3. Resolution 2001-46 Making Findings of Fact and Conclusions Regardin the he Appeal of a Decision of the
Planning and Zoning Board Relating to the Harmony Safeway Marketplace Lot 6. Safeway Fuel Facility
P.D.P.
On February 1,2001,a Notice of Appeal was filed by the applicant with respect to the January 18,2001
decision of the Planning and Zoning Board approving with a condition Harmony Safeway Marketplace,
Lot 6, Safeway Fuel Facility, P.D.P. At issue was the condition of approval pertaining to flush wall
signage on the south and east elevations of the convenience store.
At the March 20,2001 hearing on this matter,Council considered testimony of the Planning and Zoning
Board record,staff and the appellants. In subsequent discussion at this hearing,the Council determined
that the Planning and Zoning Board failed to properly interpret and apply the relevant provisions of the
Code and Charter with respect to the condition of approval.
Consequently,the January 18,2001 decision of the Planning and Zoning Board approving the P.D.P.with
one condition was amended by removing the condition of approval regarding the flush wall signs,and this
Resolution makes final the decision of the Council on the appeal.
4. Resolution 2001-47 Making Findings of Fact and Conclusions Regarding the Appeal of a Decision of the
Planning and Zoning Board Relating to the Provincetowne P.U.D.. Filing Two -Final.
On January 30, 2001, an appeal of the January 18, 2001 decision of the Planning and Zoning Board to
approve the Provincetowne PUD, Filing One - Final was filed by the Appellants David G. Evans and
Doug Sparks.The Appellants filed an amended appeal on February 20,2001,and added Mark Menke as
an appellant.
On March 20,2001,City Council voted to uphold the decision of the Planning and Zoning Board.In order
to complete the record regarding this appeal, the Council should adopt a Resolution making findings of
fact and finalizing its decision on the appeal.
