Resolution 2004-008 Authorizing Revocable Permits Under a Portion of the Harmony Road and
Ziegler Road Rights-of-Way For Installation of Fiber Optic Conduit by OnFiber.
RECOMMENDATION
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY
OnFiber has requested a revocable permit for installation and maintenance of fiber optic conduit in
the Harmony Road and Ziegler Road rights-of-way. These facilities will serve the Agilent/Hewlett-
Packard complex adjacent to that intersection. City staff has reviewed the plans and specifications
for these improvements,and has concluded that the improvements will not result in adverse impacts
to the rights-of-way. OnFiber will also be required to obtain approval of the Colorado Department
of Transportation for the location under Harmony Road as a condition of the revocable permit.
RESOLUTION 2004-008
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING A REVOCABLE PERMIT UNDER A PORTION
OF THE HARMONY ROAD AND ZIEGLER ROAD RIGHTS-OF-WAY
FOR INSTALLATION OF FIBER OPTIC CONDUIT BY ONFIBER
WHEREAS, OnFiber, a telecommunications services provider, has requested that the City
authorize the installation of conduit for fiber optic lines under the rights-of-way for Harmony Road
and Ziegler Road,in the vicinity of the intersection of those two roads in locations more specifically
described in Exhibit "A", attached hereto and incorporated herein by this reference (hereinafter
referred to as the "Permit Areas"); and
WHEREAS, OnFiber's use of the Permit Areas will allow OnFiber to provide
telecommunications services to the Agilent and Hewlett-Packard complex on the adjacent property;
and
WHEREAS,City staff has reviewed the request to install the above-described improvements
in the Permit Areas, and believes that said installation will not interfere with or adversely affect the
Harmony Road or Ziegler Road rights-of-way, based on current expectations; and
WHEREAS, the detailed plans for construction, including backfill and restoration of the
Permit Areas upon completion of work by OnFiber and the work, shall be subject to review and
approval by City staff in order to ensure that no adverse impacts to the affected rights-of-way will
result; and
WHEREAS, as a condition of the revocable permit, OnFiber will be required to obtain the
approval of the Colorado Department of Transportation for the location of the improvements under
Harmony Road; and
WHEREAS, Article XI,Section 10,of the Charter of the City of Fort Collins authorizes the
Council to permit the use or occupation of any street, alley, or public place, provided that such
permit shall be revocable by the Council at its pleasure, whether or not such right to revoke is
expressly reserved in such permit.
NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor is hereby authorized to execute such documents as are necessary to grant
a revocable permit to OnFiber consistent with the terms of this Resolution which shall include such
additional terms and conditions as the City Manager,in consultation with the City Attorney, deems
necessary or appropriate to protect the interests of the City or effectuate the purposes of this
Resolution.
Passed and adopted at a regular meeting of the City Council of the City of Fort Collins
commenced on this 20th day of January A.D. 2004.

Exhibit "A"
Legal Description for OnFiber Revocable Permit for Fiber Optic Conduit
Harmony Road (State Highway 263) Build
Beginning in the Southeast '/4 of Section 33, Township 66 West, Range 7 North, along
Harmony Road, approximately 1082' west of CDOT Milepost 04. Construction will
begin at an existing ICG handhole located 13' off the south side of Harmony Road and
trench for approximately 26' to the east. Construction will then continue with a
directional bore under Harmony Road in a northerly direction for a distance of 170'. At
this point an OnFiber Carrier Services handhole will be installed and continue
construction using trench methods for approximately 20' to the northeast to tie into an
existing Hewlett Packard telecommunications vault located on Hewlett Packard property,
completing the connection within public right-of-way.
Ziegler Road Build
Beginning in the Southwest '/4 of Section 33, Township 66 West, Range 7 North, along
Ziegler Road, approximately 158' south of the Northwest property comer of Hewlett
Packard property. Construction will begin at an existing ICG handhole on the east side
of Ziegler Road trenching approximately 10' towards the east replacing the concrete
sidewalk as needed. An OnFiber Carrier Services handhole will then be placed on the
east side of the sidewalk on Hewlett Packard property completing the connection within
public right-of-way.
