RECOMMENDATION: Staff and the Natural Resources Advisory Board recommend adoption of the Resolution. FINANCIAL IMPACT: This item authorizes the acquisition of McMurry Natural Area, approximately 30 acres of land,for public natural area purposes. The total acquisition cost to the City of Fort Collins is$10. Initial site improvement costs are estimated at$2,000 and annual maintenance costs are estimated at $2,250, based on 1999 costs for sites of similar size and condition. Staff anticipates that funds for long-term maintenance will be available from the City's share of the proceeds of the Latimer County Help Preserve Open Space (HPOS) Sales Tax. EXECUTIVE SUMMARY: The 30-acre McMurry Natural Area is on the north side of the Poudre River between Shields Street and College Avenue. Access is via a parking lot at the west end of Hemlock Street. McMurry Natural Area is within close proximity to five natural areas currently owned and managed by the City. It is immediately adjacent to Salyer Natural Area,natural area property#98P1(the"Ackerman Court Property," to be included within the McMurry Natural Area after City acquisition), and Lee Martinez Community Park. The County has owned and managed the property since the early 1960's. The property has significant natural values and would help to meet the objectives of the Natural Areas Policy Plan and several other adopted plans and policies. BACKGROUND: In early 1999, Latimer County Parks and Open Lands asked the City of Fort Collins Natural Resources Department(NRD)to consider taking over management of the McMurry Natural Area. NRD was interested in managing McMurry because it (1) was centrally located among three other City natural areas,including the recently acquired"Ackerman Court Property"; (2)had an existing parking lot; and(3)could be more consistently managed and patrolled with surrounding properties if under City Natural Areas Regulations. DATE: November 21, 2000 2 ITEM NUMBER: 30 NRD agreed to take over management of McMurry Natural Area if the County granted fee title on the property at no cost and completed site improvements planned by the County or requested by the City prior to the end of 1999. These improvements included: • Closing the existing parking lot and creating a new parking lot farther to the east (farther from the pond). Relocating western rail fencing to the new parking lot,removing old picnic benches, and creating a footpath from the new parking lot to the pond. • Revegetating the old parking lot and picnic area with a native grass/wildflower mix. • Installing "No Swimming" and"Pets Must Be On Leash" signs. Removing Russian olives (an exotic, pest shrub) on the site and on the City's adjacent "Ackerman Court Property" site. The County also agreed to maintain the portion of the Foothills Trail between the City's Maxwell Natural Area and Reservoir Ridge Natural Area in perpetuity. (This portion of the trail is on County- managed land and CSU property; none of this section of the trail is on City property.) The County has fulfilled all the improvements listed above. NRD staff anticipates that the addition of this site will add minimally to staff maintenance burden. The County's work last year has completed nearly all site improvement needs currently anticipated for the McMurry Natural Area. NRD will be adding a few benches that have been built by an Eagle Scout, natural areas regulatory signs, and a new site sign. NRD believes that the ability to patrol the site and enforce City Natural Areas Regulations will be very beneficial to surrounding natural areas as well. McMurry is a site where dogs are frequently seen off leash and the site is used illegally for swimming. Wildlife use of the site includes resting and feeding areas for resident waterfowl and other waterbirds, feeding area for a variety of migratory songbirds,and feeding and watering areas for small to large mammals, including deer and fox. The conveyance from the County will be contingent upon receipt of approval from the Colorado Division of Parks and Outdoor Recreation,as the administrator of the Land and Water Conservation Fund, which assisted the County in its initial acquisition of the property. RESOLUTION 2000-142 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE ACCEPTANCE BY THE CITY OF THE TITLE TO THE MCMURRY NATURAL AREA FROM LARIMER COUNTY WHEREAS, Larimer County is the owner of approximately 30 acres of land located north of Martinez Park, east of the Ackerman Court property previously acquired by the City's Natural Areas Program,and west of Salyer Natural Area,generally described on Exhibit"A",attached hereto and incorporated herein by this reference (the "Property"); and WHEREAS,among the policies of City Plan as adopted by the Council in Resolution 97-25 is to establish a system of publicly owned natural areas to protect the integrity of critical conservation sites,protect corridors between natural areas,preserve outstanding examples of Fort Collins'diverse natural heritage and provide a broad range of opportunities for educational, interpretive and recreational programs to meet community needs; and WHEREAS, staff and the Natural Resources Advisory Board have reviewed the resource, natural heritage and open space values of the Property,and have determined that the Property would provide a valuable opportunity to advance the Natural Area objectives of City Plan and to enhance the City's ability to manage and utilize surrounding natural areas property already owned by the City; and WHEREAS,Larimer County has agreed to convey the Property to the City for use by the City for Natural Area purposes at nominal cost to the City. NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Council hereby approves and authorizes the acceptance by the Mayor of a deed of conveyance of the Property for natural area purposes.
