SUBJECT:
Resolution 99-131 Authorizing the Mayor to Enter into an Intergovernmental Agreement with the
Colorado Department of Transportation,Division of Transportation Development,for the Provision
of Public Transportation Services in Non-Urbanized Areas.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
FINANCIAL IMPACT: The Colorado Department of Transportation grants provide operating/administrationfunding
for Dial-A-Ride paratransit services in the non-urbanized area,and operating/administration funding for FoxTrot bus services.

The local share will be provided by the City of Loveland.
EXECUTIVE SUMMARY:
These grant funds will be used to administer the 5311 and 5310 state grant for Specialized
Transportation, and operate FoxTrot and Dial-A-Ride in non-urbanized areas.
BACKGROUND:
This item will provide operating, capital, and administrative assistance funding to Estes Park,
Berthoud Area Transportation (BATS), Senior Alternative in Transportation (SAINT), Loveland,
Larimer County and the City of Fort Collins, (rural Dial-A-Ride and FoxTrot).
Transfort staff has administered this grant for eighteen months; it was previously administered by
Larimer County. The grant program is funded for the next year and includes money to cover
administration expenses.

Notification has been received from Larimer County that they will no longer support rural Dial-A-
Ride and Foxtrot beginning in the year 2000. The City will continue to receive funds for rural Dial-
A-Ride thru June 30, 2000 when the existing contract expires. The Intergovernmental Agreement
for Foxtrot Services expires on December 31, 1999.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN
INTERGOVERNMENTAL AGREEMENT WITH THE COLORADO DEPARTMENT OF
TRANSPORTATION, DIVISION OF TRANSPORTATION DEVELOPMENT,
FOR THE PROVISION OF PUBLIC TRANSPORTATION SERVICES IN
NON-URBANIZED AREAS
WHEREAS, the City of Fort Collins, Colorado (the "City") has the power to enter into
intergovernmental agreements with the State of Colorado under Article II,Section 16 of the Charter
of the City; and
WHEREAS, the State of Colorado, Department of Transportation, Division of
Transportation Development(the"State"),has obtained certain unencumbered federal funds for the
provision of transportation services in nonurbanized areas; and
WHEREAS,the State is responsible for the disbursement of said funds; and
WHEREAS,the City is desirous of obtaining said funds for the provision of transportation
services, and has filed an application with the State for this purpose; and
WHEREAS,the State has proposed an intergovernmental agreement with the City to provide
funds for such services; and
WHEREAS,the City desires to accept the funds for such services pursuant to the conditions
of the agreement; and
WHEREAS, the City desires to work together with the State to effect said services as
provided in the agreement.
NOW, THEREFORE, BE IT RESOLVED BY COUNCIL OF THE CITY OF FORT
COLLINS, COLORADO as follows:
Section 1. That the Mayor be,and hereby is,authorized to enter into an agreement with
the State of Colorado Department of Transportation, Division of Transportation Development for
the provision of public transportation services in nonurbanized areas,which agreement shall include
the following terms,and such other terms not inconsistent with the following as the City Manager,
in consultation with the City Attorney, may deem necessary to protect the interests of the City:
a. The State will provide Federal Transit Act, Section 5311 Grant funding for
operating non-urbanized transit service in Estes Park, Loveland, Berthoud,
Larimer County,and Fort Collins,with the federal portion of the Grant in the
• amount of$146,800 and the local share in the amount of$135,486;
b. The State will provide Federal Transit Act, Section 5310 Grant funding for
capital improvements for non-urbanized transit service in Estes Park,
Loveland, Berthoud, Larimer County, and Fort Collins, with the federal
portion of the Grant in the amount of$42,000 and the local share in the
amount of$10,500;
C. The City will provide contract administration for the Federal Transit Act
Section 5310 and 5311 Grant programs in accordance with terms of the
agreement.
Passed and adopted at a regular meeting of the City Council of the City of Fort Collins held
this 2nd day of November, A.D. 1999.
