RECOMMENDATION Staff recommends adoption of the Resolution. FINANCIAL IMPACT The lease will generate approximately $10,000 of income annually. There are no City expenses associated with the start up of this lease. EXECUTIVE SUMMARY Enterprise Leasing Company of Denver wishes to lease space in the airport terminal building as a rental car outlet to service the traveling public. The Agreement is for up to a two year period beginning September 1,2004. The leased area includes 133 square feet of counter area and parking spaces for staging rental cars. In addition to the $15.00 per square foot rental rate for the counter area the Agreement requires an additional payment of 10% of gross rental income, and a $50 per month payment for each of 4 parking spaces. The Agreement will provide a new revenue source for the airport and provide increased services to the public. A copy of the Agreement is on file with the City Clerk's Office. RESOLUTION 2004-097 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO EXECUTE A CAR RENTAL CONCESSION AGREEMENT AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT WITH ENTERPRISE LEASING COMPANY OF DENVER WHEREAS, the Cities of Fort Collins and Loveland (the "Cities")jointly own and operate the Fort Collins-Loveland Municipal Airport(the"Airport"),including the Terminal located on said Airport; and WHEREAS, pursuant to Section 23-114(a) of the Code of the City of Fort Collins (the "Code"), the Council is authorized to lease any and all interests in real property owned in the name of the City, provided that Council first finds that the lease is in the best interests of the City; and WHEREAS, Section 23-114(b) of the Code defines a lease as a contract by which the City grants to another the right to possess,use and enjoy any real property owned by the City for ten(10) days or longer, in exchange for the payment of rent in a stipulated amount; and WHEREAS, the Intergovernmental Agreement for the Joint Operation of the Fort Collins- Loveland Municipal Airport between the Cities specifically recognizes the leasing of Airport Property as a valid use of the jointly owned Airport Property; and WHEREAS, Enterprise Leasing Company of Denver has indicated a desire to enter into a concession agreement that would allow it the use of a portion of the Terminal,consisting of a sales counter and area of approximately 133 square feet, and a portion of the Terminal parking lot, for a period of up to two years, in order to conduct the business of renting motor vehicles at the Airport. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, COLORADO as follows: Section 1. That it is in the best interests of the City to execute a concession agreement with Enterprise Leasing Company of Denver pursuant to the terms of the Car Rental Concession Agreement, a copy of which is on file in the Office of the City Clerk,for that portion of the Airport premises described herein. Section 2. That the City Manager is hereby authorized to execute said Car Rental Concession Agreement, subject to such modifications in form or substance as the City Manager,in consultation with the City Attorney, may deem necessary to effectuate the purposes of this Resolution or to protect the interests of the City. Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 17th day of August, A.D. 2004.
