First Reading of Ordinance No. 26, 2000, Appropriating Prior Year Reserves in the General Fund
and Unanticipated Revenue in the Cultural Services and Facilities Fund for the Franz-Smith Cabin
Relocation Project.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.

:
In October of 1999,a small homestead cabin,the Franz-Smith Cabin,came to the attention of staff
at the Fort Collins Museum as a significant structure of Fort Collins' past that is in danger of being
lost. The circa 1882 Franz-Smith Cabin represents 70 years of agricultural tradition in the southern
communities of Fort Collins. The cabin stood adjacent to South Shields near Harmony Road until
it was displaced in 1987 with the development of a new subdivision at that location. The Larimer
County Historic Alliance (LCHA) relocated the cabin to Livermore in an attempt to save it from
demolition,but the LCHA's dream of an architectural park was never realized. The cabin currently
sits on blocks behind the Forks Restaurant on Colorado Department of Transportation(CDOT)land,
where it can no longer stay.
Museum staff, with the support of the Cultural Resources Board and the informal advisory group
of citizens with which Museum staff has consulted, determined the cabin would be an appropriate
addition to the Museum's Courtyard. To fund the move,the Don and May Wilkins Charitable Trust,
a local private estate trust,pledged $21,000 to the Museum, contingent upon the City's providing
or obtaining matching funds or in-kind contributions totaling $21,000. The Museum has met this
condition by raising matching funds as follows: $7,000 contributed by the Downtown Development
Authority; $7,000 from appropriated funds in the General Fund; and $7,000 in-kind from local
businesses and organizations. The donated funds have been received and placed in an interest
bearing account in the General Fund, and the interest earned since receipt is $370 for a total of
donated funds to be appropriated of$21,370.
The Museum is requesting City Council appropriate the $35,370 towards this relocation project.
Because $7,000 of the matching contribution will be from in-kind contributions,it is not necessary
to appropriate funds for that portion of the project.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE GENERAL FUND
AND UNANTICIPATED REVENUE IN THE CULTURAL SERVICES AND
FACILITIES FUND FOR THE FRANZ-SMITH CABIN RELOCATION PROJECT
WHEREAS in October of 1999 Fort Collins Museum staff learned of a small homestead
cabin, the Franz-Smith cabin, which currently sits on blocks behind the Forks Restaurant on
Colorado Department of Transportation(CDOT)land but must be removed from that location(the
"Franz-Smith Cabin"); and
WHEREAS,the Franz-Smith Cabin,which was originally located adjacent to Shields Street
near Harmony Road in around 1882 and was moved to its current location in 1987,is considered by
Museum staff-to be a significant structure of Fort Collins' past that is now in danger of being lost;
and
WHEREAS,the mission of the Fort Collins Museum is to engage and inspire its audiences
to explore the legacies of the peoples and environments of the Cache La Poudre River Valley; and
WHEREAS,the Franz-Smith Cabin serves as an icon of Fort Collins agricultural heritage
and will be preserved and protected for the education and enjoyment of today's,and future,citizens;
• and
WHEREAS,Museum staff,with the support of the Cultural Resources Board and interested
citizens,determined that the relocation of the Franz-Smith Cabin to the Museum's Courtyard would
offer a desirable means of protecting the cabin from being lost or destroyed; and
WHEREAS, in 1999,the City received a donation in the amount of$21,000 to support the
Franz-Smith Cabin Relocation Project from the Don and May Wilkins Charitable Trust, a local
private estate trust,and the donation has been received and placed in an interest bearing account in
the General Fund; and
WHEREAS, the interest earned on the donated funds of $21,000 is $370 for a total,
including the interest, of$21,370; and
WHEREAS,the donation was conditioned upon the City providing or obtaining matching
funds or in-kind contributions in the amount of$21,000,which have been identified in the form of
a $7,000 transfer from the Downtown Development Authority, a $7,000 transfer from existing
appropriations in the General Fund, and $7,000 in-kind, from local businesses and organizations;
and
WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter")
• permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS,Article V,Section 9,of the Charter also permits the City Council to appropriate
by ordinance at any time during the fiscal year such funds for expenditure as may be available from
reserves accumulated in prior years, notwithstanding that such reserves were not previously
appropriated; and
WHEREAS, it is the desire of the Council to appropriate the total amount of $35,370,
consisting of a donation from the Don and May Wilkins Charitable Trust($21,370) and transfer of
$7,000 each from the City's General Fund and the Downtown Development Authority for the
purpose of relocating the Franz-Smith Cabin.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That there is hereby appropriated from prior year reserves in the General Fund
the amount of TWENTY-ONE THOUSAND THREE HUNDRED SEVENTY DOLLARS($21,370)
and authorized for transfer to the Cultural Services and Facilities Fund,and appropriated therein for
the Franz-Smith Cabin Relocation Project.
Section 2. That there is hereby appropriated from unanticipated revenue in the Cultural
Services and Facilities Fund the sum of FOURTEEN THOUSAND DOLLARS ($14,000) for
expenditure for the Franz-Smith Cabin Relocation Project,upon receipt from the following sources:
Transfer from Downtown Development Authority 7,000
Transfer from General Fund 7,000
Total $14,000
Introduced and considered favorable on first reading and ordered published this 21 st day of
March,A.D. 2000, and to be presented for final passage on the 4th day of April,A.D. 2000.
