SUBJECT: Items Relating to the Composition of the Board of Commissioners of the Fort Collins Housing Authority. RECOMMENDATION: I Staff recommends adoption of the Ordinance on Second Reading and of the Resolution. EXECUTIVE SUMMARY: A. Second Reading of Ordinance No. 72, 2000, Amending Section 2-247 of the City Code Pertaining to the Composition of the Board of Commissioners of the Fort Collins Housing Authority. Ordinance No. 72, 2000, which was unanimously adopted on First Reading on June 6, 2000, increases the number of commissioners of the Fort Collins Housing Authority from five to seven. It also eliminates the positions of community representatives. B. Resolution 2000-83 Making Appointments to the Housing Authority Board of Commissioners. C.R.S. 29-4-205(3)sets forth the process and terms for appointment of commissioners to a housing authority. The authority is to consist of commissioners selected by the City Council. With the adoption of Ordinance No.72,2000,the number of commissioners will be increased by the Council from five to seven. The terms of the newly-appointed commissioners will take effect as of July 1, 2000,after Ordinance No.72,2000,has taken effect. Pursuant to state statute the commissioners will serve terms that are staggered from the date of their appointment so that,to the extent possible,the terns of an equal number of commissioners will end each year. Thereafter,the term of office shall be five years. These people all expressed great interest and enthusiasm. EXECUTIVE SUMMARY: The proposed ordinance would increase the number of commissioners of the Fort Collins Housing Authority from five to seven. It would also eliminate 'tio cc Y tives. CKGROUND: TI The City Code tracks the state statutes in establishing the alternative methods by which the Board of Commissioners of the Fort Collins Housing Authority can be established. Under the first alternative,the Council can appoint itself to serve as the Board of Commissioners. (This method was selected by the Council in late 1998,when the Housing Authority was in turmoil in the wake of a substantial damage award against the Authority and its Board of Commissioners.) The alternative method of selection provided in the Code is for the Council to appoint no more j than five commissioners, one of whom may be a City official. The state statute dealing with this subject was amended in 1999 to allow for a board of no more than nine commissioners rather than five. Toward that end,the Council previously appointed a committee of its members to identify candidates j for appointment to a new Board of Commissioners and to make recommendations to the Council about alternatives available to the Housing Authority for continuing its operations in the most efficient and cost-effective manner, including any recommended changes to the organizational structure of the Authority. That committee has,through the selection process,identified seven strong candidates. Additionally,the committee,the Executive Director and the City Manager believe that a seven-member Board of Commissioners would better serve the interests of the community, given the increasing complexity of the Housing Authority operations and the need for diversity and different areas of expertise on the Board. The proposed ordinance would increase the number of commissioners Woom five to seven. It would also eliminate the existing provisions of the Code which provide for the appointment f two community representatives,since the expanded Board of Commissioners would alleviate the need for such positions, especially in view of the fact that federal law currently requires that one of the members of the Board of I Commissioners must be a tenant of the Housing Authority. I RESOLUTION 2000-83 . OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING APPOINTMENTS TO HOUSING AUTHORITY BOARD OF COMMISSIONERS WHEREAS, Section 2-247 of the City Code provides that the Housing Authority shall consist of commissioners selected by the City Council in the manner provided by state statute; and WHEREAS,the manner of selection specified in the statutes and in Section 2-247 permits the Council to either appoint its own members to serve ex-officio as the commissioners of the Authority or, in the alternative,to appoint no more than nine commissioners,one of whom may be a City official; and WHEREAS,on this same date the Council has approved on second reading Ordinance No. 72,2000,amending Section 2-247 to increase the number of commissioners from five to seven;and WHEREAS, Section 29-4-205(3)(b) C.R.S.provides that the initial terms of the appointed commissioners shall be staggered from the date of their appointments such that, to the extent possible,the terms of an equal number of commissioners end each year and,thereafter,the term of office of the commissioners shall be for five years. .
