SUBJECT
Second Reading of Ordinance No. 001, 2004, Appropriating Prior Year Reserves in the Street
Oversizing Fund and Authorizing the Transfer of Appropriated Amounts to Be Used to Construct
Improvements on Ziegler Road from Timberwood Drive, South to Kechter Road.
RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY
With the construction of the Fossil Ridge High School,arterial street improvements are planned for
Zeigler Road adjacent to the school property. Parks and Recreation owns the Southeast Community
Park site adjacent to Zeigler Road immediately south of the high school site.Hewlett Packard owns
an undeveloped site adjacent to Zeigler Road immediately north of the high school. Staff has worked
with these property owners in an effort to complete this portion of Zeigler Road between Harmony
and Kechter. The property owners have combined to improve Zeigler Road to a minor arterial from
Timberwood Drive south to Kechter Road. Combining the roadway construction into one project
will save costs for all property owners due to economies of scale and complete an important segment
of roadway which will provide primary access to the new Fossil Ridge High School opening in the
fall of 2004. Ordinance No. 001, 2004, was adopted 6-0(Councilmember Bertschy was absent)on
First Reading on January 6, 2004.
ORDINANCE NO. 001, 2004
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING PRIOR YEAR RESERVES IN THE STREET OVERSIZING FUND
AND AUTHORIZING THE TRANSFER OF APPROPRIATED AMOUNTS
TO BE USED TO CONSTRUCT IMPROVEMENTS ON ZIEGLER ROAD
FROM TIMBERWOOD DRIVE, SOUTH TO KECHTER ROAD
WHEREAS, with the construction of Fossil Ridge High School and the development of
the Southeast Community Park, arterial street improvements are planned for Ziegler Road
adjacent to the new high school, from Timberwood Drive, south to Kechter Road; and
WHEREAS, during the past two years, staff from the City and Poudre R-1 School
District, have been working on the design plans for Ziegler Road, adjacent to the new Fossil
Ridge Creek High School which is currently under construction; and
WHEREAS, the planned improvements will complete the construction of the east half of
Ziegler Road, including bike lanes, curb, gutter and sidewalk from the Celestica site, on the
north, to Kechter Road on the south (the "Project"); and
WHEREAS, combining the aforementioned development improvements with the park
improvements increases efficiency, reduces costs, minimizes the disruption to the traveling
public, and completes a significant section of arterial roadway; and
WHEREAS, the estimated cost of the Project is $1,066,323; and
WHEREAS, a funding strategy has been developed, and Project funds, totaling
$1,066,323, have been identified and are available from the following sources:
Street Oversizing Fund - Prior Year Reserves (representing
contributions from Poudre R-1 School District) $ 471,063
Street Oversizing Fund - existing appropriations 369,793
Capital Projects Fund - existing appropriations in the
Southeast Community Park project 225,467
Total $ 1,066,323
WHEREAS, upon completion of the bid process, the Project is expected to begin in
March 2004, with construction to be completed prior to the opening of the high school in August
2004; and
WHEREAS, Article V, Section 9 of the Charter of the City of Fort Collins, (the
"Charter") permits the City Council to appropriate by ordinance at any time during the fiscal year
such funds for expenditure as may be available from reserves accumulated in prior years,
notwithstanding that such reserves were not previously appropriated; and
WHEREAS, Article V, Section 10, of the Charter authorizes the City Council to transfer
by ordinance any unexpended and unencumbered amount or portion thereof from one fund or
capital project to another fund or capital project, provided the purpose for which the transferred
funds are to be expended remains unchanged; and
WHEREAS, the purpose for which the previously appropriated funds in the Street
Oversizing Fund ($369,793), and the Capital Projects Fund - Southeast Community Park project
($225,467), were initially appropriated remains the same, and the City Manager has
recommended that said unspent and unencumbered funds be transferred to the Capital Projects
Fund - Ziegler Road Improvements project and that such funds be earmarked for expenditures
associated with improving Ziegler Road, from Timberwood Drive, south to Kechter Road; and
WHEREAS, it is the desire of the Council to appropriate $471,063 from prior year
reserves in the Street Oversizing Fund and authorize the transfer of said amount to the Capital
Projects Fund - Ziegler Road Improvements project, for appropriation therein, and to authorize
the transfer of existing appropriations totaling $369,793 in the Street Oversizing Fund, and
$225,467 in the Capital Projects Fund - Southeast Community Park project, to the Capital
Projects Fund - Ziegler Park Improvements project to be used for expenditures associated with
improving Ziegler Road, from Timberwood Drive, south to Kechter Road.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That there is hereby appropriated for expenditure from prior year reserves
in the Street Oversizing Fund for transfer to the Capital Projects Fund - Ziegler Road
Improvements project and appropriated therein the sum of FOUR HUNDRED SEVENTY-ONE
THOUSAND SIXTY-THREE DOLLARS ($471,063) to be used for expenditures associated
with improving Ziegler Road, from Timberwood Drive, south to Kechter Road.
Section 2. That the unexpended appropriated amount of THREE HUNDRED
SIXTY-NINE THOUSAND SEVEN HUNDRED NINETY-THREE ($369,793) is hereby
authorized for transfer from the Street Oversizing Fund to the Capital Projects Fund - Ziegler
Road Improvements project and appropriated therein to be used for expenditures associated with
improving Ziegler Road, from Timberwood Drive, south to Kechter Road.
Section 3. That the unexpended appropriated amount of TWO HUNDRED
TWENTY-FIVE THOUSAND FOUR HUNDRED SIXTY-SEVEN DOLLARS ($225,467) is
hereby authorized for transfer from the Capital Projects Fund - Southeast Community Park
project to the Capital Projects Fund - Ziegler Road Improvement project and appropriated therein
to be used for expenditures associated with improving Ziegler Road, from Timberwood Drive,
south to Kechter Road.

FINANCIAL IMPACT
This Ordinance appropriates(71,'013, una 'c at re from Contributions in Aid of

transfers $225,467 from the Southeast u Park unt, and $369,793 in existing
appropriations from the Street Oversizing Fund into the Capital Projects Fund to construct arterial
roadway improvements for the Zeigler Road Project,Timberwood to Kechter Road.This project will
go to bid as soon as funds are available. Funds will be appropriated as follows:
Poudre R-1 School District $471,063 Contribution In Aid
Parks and Recreation $225,467 Southeast Community Park Account
Street Oversizing Fund $369,793 Street Oversizing Fund

construction will be managed by the City Street Oversizing Program.

BACKGROUND
Over the past year, the Poudre R-1 School District, Street Oversizing and Parks staff have worked
to complete the design of Zeigler Road adjacent to the new Fossil Ridge High School (currently
under construction). The west half of Zeigler Road was constructed with the Harvest Park and Sage
Creek developments. This project will finish the construction of the east half of Zeigler Road with
bike lanes, curb, gutter and sidewalk from the Celestica site on the north, all the way to Kechter

The project is planned to begin construction in the March of 2004. The project will be constructed
under traffic with no closure of the roadway. Construction is planned to be completed prior to the
opening of the high school in August of 2004.
