First Reading of Ordinance No. 56, 2000, Authorizing the Revision of the Legal Description of
That Easement Conveyed to Wyoming Interstate Company Pursuant to Ordinance No. 58, 1999,
to Accommodate Minor Field Changes During Construction.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT:
The City was previously paid for the easement.

EXECUTIVE SUMMARY:
In May of 1999, Council adopted Ordinance No. 58, 1999 conveying an easement to Wyoming
Interstate Company for pipeline construction across Meadow Springs Ranch. The "as-built"
drawings show that the Wyoming Interstate Company's line of construction falls outside of the
previously acquired construction easement. This minor field change was needed to accommodate
a straight boring under Interstate 25. The Wyoming Interstate Company would like to resolve the
issue and correct the legal description contained in the easement. After Council approval of the
revised easement it will be re-recorded.

ORDINANCE NO. 56, 2000
• OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE REVISION OF THE LEGAL DESCRIPTION OF
THAT EASEMENT CONVEYED TO WYOMING INTERSTATE COMPANY
PURSUANT TO ORDINANCE NO. 58, 1999, TO ACCOMMODATE
MINOR FIELD CHANGES DURING CONSTRUCTION
WHEREAS,the City of Fort Collins is the owner of the property known as Meadow Springs
Ranch in Larimer County, Colorado (the "Ranch"); and
WHEREAS,the Ranch was acquired by the City to be used by the City's Wastewater Utility_
for future sludge disposal; and
WHEREAS, on May 10, 1999, pursuant to Ordinance No. 58, 1999, the City conveyed to
the Wyoming Interstate Company (the "Company") an easement the Company had requested for
installation and maintenance of a 24" gas pipeline (the "Pipeline") across the Ranch, as legally
described on Exhibit "A", attached hereto and incorporated herein by reference (the "Easement");
and
WHEREAS, since granting the Easement to the Company, and after construction of the
Pipeline, the as-built drawings of the Pipeline show that it was constructed on the Ranch in certain
areas outside the legal description of the Easement; and
WHEREAS,this change in location of the Pipeline was needed in order to accommodate a
straight boring under Interstate 25; and
WHEREAS,the City and Company would like to resolve this minor discrepancy between
the legal description of the Easement and where the Pipeline is actually located; and
WHEREAS, the legal description for the Easement for the Pipeline as now built should be
as legally described in Exhibit "B", attached hereto and incorporated herein by reference (the
"Corrected Legal Description"); and
WHEREAS,Section 23-111 of the City Code provides that City Council is authorized to sell,
convey or otherwise dispose of any interest in real property owned by the City that is used as part
of one of the City's utility systems, provided the Council first finds by ordinance that such
disposition will not materially impair the viability of the utility system as a whole, and that it will
be for the benefit of the City's citizens, and that it is in the best interests of the City.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the above-described conveyance of the Easement using the Corrected
Legal Description will not materially impair the viability of the City's wastewater utility system as
a whole, will be for the benefit of the City's citizens, and is in the best interests of the City.
Section 2. That the Mayor hereby is authorized to execute such documents as are
necessary to amend the Easement using the Corrected Legal Description and that such amendment
to the Easement shall be upon such other terms and conditions that in the City Manager's judgment
are in the best interests of the City,including any requirement that the Company reconvey to the City
any portion of the Easement that was originally conveyed that is no longer needed by the Company
for the Pipeline.
Introduced and considered favorably on first reading and ordered published this 16th day of
May, A.D. 2000, and to be presented for final passage on the 6th day of June,A.D. 2000.
