SUBJECT:
First Reading of Ordinance No. 126, 2001, Authorizing the Transfer of Appropriations from the
Transit Services Fund to the Capital Projects Fund CSU Transit Center Capital Project to be Used
For the Final Design and Site Preparation/Construction of the CSU Transit Center.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
FINANCIAL IMPACT:
The projected cost for the design, construction, and equipment of the CSU Transit Center is
$10,000,000. The funding sources are projected to be$8,000,000 federal,and$2,000,000 primarily
from Colorado State University from its contribution of approximately 8.21 acres of leased land.
The City has received federal grants to date of$1,794,589(FY2000$1,044,5 89,FY2001 $750,135).
EXECUTIVE SUMMARY:

The City and Colorado State University have been working together since 1996 to develop a campus
Transit Center. Work is expected to begin on final design in the fall. This item authorizes the
P transfer of existing appropriations from the Transit Services Fund to the Capital Projects Fund for
4 final design and site preparation at the CSU Transit Center.
BACKGROUND:
The City and University staffs completed the conceptual design of this Transit Center in 1998 and
presented the proposed project to City Council and the Colorado State Board of Agriculture. Both
legislative bodies provided direction to continue with the development of the project.

j This project includes the lease of land, design and construction of a Transit Center which will be
owned and operated by the City of Fort Collins. The total estimated cost for the project is
$10,000,000 with a federal share of$8,000,000 and a local share of$2,000,000. The City applied
for and has received federal funds totaling $1,794,724.

The local share for the project is being provided through the donation of a long-term lease of the
State-owned property on which the Transit Center will be built.
The project will be designed and constructed in a phased manner to insure that, if all the federal
funds required to complete the total project are not made available, the project will still be able to
function as a transfer point in the City's public transit system.
In an Intergovernmental Agreement signed on November 7,2000, it is outlined that the University
shall be solely responsible for construction management of the project and the City will hire the
contractors and vendors and handle paying of invoices. The City of Fort Collins will be responsible
for the operation and maintenance of the facility
The plan is to complete the final design by October 2001, bid the project and start construction in
January 2002. The City will submit federal grant requests in 2002 and 2003 to complete the project.
If all grants are approved,the project could be completed by December 2004.
The transfer of these funds to the Capital Projects fund will permit staff to begin the design and site
preparation work.
ORDINANCE NO. 126, 2001
is OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE TRANSFER OF APPROPRIATIONS FROM THE
TRANSIT SERVICES FUND TO THE CAPITAL PROJECTS FUND
CSU TRANSIT CENTER CAPITAL PROJECT TO BE USED
FOR THE FINAL DESIGN AND SITE PREPARATION/CONSTRUCTION
OF THE CSU TRANSIT CENTER
WHEREAS,the City and Colorado State University(CSU)have been working together since
1996 to develop a campus transit center; and
WHEREAS, the City and CSU staffs have completed the conceptual design of the CSU
Transit Center in 1998 and presented the proposed project to City Council and the Colorado State
Board of Agriculture; and
WHEREAS, both City Council and the Colorado State Board of Agriculture provided
direction to continue with the development of the CSU Transit Center project; and
WHEREAS, the project includes the lease of land, design and construction of a Transit
Center which will be owned and operated by the City of Fort Collins; and
WHEREAS,the project will be designed and constructed in a phased manner to ensure that,
if all the federal funds required to complete the total project are not made available, the project will
still be able to function as a transfer point in the City's public transit system; and
WHEREAS, the total estimated cost for the project is $10,000,000 with funding sources
projected to be $8,000,000 from Federal grants and $2,000,000 local share in the form of CSU's
contribution of approximately 8.21 acres of leased land; and
WHEREAS,the City has applied for,received and appropriated in the Transit Services Fund
Section 5309 Federal Transit Administration grant funds totaling $1,794,724; and
WHEREAS, under Article V, Section 10 of the Charter of the City of Fort Collins (the
"Charter") the City Council may, by ordinance, upon the recommendation of the City Manager,
transfer any unexpended and unencumbered appropriated amount or portion thereof from one fund
or capital project account to another fund or capital project account provided that the purpose for
which the transferred funds are to be expended remains unchanged; and
WHEREAS, pursuant to Section 23-304 of the City Code, one percent (1%) of the funds
appropriated for the construction of capital projects should be set aside in the Art in Public Places
Reserve account in the Cultural Services and Facilities Fund,for use in the acquisition or leasing of
works of art, maintenance,repair or display of works of art, and administrative expenses related to
the Art in Public Places Guidelines adopted by Council in Ordinance No. 47, 1998; and
WHEREAS, the purpose for which the Federal Transit Administration grant funds in the
Transit Services Fund were initially appropriated remains the same, and the City Manager has
recommended that said unspent and unencumbered funds be transferred into the Capital Projects
Fund,CSU Transit Center capital project and that such funds be earmarked for expenditure for the
final design and site preparation/construction of the proposed CSU Transit Center; and
WHEREAS, it is the desire of the Council to authorize the transfer of unspent and
unencumbered appropriations, totaling $1,794,724, from the Transit Services Fund to the Capital
Projects Fund, CSU Transit Center capital project to be used for the purpose of design and site
preparation/construction work for the CSU Transit Center,and provide funding for the City's Art in
Public Places program by authorizing the transfer of$17,947 from the CSU Transit Center Capital
Project and the Art in Public Places Reserve Account in the Cultural Services and Facilities Fund.
NOW, THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the sum of ONE MILLION SEVEN HUNDRED NINETY-FOUR
THOUSAND SEVEN HUNDRED TWENTY-FOUR DOLLARS($1,794,724)is hereby authorized
for transfer from the Transit Services Fund to the Capital Project Fund, CSU Transit Center capital
project and appropriated therein for the purpose of design and site preparation/construction work for
the CSU Transit Center.
Section 2. That the unexpended appropriated amount of SEVENTEEN THOUSAND NINE
HUNDRED FORTY-SEVEN DOLLARS($17,947)is hereby authorized for transfer from the CSU
Transit Center capital project in the Capital Projects Fund to the Art in Public Places Reserve
Account in the Cultural Services and Facilities Fund, and appropriated therein to be used for art
associated with the design and construction of the CSU Transit Center.
Introduced, considered favorably on first reading and ordered published this 21st day of
