Resolution 2004-009 Authorizing Revocable Permits Over Portions of the Kechter Road Right-of-
Way for a Fiber Optic Duct Bank and Irrigation Pipe for Poudre School District.
RECOMMENDATION
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY
Poudre School District has requested a revocable permit for a fiber optic duct bank and a revocable
permit for an irrigation water pipe,both in the Kechter Road right-of-way. These facilities will serve
the new Fossil Ridge High School and Zach Elementary School. City staff has reviewed the plans
and specifications for these improvements, and has concluded that the improvements will not result
in adverse impacts to the right-of-way. The District will be responsible for maintenance of the
irrigation pipe.
RESOLUTION 2004-009
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING REVOCABLE PERMITS UNDER PORTIONS OF THE
KECHTER ROAD RIGHT-OF-WAY FOR A FIBER OPTIC DUCT BANK
AND IRRIGATION PIPE FOR POUDRE SCHOOL DISTRICT
WHEREAS, Poudre School District (the "District") has requested that the City grant a
revocable permit for the continued operation of a duct bank for fiber optic lines and an irrigation
water pipe under the right-of-way for Kechter Road, in locations more specifically described in
Exhibit"A"and Exhibit`B",respectively,attached hereto and incorporated herein by this reference
(hereinafter referred to as the "Permit Areas"); and
WHEREAS,the District's use of the Permit Areas will allow the District to maintain certain
telecommunications services for Fossil Ridge High School and Zach Elementary School, and to
irrigate portions of its facilities; and
WHEREAS,City staff has reviewed the request to install the above-described improvements
in the Permit Areas, and believes that said installation will not interfere with or adversely affect the
Kechter Road right-of-way, based on current expectations; and
WHEREAS, the detailed plans for construction have been reviewed and approved by City
staff in order to ensure that no adverse impacts to the affected right-of-way will result; and
WHEREAS, Article XI,Section 10,of the Charter of the City of Fort Collins authorizes the
Council to permit the use or occupation of any street, alley, or public place, provided that such
permit shall be revocable by the Council at its pleasure, whether or not such right to revoke is
expressly reserved in such permit.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor is hereby authorized to execute such documents as are necessary to grant
a revocable permit to the Poudre School District,consistent with the terms of this Resolution which
shall include such additional terms and conditions as the City Manager,in consultation with the City
Attorney, deems necessary or appropriate to protect the interests of the City or effectuate the
purposes of this Resolution.
Passed and adopted at a regular meeting of the City Council of the City of Fort Collins
commenced on this 20th day of January A.D. 2004.
