SUBJECT
Resolution 2004-032 Authorizing the Airport Manager to Execute a Lease Agreement at the Fort
Collins-Loveland Municipal Airport with Zane and Rosalie Iverson, DBA, the Peaks Cafd.
RECOMMENDATION
Staff recommends adoption of the Resolution.
FINANCIAL IMPACT
The lease will generate$3,360 annually from lease income. There are no City expenses associated
with this lease.
EXECUTIVE SUMMARY
The Peaks Cafd wishes to lease 244 square feet of space in the airport terminal building to provide
food services to the general public. Primary customers will be passengers flying into and out of the
airport on Allegiant Air. The Agreement is for an initial one-year period with a one-year extension.
The lease rate is fixed for the first year at $3,360 payable in 12monthly installments of$280. The
lease rate will be renegotiated prior to the start of the second year. The lease rate is commensurate
with terminal building rental rates established for other tenants.
The Agreement will provide a new revenue source for the Airport and provide a valuable service
to the public. The Peaks Caf6 is an established Loveland business and will operate this facility in
conjunction with its existing location.
RESOLUTION 2004-032
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE AIRPORT MANAGER TO EXECUTE A LEASE
AGREEMENT AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT
WITH ZANE AND ROSALIE IVERSON, dba, THE PEAKS CAFE
WHEREAS,the Cities of Fort Collins and Loveland(the "Cities")jointly own and operate the
Fort Collins-Loveland Municipal Airport (the "Airport"), including the Terminal located on said
Airport; and
WHEREAS,pursuant to Section 23-114(a)of the Code of the City of Fort Collins,the Council
is authorized to lease,for a term of two years or less,any and all interests in real property owned in the
name of the City,provided that Council first finds that the lease is in the best interests of the City; and
WHEREAS, the Intergovernmental Agreement for the Joint Operation of the Fort Collins-
Loveland Municipal Airport between the Cities specifically recognizes the leasing of Airport Property
as a valid use of the jointly owned Airport Property; and
WHEREAS, Zane and Rosalie Iverson, doing business as The Peaks Cafe, have indicated a
desire to enter into a lease agreement that would allow them the use of a portion of the Terminal
consisting of 244 square feet for the concession of food and beverages to the public making use of the
Terminal for a term of up to two years; and
WHEREAS, the provision of food and drink at the Terminal will be a benefit to the traveling
public making use of the Terminal and will provide a new revenue source to the Cities to aid them in
maintaining the Airport and the Terminal.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, COLORADO as follows:
Section 1. That it is in the best interests of the City to execute a lease agreement with Zane
and Rosalie Iverson, dba The Peaks Cafe, pursuant to the terms of the Lease Agreement, a copy of
which is on file in the office of the City Clerk, for that portion of the Airport premises described
therein.
Section 2. That the Airport Manager is hereby authorized to execute said Lease Agreement,
subject to such modifications in form or substance as the Airport Manager,in consultation with the City
Attorney, may deem necessary to effectuate the purposes of this Resolution or to protect the interests
of the City.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 2nd day
of March, A.D. 2004.
