RECOMMENDATION: Staff recommends adoption of the Resolution and of the Ordinance on First Reading. EXECUTIVE SUMMARY: A. Resolution 2000-98 Authorizing the City Manager to Enter into an Agreement with the Burlington Northern Santa Fe Railway Company for Upgrading the Crossing Material at the Trilby Road/Burlington Northern Santa Fe Railroad Crossing Located East of Shields Street. B. First Reading of Ordinance No. 99, 2000, Appropriating Unanticipated Revenue in the Capital Projects Fund Minor Streets Capital Project to be Used for Upgrading the Railroad Crossing Material at the Trilby Road/Burlington Northern Santa Fe Railroad Crossing Located East of Shields Street. As part of the requirements for off-site street improvements required of the Registry Ridge P.U.D. development project, the Developer is required to pay for 100% of the cost to upgrade the crossing material at the Trilby Road/Burlington Northern Santa Fe Railroad (BNSFRR) crossing located east of Shields Street. To pay for the improvements, the Developer has deposited $40,000 with the City to cover the cost. The estimated cost for the improvements estimated by the BNSFRR, is $35,040. Any funds remaining will be returned to the Developer. The installation of the crossing material will be done by the BNSFRR. The funds received from the Developer will be used to reimburse the BNSFRR for its work. The funds will be appropriated in the Minor Streets Capital account for tracking purposes. The work, not yet scheduled, will likely be completed next spring. . ., ,... _ . . RESOLUTION 2000-98 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE BURLINGTON NORTHERN SANTA FE RAILWAY COMPANY FOR UPGRADING THE CROSSING MATERIAL AT THE TRILBY ROAD/ SANTA FE RAILROAD CROSSING LOCATED EAST OF SHIELDS STREET WHEREAS, there exists a crossing of Trilby Road and the Burlington Northern Santa Fe Railroad in the City east of Shields Street; and WHEREAS,one of the requirements for off-site street improvements for the Registry Ridge P.U.D. development project is that the Developer must pay for 100% of the cost to upgrade the railroad crossing material at the Trilby Road/Burlington Northern Santa Fe Railroad crossing,located east of Shields Street(the 'Project"); and WHEREAS, the estimated cost of the Project is thirty-five thousand and forty dollars ($35,040); and WHEREAS,to pay for the improvements,the Developer has deposited forty thousand dollars ($40,000) with the City to cover the cost; and WHEREAS, any funds remaining once the Project is completed will be returned to the Developer; and WHEREAS, the funds received by the Developer will be used to reimburse the Burlington Northern Santa Fe Railway Company for its work done to upgrade the crossing material; and WHEREAS,the Council has determined that it is in the best interests of the City that the City Manager enter into an agreement with the Burlington Northern Santa Fe Railway Company for the upgrading of the crossing material at the aforesaid intersection of Trilby Road and the Burlington Northern Santa Fe Railroad. Mayor ATTEST: City Clerk • OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE CAPITAL PROJECTS FUND MINOR STREETS CAPITAL PROJECT TO BE USED FOR UPGRADING THE RAILROAD CROSSING MATERIAL AT THE TRILBY ROADBURLINGTON NORTHERN SANTA FE RAILROAD CROSSING LOCATED EAST OF SHIELDS STREET WHEREAS,Article V,Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,the City Council adopted Resolution 2000-98,on August 15,2000,authorizing the City to enter into a contract with the Burlington Northern Santa Fe Railway Company for upgrading the crossing material at the Trilby Road/Burlington Northern Santa Fe Railroad crossing located east of Shields Street(the "Project'); and WHEREAS, the estimated cost of the Project is thirty-five thousand and forty dollars ($35,040); and . WHEREAS,one of the requirements for off-site street improvements for the Registry Ridge P.U.D. development project is that the Developer must pay for 100% of the cost to upgrade the railroad crossing material at the Trilby Road/Burlington Northern Santa Fe Railroad crossing,located east of Shields Street; and WHEREAS,to pay for the improvements,the Developer has deposited forty thousand dollars ($40,000) with the City to cover the cost; and WHEREAS, any funds remaining once the project is completed will be returned to the Developer; and WHEREAS, the funds received by the Developer will be used to reimburse the Burlington Northern Santa Fe Railway Company for its work done to upgrade the crossing material; and WHEREAS,it is the desire of the Council to appropriate the sum of$40,000 in unanticipated revenue in the Capital Projects Fund Minor Street Capital project to be used to upgrade the railroad crossing material at the Trilby Road/Burlington Northern Santa Fe Railroad crossing located east of Shields Street. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF"'?-IE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund Minor Street Capital Project,the sum of FORTY THOUSAND DOLLARS ($40,000),from Developer deposited funds,to be used for upgrading the railroad crossing material at the Trilby Road/Burlington Northern Santa Fe Railroad crossing located east of Shields Street. Introduced and considered favorably on first reading and ordered published this 15th day of August, A.D. 2000, and to be presented for final passage on the 5th day of September, A.D. 2000.
