First Reading of Ordinance No. 139,2000,Repealing Ordinance No. 93, 1995,and Designating the

RECOMMENDATION:
Staff and the Landmark Preservation Commission recommend adoption of the Ordinance on First
Reading.
EXECUTIVE SUMMARY:
The owner of the property,the City of Fort Collins, is initiating this request to repeal Ordinance No.
93, 1995,and to enact another ordinance to designate the C&S Freight Depot building and the entire
dock as a Fort Collins Landmark. The depot is significant to Fort Collins as an excellent example
of early vernacular industrial railroad design. The depot has additional significance to Fort Collins
for its historical importance,as a representation of the development of transportation and commerce
lip in Fort Collins.
History - Built in 1906 for $20,000, this was the Colorado & Southern Railroad's largest freight
depot north of Denver, designed so that twelve freight cars could be unloaded at once. Located
adjacent to the business district, the freight depot served as a shipping center for the region's large
sugar beet,lumber,and livestock industries. It also handled the domestic shipping needs of citizens,
from catalogue orders to coffins, as well as the bags, trunks and parcels of the growing number of
college students. From 1952 through 1975, the freight depot building also served as a Railway
Express Agency(REA)office-a pre-cursor to United Parcel Service. Used continuously as a freight
handling facility for eighty years, the freight depot was closed in May, 1986.
At a public hearing held on August 9, 2000, the Landmark Preservation Commission unanimously
recommended repeal of Ordinance No.93, 1995,which designated the C&S Freight Depot building
and only a portion of the Freight Depot dock; the Commission further unanimously recommended
adoption of another ordinance designating the C&S Freight Depot building and the entire dock as
a landmark for its architectural and historical importance to Fort Collins.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
REPEALING ORDINANCE NO. 93, 1995, AND DESIGNATING
THE C&S FREIGHT DEPOT BUILDING AND DOCK AS A
HISTORIC LANDMARK PURSUANT TO CHAPTER 14 OF THE CITY CODE
WHEREAS, pursuant to Section 14-2 of the City Code, the City Council has established a
public policy encouraging the protection,enhancement and perpetuation of historic landmarks within
the City; and
WHEREAS,the C&S Freight Depot building and only a portion of the dock were designated
as a historic landmark by Ordinance No. 93, 1995; and
WHEREAS,by Resolution dated August 9,2000 the Landmark Preservation Commission
(the "Commission") has determined that the C&S Freight Depot and the entire Dock have
architectural and historical importance to Fort Collins,as an early example of vernacular industrial
railroad design, and for their historical importance, as a representation of the development of
transportation and commerce in Fort Collins; and
WHEREAS,the Commission has further determined that said property meets the criteria of
a landmark as set forth in Section 14-5 of the Code and is eligible for designation as a landmark,and
. has recommended to the City Council that said property be designated by the City Council as a
landmark; and
WHEREAS, the owner of the property, the City of Fort Collins, has consented to such
landmark designation; and
WHEREAS, such landmark designation will preserve the property's significance to the
community; and
WHEREAS, the City Council has reviewed the recommendation of the Commission and
desires to approve such recommendation and designate said property as a historic landmark.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Ordinance No. 93, 1995,which designated the C&S Freight Depot building
and a portion of the dock, be, and hereby is, repealed.
Section 2.That the building and structure historically known as the C&S Freight Depot and
Dock,located on lands in the City of Fort Collins,Latimer County,Colorado,described as follows,
to wit:

Tracts A and C,
as shown on the proposed Plat of Downtown Transit Center,
Being a Replat of a Portion of Block 22, City of Fort Collins,
be, and hereby are,designated as a historic landmark pursuant to Chapter 14 of the Code of the City
of Fort Collins.
Section 3. That the Secretary of the Interior's standards and guidelines for the treatment of
historic properties will serve as the standards by which alterations, additions and other changes to
buildings and structures located upon the above described property will be reviewed for compliance
with Chapter 14, Article III,of the Code of the City of Fort Collins.

WHEREAS, it is a matter of public policy that the protection,enhancement and perpetuation of
sites, structures, and districts of historical,architectural or geographic significance, located within
the city, are a public necessity and are required in the interest of the prosperity, civic pride and
general welfare of the people; and
WHEREAS, it is the opinion of the City Council that the economic, cultural and aesthetic
standing of this city cannot be maintained or enhanced by disregarding the historical, architectural
and geographical heritage of the city and by ignoring the destruction or defacement of such cultural
assets; and
WHEREAS,the C&S Freight Depot building and a portion of the dock were designated as a Fort
Collins Landmark by Ordinance No. 93, 1995; and
WHEREAS,the Landmark Preservation Commission recommends that the C&S Freight Depot
building and the entire dock be designated as a Fort Collins Landmark; and
WHEREAS, the C&S Freight Depot and Dock have architectural and historical importance to
Fort Collins, as a locally rare early example of vernacular industrial railroad design, and for their
representation of the development of transportation in Fort Collins and the region; and
WHEREAS,the Landmark Preservation Commission has determined that the C&S Freight Depot

STAFF REPORT
REQUESTS:
1. Landmark Designation of a Portion of the C& S Freight Depot Dock, 136 Laporte Avenue.
2. Amendment of Ordinance No. 93, 1995, Designating the C & S Freight Depot and Dock, to
limit the Landmark designation to the C &S Freight Depot building and the north and west
docks, and removing the remaining land, as described on the attached map.

APPLICANT: City of Fort Collins, Jack Gianola, Facilities Special Projects Manager
BACKGROUND: At its June 13, 1995 meeting, the Landmark Preservation Commission voted
to recommend to Council the Landmark designation of the C & S Freight Depot, to include the
freight depot and the docks on the west side of the building,but only approximately 40 feet of the
dock to the north of the building. The designation was done in this manner to preserve as much
of the dock as possible, while recognizing the City's plans to eliminated the ramp portion of the
dock for a new office building. The designation was approved on August 1, 1995, when Council
passed Ordinance No. 93, 1995. The City's plans for construction in this location have since
changed, and the City would like to amend this designation ordinance to include all of the north
dock and ramp.
Additionally, the land to the west of the freight depot building was inadvertently included in the
original C & S Freight Depot designation. Amending Ordinance No. 93, 1995 would clarify the
original intent to designate only the freight depot building and docks, and would remove the
remaining land from the landmark designation. The Landmark designation of Annie's Grave Site
and Memorial Headstone, accomplished by Ordinance No. 140, 1995, would not be affected.
RECOMMENDATION: Staff recommends recommending to Council: 1.) Approval of the
Landmark designation of the entire north dock of the C & S Freight Depot building, to include
the ramp, for its architectural and historical significance to Fort Collins. 2.)The amendment of
Ordinance No. 93, 1995, to limit the Landmark designation to the C & S Freight Depot building
and the north and west docks, and removing the remaining land.

landmark, and has recommended to the City Council that said structure be designated by the City
Council as a local landmark; and

community; and

Southern Railway (C&S) Freight Depot or the Burlington Northern Freight Depot.
Included as part of the improvements are the loading docks on west side of building
and that portion of the loading docks south of the north"east-west" line of Lot 28,
Block 22 (approximately 40 feet north of the north facade of subject building).

APPLICANT: City of Fort Collins
REQUEST: Local Landmark Designation of the C&S Freight Depot,
including the docks on the west and approximately 40 feet of the
docks to the north
BACKGROUND: Please see attached memorandum from Jim Reidhead,
Associate Director, The Center for the Stabilization of Important
Structures
• STANDARDS: The Secretary of the Interior' s Standards for
Rehabilitation defines rehabilitation as "the process of
returning a property to a state of utility , through repair or
alteration , which makes possible an efficient contemporary use
while preserving those portions and features of the property
which are significant to its historic, architectural, and
cultural values . " (p. 5) .
RECOMMENDATION: Staff recommends approving the request for Local
Landmark Designation of the historic Colorado & Southern Freight
Depot, also known as the B & N Depot, 136 Laporte Avenue,
including the docks on the west and approximately 40 feet of the
docks to the north. The structure is significant for its
historical and architectural importance.
Historical Importance - the depot is significant for its
contribution to the historical trend of transportation history in
Fort Collins . For much of this century, all commerce revolved
around this building, and businesses located around Mason Street
to avail themselves of the dependable transportation network.
The depot housed the Railway Express Agency, the forerunner of
United Parcel Service today.
Architectural Importance - The architecture of the C & S Freight
Depot is significant because it represents early vernacular
industrial railroad design. Five vernacular architecture styled
. railroad depots were built in Fort Collins over the years; only
three remain of which two are freight depots. Constructed in
1906 by the Cole and Potter Construction Company of Fort Collins,
the C & S Freight Depot was the last to be used as an active
railroad facility, being retired in May 1986. It was built of
150, 000 bricks manufactured by the historic Fort Collins Pressed
Brick Co.
For these reasons, staff is pleased to recommend the Colorado &
Southern Freight Depot for landmark designation.
