HomeMy WebLinkAboutCOUNCIL - AGENDA ITEM - 11/21/2000 - FIRST READING OF ORDINANCE NO. 169, 2000, APPROPRI AGENDA ITEM SUMMARY ITEM NUMBER: 17 FORT COLLINS CITY COUNCIL DATE: November 21, 2000 STAFF: Kathleen Reavis SUBJECT: First Reading of Ordinance No.169, 2000, Appropriating Unanticipated Revenue in the Transportation Services Fund, Authorizing the Transfer of Appropriations to be Used for Extending the Scope of Improvements Associated with the Construction of Phase III of the Harmony Road Bikeway Project, and Approving the Related Amendment of the Contract with the Colorado Department of Transportation. RECOMMENDATION: Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT: The City of Fort Collins has been provided with additional Enhancement funding from the Colorado Department of Transportation(CDOT)to extend the scope of work for the Harmony Road Bikelanes Phase III project. The City will receive an additional$154,000 of funding for this project,$123,200 in federal funds from CDOT plus $30,800 local matching funds from Transportation Planning. In addition, Hewlett-Packard company will be contributing$7,800 to the City for the re-construction of the islands in front of its site entrances. The original funding for the Harmony Road Bikelanes — Phase III was $456,485. The additional funds will bring the CDOT funding level to$610,485,plus the$7,800 from Hewlett-Packard for an overall project total of$618,285. EXECUTIVE SUMMARY: The City of Fort Collins has been provided with additional Enhancement funding from the Colorado Department of Transportation (CDOT)to extend the scope of the Harmony Road Bikelanes Phase III project. This additional funding will cover the costs associated with extending the project to include bikelane improvements along Harmony Road from Ziegler Road(County Road 9)to Strauss Cabin Road (County Road 7). The original funding for the Harmony Road Bikelanes —Phase III was$456,485. These funds have been used to complete the final design plans for the entire project corridor as well as construct the bikelanes along Harmony from Boardwalk to Timberline. BACKGROUND: The Harmony Road Bikelane Project has come forward as a critical bikeway improvement project based upon the City of Fort Collins Bicycle Program Plan (1995) and the Harmony Road Bicycle Project: Concept Plan (1996). Both of these citizen-based planning efforts were very effective in identifying needs and bikeway design issues for commuter cyclists along this major east/west corridor of the city. DATE: November 21, 2000 2 ITEM NUMBER: 17 Since the Harmony Road Bicycle Project: Concept Plan was approved in 1996, the City's Transportation Planning department has continued to pursue funding to carry out the planning, design, and construction phases for the bikeway project along the Harmony corridor. The primary funding source for the Harmony Road bikelanes has been federal Enhancement funds from the Colorado Department of Transportation through the North Front Range Transportation& Air Quality Planning Council. Over the past 4'/z years, the City has received approximately $750,000 in total grant funding for this project. The last remaining phase of the bikelane project is this "Harmony Road Bikelane Project—Phase III Extension" which includes an additional $154,000 in public funds and $7,800 in private funds from Hewlett-Packard. This funding will allow the City the necessary funds to expand the scope of the original phase III project in order to construct the Harmony Road bikelanes from Ziegler Road (formerly County Road 9)to Strauss Cabin Road(formerly County Road 7). The additional funds available for the Phase III extension project,bring the total funding for the project to approximately $900,000. After completion of the Phase III extension project, the bikelanes on Harmony will be continuous from South College Avenue to I-25. Thus accomplishing the goals set forth in the Harmony Road Bicycle Project: Concept Plan to improve safety and accessibility for cyclists along this important commercial and employment corridor. There will still be a few small stretches of the Harmony corridor that will not have bikelanes until the adjacent development is completed or a major roadway widening project is undertaken by the City and/or CDOT. However, given the rapid growth rate along the Harmony Road corridor, these improvements will likely be constructed by new development in the very near term. • ORDINANCE NO. 169, 2000 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE TRANSPORTATION SERVICES FUND, AUTHORIZING THE TRANSFER OF APPROPRIATIONS TO BE USED FOR EXTENDING THE SCOPE OF IMPROVEMENTS ASSOCIATED WITH THE CONSTRUCTION OF PHASE III OF THE HARMONY ROAD BIKEWAY PROJECT, AND APPROVING THE RELATED AMENDMENT OF THE CONTRACT WITH THE COLORADO DEPARTMENT OF TRANSPORTATION WHEREAS,the City contracted with the consulting team HNTB Corporation and Drake and Associates and worked with a citizen's advisory committee to plan and design facilities for bicycle transportation on Harmony Road between College Avenue and Interstate 25; and WHEREAS, constructing bike lanes along Harmony Road was identified as the highest priority of the Project; and WHEREAS,portions of phases I and II have been completed or are planned for completion as part of the development occurring along the Harmony corridor; and WHEREAS, on July 20, 1999, the City Council adopted Ordinance No. 108, 1999, . appropriating a total of$365,188, in the form of Transportation Equity Act for the 21st Century funds ("TEA-21 Funds") from the Colorado Department of Transportation ("CDOT") and related City matching funds to be used for the construction of phase III of the Harmony Road Bikeway project (the "Project"); and WHEREAS, the estimated cost to complete phase III of the Project was $456,485; and WHEREAS,the City Council previously adopted Resolution 99-79,authorizing the Mayor to execute an intergovernmental agreement with the CDOT for the extension of the Harmony Road Bikeway Phase III project and for the receipt of Transportation Equity Act for the 21 st Century funds ("I'EA-21 Funds") to be used to design and construct improvements relating to phase III of the Project; and WHEREAS,CDOT has made available to the City of Fort Collins,TEA-21 funds in the total amount of$123,200 to extend the scope of work associated with phase III of the Project, including bikelane improvements along Harmony Road from Ziegler Road(County Road 9)to Strauss Cabin Road (County Road 7); and WHEREAS,the revised estimated cost to complete phase III of the Project is now$610,485; and WHEREAS,local matching funds needed for completion of phase III of the Project,totaling • $30,800,have been identified from existing appropriations in the Transportation Services Fund;and WHEREAS, in addition,the Hewlett-Packard Company will be contributing$7,800 to the City for the reconstruction of the islands in front of their site entrances; and WHEREAS,Article V, Section 9, of the Charter of the City of Fort Collins (the"Charter") permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,do not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS,Article V,Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project,provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, it is the desire of the Council to appropriate the sum of$123,200 in Colorado Department of Transportation TEA-21 funds and$7,800 from a contribution from Hewlett-Packard, and to authorize the transfer of$30,800 in local matching funds in the Transportation Services Fund to be used to extend the scope of work associated with the construction of phase III of the Harmony Road Bikeway project. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Transportation Services Fund,the sum of ONE HUNDRED TWENTY-THREE THOUSAND TWO HUNDRED DOLLARS ($123,200) from Colorado Department of Transportation TEA-21 funds, to be used to extend the scope of work associated with the construction of phase III of the Harmony Road Bikeway project. Section 2. That there is hereby appropriated for expenditure from unanticipated revenue in the Transportation Services Fund, the sum of SEVEN THOUSAND EIGHT HUNDRED DOLLARS ($7,800),in the form of a contributions from the Hewlett-Packard Company,to be used for their share of improvements associated with the construction of phase III of the Harmony Road Bikeway project. Section3. That the unexpended appropriated amount of THIRTYTHOUSAND EIGHT HUNDRED DOLLARS ($30,800) is hereby authorized for transfer from operations dollars in the Transportation Planning 2000 budget to the Harmony Road Bikeway project and appropriated therein to be used to extend the scope of work associated with the construction of phase III of the Harmony Road Bikeway project. Section 4. That the Mayor be,and hereby is,authorized to execute documents amending the original transportation enhancement contract between the City and the Colorado Department of Transportation, in accordance with the terms of this Ordinance; provided that the approval of such amendment by this Ordinance is not intended,and shall be not be interpreted to require,the approval of any subsequent modifications of said contract to be accomplished by ordinance if such modification may otherwise be accomplished by resolution.
