater system and to pay debt service for the
accelerated capital improvements program. Since both the O&M and capital improvement monthly
fees are no longer basin-specific,they have been combined into a single fee amount. Current budget
projections indicate that another 8%increase in stormwater rates will be needed in 2001 and that a
6% increase per year will be necessary in the years 2002-2004.
Cash in Lieu of Raw-Water Requirements
The proposed ordinance will increase the cash rate charged developers for satisfaction of raw-water
requirements from $2,700 to $3,500 per acre-foot. The cash rate,which is adjusted periodically to
reflect the current price of raw-water, is also the basis for a surcharge paid by nonresidential
customers for water used in excess of their annual allotment.
Developers have the option of turning in water rights or cash when satisfying the City's raw-water
requirements. Over the last several years, about 20%to 30% of the raw-water requirements have
been satisfied with cash. The"cash in lieu of water rights" rate is periodically adjusted to reflect the
market price of water rights in this area. The price of Colorado-Big Thompson (CBT) units has
historically been used to set this rate,as there is enough market activity to establish the going price.
The price of CBT water has increased significantly during the last two years,from about$2,800 per
acre-foot unit to over$5,000 per unit. The rapid increase in price appears to be because of numerous
CBT water purchases by many communities in the Northern Colorado Water Conservancy District.
Other cities and water districts in this area presently have cash rates ranging from approximately
$4,000 to $6,000 per acre-foot.
With the significant increases in the price of CBT water,local developers are turning more and more
to the local irrigation companies,such as North Poudre Irrigation Company and the southside ditch
companies, or paying cash in lieu of water rights to satisfy the City's raw-water requirements.
Because of this, it is appropriate to consider more than just the price of CBT water when adjusting
the cash-in-lieu rate. Taking into consideration the wide range of prices among available sources
of water,the staff and Water Board believe that a reasonable cash-in-lieu rate would be $3,500 per
acre-foot.
The City Code provides that nonresidential customers pay a surcharge on water used in excess of
their annual allotment. As this charge is based on the cash-in-lieu rate, it also needs to be increased
from $1.27 to $1.65 per one thousand gallons.
The Water Board at its August 26. 1999 meeting endorsed the proposed increases. The new rates
will go into effect for all building permits or billings issued on or after January 1, 2000.

Section 1. That Section 26-126 ofthe Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-126. Schedule A,flat rates for unmetered water use.
When the use of city water is not metered,the monthly rate to be charged for each
flat rate water service shall be the sum of the total charge for the dwelling units (A)
plus the lot charge (B):

the city limits shall be as follows:
(1) Residential customers. Residential customers shall pay a minimum
monthly charge of thirteen
dollars and eight cents ($13.08) for the first dwelling unit. Duplex
residential customers shall pay an additional four dollars and fb� two

(3) Construction rate. For residential premises under construction (single
family and duplex), seven dollars and aeforty-two cents($7.99)',($7.42)

Section 1. That Section 26-464,paragraphs (f) and (g). of the Code of the City of Fort
Collins are hereby amended to read as follows:
Sec. 26-464. Residential energy service,schedule R.
(f) Service charge. There shall be a service charge of ten fourteen dollars and
sixty-€ive fifty-nine cents($19.6314.59)for the processing of a request for electrical
service under this schedule except where the request is made for after-hours service,
in which case the service charge shall be forty dollars and sixty-four cents($40.64).
The service charge is further applicable for a special meter reading and/or fractional
period billing.
(g) Water heater control rebate. Upon customer application,-controlled water
heater service will be provided to uncontrolled, all-electric and solely residential
• water heaters with single-element capacity of three and one-half (3'/2) or more
kilowatts whereby the utility may interrupt electric power to the water heaters by
remote control at times of electrical system emergencies and periods of anticipated
peak load. Customers of record with active accounts under which service is received
on ,.;ea1 during theMarch billing cycle who do not it&ve delinquent aeeaunts
and whose household has received controlled water
heater service for the preceding six(6)months pursuant to contract with the city will
be-paid-receive-an annual credit on their utility bill rebate of fifty dollars ($50.)per

operated and maintained by the utility.If the customer's water heater system utilizes
an alternative supplementary heat source, such customer will be paid receive an
annual credit on their utility bill rebate of twenty-five dollars ($25.) per contract,
subject to the above conditions. Customers who discontinue or terminate this service
or who choose not to extend service initiated for the service address by a preceding
customer are not eligible to reapply for such service at the same address until after
the passage of twelve (12) months from the date on which such discontinuance or
termination was effective. This service is not available to customers with load-
limiting devices installed within their electrical systems. Installation of such load-
limiting devices subsequent to initiation of this service voids the rebate provisions.
The utility or the applicant may discontinue this service at any time upon ten (10)
days'written notice.This service is subject to the availability of suitable load-control
equipment and radio transmission frequencies.

Collins are hereby amended to read as follows:

Section 3. That Section 26-466, Residential time-of-demand, schedule RT, is hereby
repealed in its entirety.
Section 4. That Section 26-467 is hereby renumbered as Section 26-466,and paragraphs
(g) and (n) amended to read as follows:
Sec. 26-46-466. General service, schedule GS.
(g) Service charge. There shall be a service charge of ten fourteen dollars and
sixty-five fifty-nine cents($10.6514.59)for the processing of a request for electrical
service under this schedule except where the request is made for after-hours service,
in which case the service charge shall be forty dollars and sixty-four cents($40.64).
The service charge is further applicable for a special meter reading and/or fractional
period billing.
(n) Seasonal rate provision. Where service is provided under this schedule for
seasonal irrigation pumping,the monthly fixed charge, excess capacity charge and
billing demand provisions of this schedule shall not apply during the months of
October through March, Upon approval
of the utility, this provision may apply to other loads with similar characteristics.
Section 5. That Section 26-468, General service time-of-demand, schedule GST, is
hereby repealed in its entirety.
Section 6. That Section 26-469, General service 50, schedule GS50, is hereby
• renumbered as Section 26-467.
Section 7. That Section 26-470.General service 50X,schedule GS50X,and Section 26-

AMENDING CHAPTER 26, ARTICLE VII, DIVISION 2 OF
THE CODE OF THE CITY RELATING TO STORMWATER FEES
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows:
Section 1. That Section 26-514 of the Code of the City of Fort Collins is hereby amended
to read as follows:
Sec. 26-514. Determination of stormwater utility fee.
The stormwater utility fee shall be based upon the area of each lot or parcel of land;
and the runoff coefficient of the lot or parcel and the stermw ._-b"in in_high the!at
or . For:the purposes of this section,the total lot or parcel area shall
include both the actual square,footage of the lot or parcel and the square footage of
open space and common areas allocated to such lot as provided in paragraph(4)of-this
section. The stormwater utility fee shall
recover the
costs-of both operations and maintenance and a portion ofcapital improvements. The
Director shall determine the rates that shall apply to each specific lot or parcel of land
within the guidelines herein set forth and shall establish the utility fee in accordance
with the rate together with the other factors set forth as follows:
(1) Runoff coefficient.
a. Each lot or parcel of land shall be placed in one (1) of five (5) specific
categories hereinafter referred to as basic categories of development,based
upon the land use characteristics for the lot or parcel. The runoff
coefficient as used in the engineering formula known as the rational
method shall be used as the basis for assigning rate factors for basic
categories of development as follows:

Section 1. That Section 26-129(c)(1)and(2)of the Code of the City of Fort Collins be,
and the same hereby are, amended to read as follows:
(c) The fees and requirements for raw water shall be as follows:
(1) To satisfy raw water requirements with in-lieu cash payments, the rate per
acre-foot ofRWRistwents--seveathirty-five hundred dollars($2-,?.993,500.).
(2) The surcharge for water used in excess of applicable annual allotment shall
be one dollar and ewenty-seven sixty-five cents ($1.?765)per one thousand
(1,000) gallons.
Section 2. The amendments recited herein shall become effective for all permits and
