RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY
The North College Avenue Corridor Improvement project covers an area on Riverside/Jefferson
from Mulberry to College and on North College Avenue from Jefferson to north of Cherry Street.
The project is managed by City of Fort Collins Transportation Services and is funded by a
combination of sources including the City's 1997 Building Community Choices funds, Colorado
Department of Transportation (CDOT) resurfacing funds, Federal Congestion Mitigation and Air
Quality (CMAQ) funds, and Federal Surface Transportation Program (STP) funds.
Ordinance No. 009, 2004, was adopted 6-0 (Mayor Martinez was absent) on First Reading on
January 20, 2004.
ORDINANCE NO. 009, 2004
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROPRIATING UNANTICIPATED REVENUE
IN THE BUILDING COMMUNITY CHOICES CAPITAL PROJECTS FUND -
NORTH COLLEGE AVENUE CORRIDOR IMPROVEMENTS, PHASE I
WHEREAS,on April 8, 1997, the voters of the City approved Ordinance No. 30, 1997 (the
"Ordinance"), authorizing the imposition of a quarter cent sales and use tax for the purpose of
generating revenues to construct certain transportation projects described in the 'Building
Community Choices" ('BCC') capital improvement program; and
WHEREAS, one such project approved for funding by the voters was the North College
Avenue Corridor Improvements, Phase I (the 'Project"); and
WHEREAS, the scope of the Project as outlined in the Ordinance calls for the phased
construction of improvements to improve the safety of pedestrians and vehicles on North College
Avenue focusing on the 1/4 to 1/2 mile north of Jefferson Street; and
WHEREAS, the project improvements may include: (1) drainage improvements; (2)
widening the roadway to provide better and safer facilities for bicycles and pedestrians; (3)
constructing medians for access control; and/or (4) improving to full arterial street standards
including curb, gutter, and sidewalk; and
WHEREAS,on March 5,2002,City Council adopted Ordinance No.38,2002,appropriating
$142,270 in Congestion Mitigation&Air Quality("CMAQ")funds from the Colorado Department
of Transportation ("CDOT") and $34,730 in City matching funds to be used for design and
construction of bicycle and pedestrian improvements associated with the Project; and
WHEREAS, on February 4, 2003, Council adopted Ordinance No. 10, 2003, appropriating
an additional $223,453 in CMAQ funds, from CDOT, and $54,547 in local matching funds to be
used for the same Project purposes, plus an additional $2,500,000 in highwa
y resurfacing funds from CDOT for other road improvements in the immediate area of the Project,
including asphalt milling and overlaying along Jefferson and Riverside, and intersection
improvements at the North College/Jefferson, and Mulberry/Riverside intersections; and
WHEREAS, CDOT has recently awarded the City of Fort Collins another$200,143, in the
form of Surface Transportation Program ("STP") funds, to be used to construct additional
improvements associated with the Project; and
WHEREAS,local matching funds needed,totaling$48,857,have been identified in the form
of existing appropriations in the Building Community Choices-North College Corridor Project;and
WHEREAS,the aforementioned STP funds($200,143)from CDOT will be used along with
previously appropriated, dedicated sales and use tax funds (Building Community Choices) and
federal funds, totaling $5,463,222, in the Project, resulting in a total available appropriation of
$5,663,365; and
WHEREAS, on January 20, 2004, the City Council adopted Resolution 2004-007,
authorizing the Mayor to sign a contract funding increase approval letter with the Colorado
Department of Transportation for the construction of the North College Avenue Corridor
Improvements and the receipt of the foregoing $200,143 in STP funds; and
WHEREAS, the scope of improvements as described herein for the Project has been
developed in accordance with the North College Avenue/US 287 Access Management Plan; and
WHEREAS, Article V, Section 9, of the Charter of the City of Fort Collins (the "Charter")
permits the City Council to make supplemental appropriations by ordinance at any time during the
fiscal year,provided that the total amount of such supplemental appropriations,in combination with
all previous appropriations for that fiscal year, does not exceed the current estimate of actual and
anticipated revenues to be received during the fiscal year; and
WHEREAS,City staff has determined that the appropriation of STP funds ($200,143)from
the Colorado Department of Transportation, as described herein, will not cause the total amount
appropriated in the Building Community Choices Capital Projects Fund - North College Corridor
Project to exceed the current estimate of actual and anticipated revenues to be received during the
fiscal year; and
WHEREAS,it is the desire of the Council to appropriate the sum of$200,143,in STP funds,
in the Building Community Choices Capital Projects Fund - North College Avenue Corridor
Improvements project to be used with existing appropriations for the construction of improvements
along North College Avenue, between Jefferson Street and Vine Drive.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the
Building Community Choices Capital Projects Fund-North College Avenue Corridor Improvements
project,the sum of TWO HUNDRED THOUSAND ONE HUNDRED FORTY-THREE DOLLARS
($200,143)from Colorado Department of Transportation STP funds,to be used for the construction
of improvements along North College Avenue, between Jefferson Street and Vine Drive.
Introduced and considered favorably on first reading and ordered published this 20th day of
January, A.D. 2004, and to be presented for final passage on the 3rd day of February, A.D. 2004.

FINANCIAL IMPACT
The purpose of this Resolution is to authorize the Mayor to sign a contract funding letter for an
additional piece of federal funding for the North College Avenue Corridor Improvements project.

$249,000. This is in the form of$200,143 of Federal Funds and$48,857 in Local Agency Matching
Funds. The matching funds will come from the existing Building Community Choices funds for the
North College Improvements Project.

The North College Avenue Corridor Improvement project covers an area on Riverside/Jefferson
from Mulberry to College and on North College Avenue from Jefferson to north of Cherry Street.
The project is managed by City of Fort Collins Transportation Services and is funded by a

The goals of the project include the addition of pedestrian and bicycle facilities, installation of
drainage, access and landscaping improvements, and reconstruction of the roadway surface with
concrete paving on North College Avenue between Jefferson and Cherry Street. Also incorporated
in the project are roadway resurfacing improvements on Jefferson/Riverside between College
Avenue and Mulberry Street, including the Riverside/Mulberry intersection.
This proposed Resolution will authorize the Mayor to finalize the agreement with the Colorado
Department of Transportation for this component of the federal funding.

"This is a four phase project to improve the safety of pedestrians and vehicles on North College
Avenue. Phase I will focus on the 114 to 1/2 mile north of Jefferson Street. Anticipated
improvements may include:(1)drainage improvements;(2)widening roadway to provide betterand
safer facilities for bicycles and pedestrians; (3)constructing medians for access control;and/or(4)
improving to full arterial street standards including curb, gutter, and sidewalk. Planning, design,
right-of-way acquisition and other project costs may also be included."

Street intersection on the south to Vine Drive on the north. In addition,CDOT has added resurfacing
funding to the project so that roadway maintenance can be completed along Jefferson and Riverside
(SH14)from North College(US287)to Mulberry(SH14).The roadway maintenance improvements
include asphalt mill and overlay of the roadway and concrete improvements in the intersections.The
design has been developed in accordance with the US 287/SH14 Access Management Plan.
The design is based upon input from the community gathered from public open house events as well
as individual meetings with local tipsiness erty owners.

1. Single southbound left turn lane from North College to Jefferson;
2. Free flow right turn lane from westbound Jefferson to northbound College;
3. Raised, landscaped medians along the North College corridor;
4. Future removal of the northbound left turn from College to Cherry street, however this
change can be phased in over time as traffic conditions warrant—it is not needed with the
first phase of this project;
5. Double left turn lanes eastbound at the Cherry Street/North College intersection;
6. Extensive bicycle and pedestrian improvements,including enhanced crosswalks,on and off-
street bikeways.

The City has previously approved two contracts and one additional funding letter with the Colorado
Department of Transportation (CDOT) for this project. These include two Congestion Mitigation
and Air Quality(CMAQ)appropriations and a Resurfacing Funds appropriation. The Federal funds
are intended to assist with the construction of the improvements associated with the Building
Community Choices (BCC)project along North College Avenue/US 287 between Jefferson Street
and Vine Drive and the Resurfacing funds are intended to improve Jefferson and Riverside between
College and Mulberry. The State and Federal funds for this project are summarized as follows:

Besides the Federal and State Funds, the Building Community Choices (BCC) funds have been
previously appropriated into the project. The Building Community Choices (BCC) funds total
