SUBJECT:
First Reading of Ordinance No. 73, 2000, Appropriating Prior Year Reserves in the Capital
Expansion Fund for Improvements Relating to the Provision of Library Services.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT:
Adoption of this Ordinance will allow the funds that have been received from the Library Capital
Improvement Expansion Fee to be approved and spent. Prior year reserves for library expansion fees
totaled$1,290,364 through 1999. Adoption of the Ordinance will appropriate$250,000 from library
expansion fee prior year reserves to purchase books and other library materials for the library.
EXECUTIVE SUMMARY:
Council previously authorized certain capital improvement expansion fees,including a fee for library
capital improvements. These fees are found in Chapter 7.5,Article II of the City Code. This article
provides that the expansion fees may only be spent on improvements identified in the Capital
Improvements Plan for library services. The Library Board's long-range capital improvement plan
was adopted by Council in 1998 and became part the City's Comprehensive Plan. Staff has planned
to use a portion of this money to buy books and materials for the library system,and these funds,in
the amount of$250,000 are appropriated for this purpose by adoption of the Ordinance. In 1998,
$268,000 was appropriated to purchase books and other library materials.
BACKGROUND:
The Library Capital Improvement Plan simply provides that the capital needs of the Library consist
of the need for more books and materials and more space and furnishings. Currently the Library
provides 2.5 books per capita and library expenditures are$25 per capita in this year's General Fund
Budget,based on a 2000 projected service area population of 137,772. The adopted Library Capital
Improvement Plan recommends that the Library strive to provide four books per capita and$36 per
I! capita by 2015.

APPROPRIATING PRIOR YEAR RESERVES IN THE
CAPITAL EXPANSION FUND FOR IMPROVEMENTS
RELATING TO THE PROVISION OF LIBRARY SERVICES
WHEREAS, the City of Fort Collins has recognized and addressed the issue of requiring
future growth and new development to contribute its proportionate share of the cost ofproviding new
capital facilities and infrastructure required to maintain the City's level of services to its residents;
and
WHEREAS,the City Council adopted Ordinance No. 51, 1996,on May 21, 1996,amending
the City Code by adding a new article pertaining to the imposition of capital expansion fees to be
used to fund capital improvements for the library,community parkland,police services,fire services,
and general governmental facility services; and
WHEREAS,the capital expansion fees imposed under the provisions of the aforementioned
section of the City Code,including a Library Capital Improvement Expansion Fee,went into effect
on July 1, 1996, and the City has since been receiving said fees as a condition of the issuance of
building permits; and
. WHEREAS, City Code Section 7.5-18, provides for annual fee increases in the capital
improvement expansion fees corresponding to the increases in the Denver-Boulder Consumer Price
Index for all urban consumers; and
WHEREAS,on July 21, 1998,the Council adopted on second reading Ordinance No. 121,
1998, increasing the library Capital Improvement Expansion Fee to reflect the increased level of
service resulting from the opening of the Harmony Library at Front Range Community College;and
WHEREAS,on November 16, 1999,the City Council adopted on second reading Ordinance
No. 171, 1999,adjusting the capital improvement expansion fees for increases in inflation based on
the Denver-Boulder Consumer Price Index; and
WHEREAS, City Code Section 7.5-27(a) requires that Library Capital Improvement
Expansion Fee funds be used only for capital improvements related to the provision of general
library services,as such improvements may be identified in the capital improvements plan for library
services; and
WHEREAS, the City Council adopted Ordinance No. 93, 1998, on June 2, 1998,
appropriating prior year Library Capital Expansion reserves to purchase books and other library
materials; and

WHEREAS,the purchase of books and other library materials is consistent with the Capital
Improvements Plan for the Library adopted by the Council in Resolution 98-83 on May 19, 1998;
and
WHEREAS,the Library Capital Improvements Plan recommends that the Library strive to
provide 4.0 books per city resident and increase annual per capita library expenditures to$36 by the
year 2015; and
WHEREAS, Library staff has identified the need to appropriate an additional $250,000 of
Library Capital Improvement Expansion Fees, to be used to purchase books and other library
materials, in an effort to move toward the aforementioned goals set forth in the Library Capital
Improvements Plan; and
WHEREAS,the aforementioned request for appropriation of said fees is consistent with the
uses of the fees set forth in Chapter 7.5 of the City Code; and
WHEREAS, funds are available in the Capital Expansion Fund for Library Services, from
prior year reserves in the amount of$250,000; and
WHEREAS,Article V,Section 9,of the Charter of the City of Fort Collins permits the City
Council to appropriate by ordinance at any time during the fiscal year such funds for expenditure as
may be available from reserves accumulated in prior years,notwithstanding that such reserves were
not previously appropriated; and
WHEREAS,it is the desire of the Council to appropriate funds,totaling$250,000,from prior
year reserves in the Capital Expansion Fund for the provision of costs associated with Library
Services.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from prior year reserves in the Capital
Expansion Fund,the sum of TWO HUNDRED FIFTY THOUSAND DOLLARS ($250,000)to be
used to purchase books and other library materials,as set forth in the Library Capital Improvements
Plan.
