RECOMMENDATION Staff recommends adoption of this Ordinance on Second Reading. EXECUTIVE SUMMARY This Ordinance, unanimously adopted on First Reading on January 15, 2008, appropriates funding to be used to install an eight foot wide sidewalk on the north side of Harmony, from Ziegler Road to Lady Moon Drive to provide pedestrian access to bus stops and businesses on the Harmony transit route. RECOMMENDATION Staff recommends adoption of the Ordinance on First Reading. FINANCIAL IMPACT This Ordinance appropriates $ 6 %in-tlicked re e from Contributions-in-Aid-of- Construction in the Street Oversizing Fund(received from Avago and Hewlett Packard Companies), and transfers an additional$204,508 from existing appropriations in the Street Oversizing Fund into the Capital Projects Fund,in order to construct sidewalk improvements on the north side of Harmony Road, from Ziegler Road to Lady Moon Drive. This project will go to bid this spring as a separate sidewalk projector as apart of the Ziegler and Horsetooth Roundabout. Funds will be appropriated as follows: Avago $ 30,324 Contribution-In-Aid Hewlett Packard $ 32,462 Contribution-In-Aid Street Oversizing Fund $204,508 Street Oversizing Fund Transfer to Project $267,294 EXECUTIVE SUMMARY Since Transfort has re-establishe e H .t route, ff has been working on sidewalk improvements for Harmony Road to support pedestrian accessibility. Working with private development and the Pedestrian Access Program, several gaps of missing sidewalk have been installed along Harmony Road. Staff began working with Avago Corporation and Hewlett Packard Company as adjacent property owners to explore the feasibility of installing an eight-foot wide sidewalk on the north side ofHarmony,from Ziegler Road to Lady Moon Drive(approximately 3900 linear feet). Both companies have agreed to contribute their local street portion for the construction January 15, 2008 -2- Item No. 12 of the improvements. The Street Oversizing Program will contribute for the oversized portion of the sidewalk and install a bus stop at Lady Moon, in accordance with normal program policies. BACKGROUND The Street Oversizing Program t ed a first p e of construction of the Harmony and Zeigler improvement project and is now prepared to begin the second phase, the roundabout construction at Ziegler and Horsetooth. Staff began working with Avago Corporation and the Hewlett Packard Company as adjacent property owners to explore the feasibility of installing an eight foot wide sidewalk on the north side of Harmony, from Ziegler Road to Lady Moon Drive (approximately 3900 linear feet). With the Harmony transit route now in service, pedestrian accessibility to bus stops and from bus stops to businesses is needed. Staff has been working with many property owners and private developers to fill in the gaps of missing sidewalk along Harmony. Avago and Hewlett Packard Companies have agreed to contribute their local street portion for the construction of the eight foot wide sidewalk along their frontage on the north side of Harmony Road. The Street Oversizing Program will contribute for the oversized portion of the sidewalk and install a bus stop at Lady Moon, in aCce po ies.With the City constructing 1 rov e s in the ea, itmakessense to build these improvements now in order tonta ec ies of a and keep construction costs low. Staff is prepared to construct the improvements this spring and summer,planned for May 2008 and to be completed in July 2008. Right-of-way was previously acquired through normal development dedications. No additional right-of-way is needed, with the exception of a temporary construction easement and a pedestrian easement. This sidewalk improvement will provide an important and much needed pedestrian connection between the businesses in the area and the transit stops on Harmony at Lady Moon and Ziegler. ORDINANCE NO. 002, 2008 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED REVENUE IN THE STREET OVERSIZING FUND FOR TRANSFER TO THE CAPITAL PROJECTS FUND - HARMONY ROAD AND ZIEGLER ROAD IMPROVEMENTS - FRONT RANGE VILLAGE DEVELOPMENT CAPITAL PROJECT AND AUTHORIZING THE TRANSFER OF APPROPRIATIONS BETWEEN FUNDS TO CONSTRUCT SIDEWALK IMPROVEMENTS ON THE NORTH SIDE OF HARMONY ROAD FROM ZIEGLER ROAD TO LADY MOON DRIVE WHEREAS, staff has been working on sidewalk improvements along Harmony Road to support pedestrian accessibility and enhance transit services along the Harmony Transfort route;and WHEREAS,staff has been working with Avago Corporation and Hewlett Packard Company, as adjacent property owners, to construct an eight-foot wide sidewalk along the north side of Harmony Road from Ziegler Road to Lady Moon Drive, spanning approximately 3,900 linear feet; and WHEREAS, the estimated cost to construct the aforementioned section of sidewalk along Harmony Road, adjacent to the Avago Corporation and Hewlett Packard Company properties, is $267,294; and WHEREAS, staff recommends funding these sidewalk improvements using the following sources: Developer Contribution - Avago Corporation $ 30,324 Developer Contribution - Hewlett Packard Company 32,462 Existing Appropriations - City's Street Oversizing Fund 204,508 Total $ 267,294 and; WHEREAS, constructing these sidewalk improvements at the same time as other City roadway improvements associated with the Front Range Village Development along Harmony Road will allow the City to take advantage of economies of scale and create savings in construction costs; and WHEREAS,staff plans to construct the proposed sidewalk improvements beginning in May of this year with a scheduled completion date in July; and WHEREAS, Article V, Section 9 of the Charter of the City of Fort Collins (the"Charter") pen-nits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year,provided that the total amount of such supplemental appropriations, in combination with all previous appropriations for that fiscal year, does not exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, staff has determined that the appropriation of developer contributions from Avago Corporation ($30,324) and Hewlett Packard Company ($32,462) will not cause the total amount appropriated in the Capital Projects Fund-Harmony Road and Ziegler Road Improvements - Front Range Village Development capital project to exceed the current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, Article V, Section 10,of the Charter authorizes the City Council to transfer by ordinance any unexpended and unencumbered amount or portion thereof from one fund or capital project to another fund or capital project, provided that the purpose for which the transferred funds are to be expended remains unchanged; and WHEREAS, in order to construct sidewalk improvements on the north side of Harmony Road from Ziegler Road to Lady Moon Drive, it is the desire of City Council to: (a)appropriate the sum of$62,786, in the form of developer contributions from Avago Corporation ($30,324) and Hewlett Packard Company ($32,462) in the Capital Projects Fund - Harmony Road and Ziegler Road Improvements - Front Range Village Development capital project; and (b) authorize the transfer of$204,508 from the Street Oversizing Fund to the Capital Projects Fund- Harmony Road and Ziegler Road Improvements - Front Range Village Development capital project for appropriation therein. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That there is hereby appropriated for expenditure from unanticipated revenue in the Capital Projects Fund-Harmony Road and Ziegler Road Improvements-Front Range Village Development capital project,the sum of SIXTY-TWO THOUSAND SEVEN HUNDRED EIGHTY- SIX DOLLARS($62,786),representing developer contributions from Avago Corporation($30,324) and Hewlett Packard Company ($32,462) for the purpose of constructing sidewalk improvements on the north side of Harmony Road from Ziegler Road to Lady Moon Drive. Section 2. That the unexpended and unencumbered appropriated amount of TWO HUNDRED FOUR THOUSAND FIVE HUNDRED EIGHT DOLLARS ($204,508) is hereby authorized for transfer from the Street Oversizing Fund to the Capital Projects Fund - Harmony Road and Ziegler Road Improvements - Front Range Village Development capital project for appropriation therein for the purpose of constructing sidewalk improvements on the north side of Harmony Road from Ziegler Road to Lady Moon Drive.
