SUBJECT
First Reading of Ordinance No. 008, 2004, Appropriating Unanticipated Revenue into a Project
Account for the Design of Improvements to South Taft Hill Road, Between Horsetooth Road and
Harmony Road (CR-38E).
RECOMMENDATION
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT
The design of South Taft Hill Road from Horsetooth Road to Harmony Road is being funded
through a transfer of$300,000 in Regional Road Capital Expansion Fees from Latimer County to
the City.
No local matching funds are required by the City.
EXECUTIVE SUMMARY
The City of Fort Collins Engineering Department has received a total of $300,000 from Latimer
County's Regional Road Capital Expansion Fee Program. Under this program,the County collects
a fee from building permits issued within unincorporated Latimer County and the City of Fort
Collins. This impact fee program was initiated by Latimer County in 1999,and adopted by the City
of Fort Collins in February of 2000. Taft Hill Road (County Road 19) between Fort Collins and
Loveland is identified as one of five regional roads in the Latimer County Transportation Plan dated
1998. Latimer County has selected this segment of South Taft Hill Road(Horsetooth to Harmony)
from among the five eligible regional roads for use of these funds. This project will design this
section of South Taft Hill Road for the ultimate four-lane urban arterial street section. At the request
of the County,a design for a potential interim three-lane arterial street section will also be produced.
BACKGROUND
South Taft Hill Road between Horsetooth Road and Harmony Road (CR-38E) has not yet been
annexed by the City of Fort Collins, but is located within the City's Growth Management Area. It
is currently a two-lane County road with no left turn lanes, no bike lanes, partial sidewalk and

minimal shoulders. This County road is identified in the City's Master Street Plan as ultimately
needing to become a four-lane arterial street.
Latimer County's Transportation Plan,adopted in 1998,has identified five roads within the County
that are considered"Regional Roads"and are eligible for funding from the"Regional Road Capital
Expansion Fees" program for road improvements. Taft Hill Road (CR 19) is one of the regional
roads that can be improved using these impact fees.
The ultimate roadway section will be designed as a City four-lane arterial street. This section is
anticipated to be very similar to the recently completed,Building Community Choices-1997 section
of South Taft Hill Road between Drake and Horsetooth, immediately to the north. Additional
Regional Road funds that can be transferred from the County to pay for construction are being
accumulated. These funds are limited, and alone may not be sufficient to fund the ultimate
improvements. As a potential "fall back" measure, the County has requested that interim
improvements also be designed, which will likely consist of a three-lane arterial street, including
a center reversible turn lane, two auto travel lanes and ten-foot wide paved shoulders/bike lanes.
The design effort will identify the costs for rights-of-way acquisition and construction. City staff
believes that it is preferable to construct the ultimate improvements if the funding can be found
within a reasonable time frame. Estimating the extent of funding that would need to be identified
requires that this design project proceed.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE IN THE
CAPITAL PROJECTS FUND - SOUTH TAFT HILL ROAD,
HORSETOOTH ROAD TO HARMONY ROAD PROJECT, TO BE USED FOR
THE DESIGN OF A FOUR-LANE ARTERIAL STREET ON A SECTION OF SOUTH
TAFT HILL ROAD FROM HORSETOOTH ROAD SOUTH TO HARMONY ROAD
WHEREAS, the section of South Taft Hill Road from Horsetooth Road south to
Harmony Road, located within the City's Growth Management Area, is currently a two-lane
County road with no left turn lanes, no bike lanes, partial sidewalk, and minimal roadway
shoulders; and
WHEREAS, the aforementioned roadway is identified in the City's Master Street Plan as
a roadway which should become a four-lane arterial street; and
WHEREAS, South Taft Hill Road (County Road 19) is identified in Latimer County's
Transportation Plan as one of five roads within the County that are considered "Regional Roads"
and, as such, Taft Hill Road is eligible for funding from the County's Regional Road Capital
Expansion Fee program; and
WHEREAS, under the County's Regional Road Capital Expansion Fee program, initiated
by Latimer County in 1999 and adopted by the City in 2000, the County collects fees from
building permits issued within unincorporated Latimer County and the City of Fort Collins, and
said fees are then available for funding improvements to "Regional Roads" as identified by the
County; and
WHEREAS, the City has received $300,000 from Latimer County's Regional Road
Capital Expansion Fee program; and
WHEREAS, the City will use the aforementioned funds to cover the costs of designing a
four-lane arterial street for the section of South Taft Hill Road from Horsetooth Road south to
Harmony Road; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins permits the
City Council to make supplemental appropriations by ordinance at any time during the fiscal
year, provided that the total amount of such supplemental appropriations, in combination with all
previous appropriations for that fiscal year, does not exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS, City staff has determined that the appropriation of $300,000 from Latimer
County as described herein will not cause the total amount appropriated in the Capital Projects
Fund - South Taft Hill Road, Horsetooth Road to Harmony Road capital project budget to
exceed the current estimate of actual and anticipated revenues to be received during any fiscal
year; and
WHEREAS, it is the desire of the Council to appropriate the sum of $300,000,
representing Regional Road Capital Expansion fees collected by Larimer County, in the Capital
Projects Fund - South Taft Hill Road, Horsetooth Road to Harmony capital project to be used to
cover the costs of designing a four-lane arterial street for the section of South Taft Hill Road
from Horsetooth Road south to Harmony Road
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in
the Capital Projects Fund - South Taft Hill Road, Horstooth Road to Harmony Road capital
project, the sum of THREE HUNDRED THOUSAND DOLLARS ($300,000), upon receipt
from Larimer County, to be used to cover the costs to design a four-lane arterial street for the
section of South Taft Hill Road from Horsetooth Road south to Harmony Road.
Introduced and considered favorably on first reading and ordered published this 20th day
of January, A.D. 2004, and to be presented for final passage on the 3rd day of February, A.D.
2004.
