Resolution 2001-13 Authorizing a Revocable Permit Over a Portion of Westfield Park for
Construction of Seneca Street by Miramont Associates.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
EXECUTIVE SUMMARY:
The City's Master Street Plan requires that Seneca Street be constructed along the easterly boundary
of Westfield Park. The right-of-way for Seneca Street will be dedicated on the Mountain Ridge
Farm, 3rd Filing Plat, which was approved by the Planning and Zoning Board on October 5, 2000.
In order for Miramont Associates to construct Seneca Street, a 100-ft. wide (84,961 s.f.) revocable
permit to use the easterly boundary of Westfield Park is needed from the City for grading and for
reconstruction of the public sidewalk. Staff has reviewed and recommends approval of the revocable
permit.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING A REVOCABLE PERMIT
OVER A PORTION OF WESTFIELD PARK
FOR CONSTRUCTION OF SENECA STREET BY MIRAMONT ASSOCIATES
WHEREAS, the City of Fort Collins (the "City") is the owner of the property known as
Westfield Park in Latimer County, Colorado (hereinafter referred to as the "Park"); and
WHEREAS, the City's Master Street Plan requires that the right-of-way for Seneca Street
be constructed along the easterly boundary of the Park and is dedicated on the Mountain Ridge Farm,
3rd Filing Plat; and
WHEREAS, Miramont Associates, the developer,has requested permission to temporarily
occupy a I00-foot wide (84,961s.f.) parcel of City-owned land along the easterly boundary of the
Park, which parcel is legally described on Exhibit"A", attached hereto and incorporated herein by
this reference(the"Construction Area"),for the purpose of grading and reconstruction of the public
sidewalk in connection with construction of the Seneca Street improvements; and
WHEREAS,Article XI, Section 10,of the Charter of the City of Fort Collins authorizes the
Council to permit the use or occupation of any street, alley, or public place, provided that such
permit shall be revocable by the Council at its pleasure, whether or not such right to revoke is
expressly reserved in such permit.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor is authorized to execute such documents as are necessary to grant a
revocable permit in the land described on Exhibit"A,"consistent with this Resolution,to Miramont
Associates in connection with its construction of Seneca Street.
Passed and adopted at a regular meeting of the City Council of the City of Fort Collins held

That Portion of the Northeast Quarter of Section 34, Township 7 North, Range 69 West of the 6th
P.M., City of Fort Collins,County of Larimer, State of Colorado being more particularly described
as follows:
A One Hundred (100) foot Temporary Construction Easement lying West of and adjacent to the
Westerly Right of Way of Seneca Street as platted with Mountain Ridge Farm P.U.D. 3rd Filing,to
the City of Fort Collins being more particularly described as follows:
Considering the South line of said Northeast Quarter as bearing South 89°56'24" East and with all
bearings contained herein relative thereto:
Beginning at the Southwest corner of said Northeast Quarter; thence along the South line of said
Northeast Quarter, South 89°56'24" East 784.56 feet to the True Point of Beginning; thence
continuing along said South line, South 89°56'24"East 100.00 feet to the Westerly Right of Way of
Seneca Street said point being on a curve concave to the Southwest having a central angle 19°05'29"
with a radius of 576.00 feet, the long chord of which bears North 09°29'09" West at a distance of
191.04 feet; thence departing said South line and along said Westerly Right of Way the following
five (5) courses and distances and Northwesterly along the arc of said curve 191.93 feet; thence
tangent from said curve North 19001'53" West 309.13 feet to the beginning of a tangent curve
concave to the East having a central angle 23°59'57" with a radius of 644.00 feet, the long chord of
which bears North 07°01'51"West at a distance 267.78 feet; thence Northerly along the arc of said
