RECOMMENDATION: iI Staff recommends adoption of the Resolution and of the Ordinance on First Reading. FINANCIAL IMPACT: The total cost of this project is $326,381 for year 2000. The City of Fort Collins will receive from CDOT $260,000 in Transportation Equity Act for the 21st Century (TEA-21) funds for the Timberline Road bikeway project. Transportation Services has the local matching funds required for 2000 of$63,383 identified in the current Transportation Planning budget. EXECUTIVE SUMMARY: A. Resolution 2000-10, Authorizing the Mayor to Execute an Intergovernmental Agreement dBetween the City and the Colorado Department of Transportation for the Timberline Road Bikeway Project. B. First Reading of Ordinance No. 8, 2000, Appropriating Unanticipated Revenue in the s Transportation Services Fund and Authorizing the Transfer of Appropriations to be Used for the Design and Construction of the Timberline Road Bikeway Project. The contract between the City and CDOT will allow work to proceed to prepare preliminary design plans and final engineering documents, as well as complete construction of the Timberline Road bikeway project. The scope of this project will include design and construction of bikelanes along Timberline Road from Willow Springs Way/County Road 36 south to Trilby. S 1 O f DATE: January 18, 2000 2 ITEM NUMBER: 12 A-B BACKGROUND: Timberline Road south ofHarmony to Trilby Road was identified by the City ofFort Collins Bicycle Program Plan (1995) has a high priority for improvements. The northern portion of the bikelane improvements along this section of Timberline (from Harmony south to Willow Springs) was completed last year via the City's Street Oversizing fund as part of the development-related improvements in this area. TEA-21 funds are now available to the City from CDOT in order to complete the southern portion of the bikelane improvements along this corridor (from Willow Springs to Trilby). This is a much needed safety improvement due to the current lack of roadway shoulders and the heavy bicycle (and vehicular)traffic along this segment of Timberline. Once this segment of bikelanes is complete, there will be a continuous bikelane system on Timberline Road/County Road 11 from the north end of Loveland to International Boulevard on the northern side of Fort Collins. This continuous link in the Fort Collins' bikeway system provides a safer and more direct travel route for local and regional cyclists and is an important accomplishment toward the implementation of the City's Bicycle Plan. RESOLUTION 2000-10 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY AND THE COLORADO DEPARTMENT OF TRANSPORTATION FOR THE TIMBERLINE ROAD BIKEWAY PROJECT WHEREAS,Timberline Road,between Harmony Road and Trilby Road,was identified as a high priority for improvements in the City's Bicycle Program Plan adopted in 1995; and WHEREAS,the northern portion of the lane improvements along said section of Timberline Road was completed from Harmony Road to Willow Springs in 1999; and WHEREAS, Transportation Equity Act for the 21st Century ("TEA-21") funds are now available to the City from the Colorado Department of Transportation("CDOT")for the purpose of completing the southern portion of the bikelane improvements along Timberline Road from Willow Springs to Trilby Road; and WHEREAS,the City Council has determined that said improvements are in the best interests of the City in the protection of the public health and safety due to the current lack of roadway shoulders and the extensive usage of said roadway for both bicycle and vehicular traffic; and WHEREAS,the completion of said segment of Timberline Road bikelanes will result in a continuous bikelane system on Timberline Road from the north end of Loveland to International Boulevard, which continuous link will provide a safer and more direct travel route for local and regional cyclists and will serve as an important accomplishment toward the implementation of the City's Bicycle Program Plan; and WHEREAS, the Council has determined that it is in the best interests of the City that the Mayor execute an intergovernmental agreement with CDOT for the extension of said bicycle lanes utilizing TEA-21 funds in the amount of two hundred sixty thousand dollars ($260,000) and City participating funds in the amount of sixty-three thousand three hundred eighty-three dollars ($63,383),which City participating funds have been identified in the transportation planning budget. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be,and hereby is,authorized to execute an intergovernmental agreement between the City and the State of Colorado Department of Transportation for the addition of an eight-foot bicycle lane to both sides of the existing roadway on Timberline Road from County Road 36 south one mile to County Road 34 and as more specifically described in Exhibit"A"of the said intergovernmental agreement,for a total cost in the amount of THREE HUNDRED TWENTY SIX THOUSAND THREE HUNDRED EIGHTY-THREE DOLLARS($326,383)with federal TEA-21 funds to be expended toward said contract in the amount of TWO HUNDRED SIXTY THOUSAND DOLLARS ($260,000) and City participating funds to be expended toward said contract in the • amount of SIXTY-THREE THOUSAND THREE HUNDRED EIGHTY-THREE DOLLARS ($63,383) (with nonparticipating costs in the amount of$3,000). Passed and adopted at a regular meeting of the City Council held this 18th day of January, A.D. 2000. Mayor ATTEST: City Clerk i ORDINANCE NO. 8, 2000 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE TRANSPORTATION SERVICES FUND AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS TO BE USED FOR THE DESIGN AND CONSTRUCTION OF THE TIMBERLINE ROAD BIKEWAY PROJECT WHEREAS,Timberline Road south of Harmony Road to Trilby Road was identified in the City of Fort Collins Bicycle Program Plan (1995) as a high priority in terms of needed improvements; and WHEREAS, on April 20, 1999, the City Council adopted Ordinance No. 44, 1999, appropriating a total of one million one hundred nineteen thousand seven hundred eighteen dollars ($1,119,718),in the form of Street Oversizing Fees,developer contributions,and a contribution from the Fort Collins/Loveland Water District to be used for reconstruction of the roadway,curb,gutter, sidewalks, bikelanes, and installation of a new water main along the section of Timberline Road from Harmony Road, south to Willow Springs; and WHEREAS,bikelanes on Timberline Road were constructed as part of the aforementioned project from Harmony Road south to Willow Springs; and WHEREAS,the Colorado Department of Transportation(CDOT)has made available to the City of Fort Collins,Transportation Equity Act for the 21 st Century("TEA-21 Funds")funds in the amount of two hundred sixty thousand dollars ($260,000)to be used for preliminary design plans, final engineering documents, and construction of bikelanes along Timberline Road from Willow Springs Way, south to Trilby Road (the "Project'); and WHEREAS, the estimated cost of the Project is three hundred twenty-six thousand three hundred eighty-three dollars ($326,383); and WHEREAS, local matching funds needed for the Project, totaling sixty-six thousand three hundred eighty-three dollars ($66,383), have been identified from existing appropriations in the Transportation Services Fund; and WHEREAS,the City Council adopted Resolution 2000-10,on January 18,2000,authorizing the City to enter into an intergovernmental agreement with CDOT for the receipt of TEA-21 Funds to be used for the design and construction of bikelanes along Timberline Road from Willow Springs Way, south to Trilby Road; and WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins (the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with i all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, it is the desire of the Council to appropriate the sum of two hundred sixty thousand dollars($260,000)in Colorado Department of Transportation TEA-21 funds and authorize the transfer of sixty-three thousand three hundred eighty-three dollars ($66,383) in local matching funds in the Transportation Services Fund to be used for the design and construction of bikelanes along Timberline Road from Willow Springs Way, south to Trilby Road. NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Transportation Services Fund, Timberline Road from Willow Springs Way, south to Trilby Road project, the sum of TWO HUNDRED SIXTY THOUSAND DOLLARS ($260,000) from Colorado Department of Transportation TEA-21 funds,to be used for the design and construction of bikelanes along Timberline Road from Willow Springs Way, south to Trilby Road. Section 2. That the unexpended appropriated amount of SIXTY-SIX THOUSAND THREE HUNDRED EIGHTY-THREE DOLLARS($66,383)is hereby authorized for transfer from operations dollars in the Transportation Planning 2000 budget in the Transportation Services Fund to the Timberline Road from Willow Springs Way, south to Trilby Road project and appropriated therein to be used for the design and construction of bikelanes along Timberline Road from Willow Springs Way, south to Trilby Road.
